Regulations on the mode of constant state surveillance on production facilities of the affinaging organizations and organizations performing sorting, primary classification and primary assessment of gemstones

1. This Provision establishes procedure of constant state surveillance on production facilities of the affinaging organizations and organizations performing sorting, primary classification and primary assessment of the gemstones included in the list of production facilities of the affinaging organizations and organizations performing sorting, primary classification and primary assessment of gemstones concerning which the mode of constant state surveillance approved by the order of the Government of the Russian Federation of December 12, 2015 No. 1356 "About the mode of constant state surveillance on production facilities of the affinaging organizations and organizations performing sorting, primary classification and primary assessment of gemstones" is set (further respectively - production facilities, the organizations) when implementing federal state assay supervision (further - constant state surveillance).

2. Constant state surveillance on production facilities is exercised by Federal assay chamber and federal state institution "Public Institution on Forming of the State Fund of Precious Metals and Gemstones of the Russian Federation, Storage, Leave and Use of Precious Metals and Gemstones (Gokhran of Russia) under the Ministry of Finance of the Russian Federation" (further - public institution).

3. Constant state surveillance provides possibility of permanent stay on production facilities of authorized officers of Federal assay chamber, public institution (further - authorized persons) and holding actions for control of production, extraction, conversion, use, storage and accounting of precious metals by them, observance of established procedure of sorting, primary classification and primary assessment of gemstones.

4. Lists of the authorized persons of Federal assay chamber and public institution exercising constant state surveillance affirm orders of heads of Federal assay chamber and public institution respectively in coordination with the Ministry of Finance of the Russian Federation and go to heads of the organizations by the registered mail with the assurance of receipt.

5. The authorized persons exercising constant state surveillance shall observe regime requirements, and also the regulations established on production facilities of the organizations.

6. Heads of the organizations shall provide to authorized persons easy access to production facilities, documents and control facilities on production facilities in case of presentation by authorized persons of the official ID.

7. When implementing constant state surveillance observance (accomplishment) is performed:

a) on production facilities of the affinaging organizations:

procedure for making of transactions with the mineral raw material containing precious metals to refining;

requirements to accounting and storage of precious metals, gemstones and products from them, and also to maintaining the corresponding reporting;

requirements to carrying out inventory count of precious metals;

requirements for ensuring the most complete extraction of precious metals from raw materials according to technological standard rates;

requirements of the legislation on counteraction of legalization (washing) of income gained in the criminal way, and to financing of terrorism on identification of suppliers of raw materials and receivers of the affined precious metals;

requirements for ensuring completeness of accounting, collection, conversion and realization of scrap and waste of precious metals;
