Rules of implementation of federal state assay supervision

1. These rules establish procedure of federal state assay supervision.

2. Federal state assay supervision is directed to the prevention, identification and suppression of violations by legal entities, the individual entrepreneurs performing production, use, the address of precious metals in any condition and type, sorting, primary classification and primary assessment of gemstones, their use and the address, the requirements established by international treaties of the Russian Federation, the Federal Law "About Precious Metals and Gemstones", other Federal Laws and other regulatory legal acts of the Russian Federation in the field of production, use and the address of precious metals, and also production (regarding sorting, primary classification and primary assessment of gemstones), uses and addresses of gemstones (further - mandatory requirements), by the organization and conducting checks of specified persons, acceptances of stipulated by the legislation measures of the Russian Federation for suppression and (or) elimination of consequences of the revealed violations, the analysis and forecasting of condition of execution of mandatory requirements when implementing by legal entities and individual entrepreneurs of the activities.

Subject of implementation of federal state assay supervision is observance of mandatory requirements by the legal entities and individual entrepreneurs performing production, use, the address of precious metals in any condition and type and also sorting, primary classification and primary assessment of gemstones, their use and the address.

3. Federal state assay supervision is exercised by means of:

a) establishments of the mode of constant state surveillance concerning production facilities of the affinaging organizations and the organizations performing sorting, primary classification and primary assessment of gemstones which list affirms the Government of the Russian Federation;

b) planned and unplanned (in the form of documentary and (or) exit) checks of legal entities and individual entrepreneurs.

4. Federal state assay supervision is exercised by Federal assay chamber, and also federal state institution "Public Institution on Forming of the State Fund of Precious Metals and Gemstones of the Russian Federation, Storage, Leave and Use of Precious Metals and Gemstones (Gokhran of Russia) under the Ministry of Finance of the Russian Federation" (further - public institution).

5. Are performed by the Ministry of Finance of the Russian Federation:

a) ceased to be valid

b) normative legal and methodical support of the relations connected with implementation of federal state assay supervision within the powers;

c) organization and coordination of activities of Federal assay chamber and public institution;

d) monitoring of results and efficiency of federal state assay supervision;

e) other powers, stipulated by the legislation the Russian Federation in the sphere of implementation of federal state assay supervision.

6. By public institution it is performed:

a) constant state surveillance on production facilities of the organizations performing sorting, primary classification and primary assessment of gemstones;

b) acceptance of stipulated by the legislation measures of the Russian Federation for suppression and (or) elimination of consequences of the revealed violations;

c) the analysis and forecasting of condition of execution of mandatory requirements when implementing by legal entities and individual entrepreneurs of sorting, primary classification and primary assessment of gemstones.

6(1). By federal assay chamber it is performed:

a) development and approval of annual plans of conducting planned inspections of legal entities and individual entrepreneurs, finishing them to data of interested persons, submission of plans to bodies of prosecutor's office and their coordination;

b) constant state surveillance on production facilities of the affinaging organizations;

c) organization and carrying out scheduled and unscheduled inspections of observance of mandatory requirements by legal entities and individual entrepreneurs;

d) the analysis and forecasting of condition of execution of mandatory requirements when implementing by legal entities and individual entrepreneurs of production, use, the address of precious metals in any condition and type, uses and addresses of gemstones;

e) acceptance of stipulated by the legislation measures of the Russian Federation for suppression and (or) elimination of consequences of the revealed violations.

7. The officials authorized on implementation of federal state assay supervision are:

a) ceased to be valid

d) the head and deputy managers of public institution to whom according to official regulations implementation of federal state assay supervision is assigned;

e) chiefs and deputy chiefs of structural divisions of public institution to whom according to official regulations implementation of federal state assay supervision is assigned;

e) employees of structural divisions of public institution to whom according to official regulations implementation of federal state assay supervision is assigned;

g) chiefs and deputy chiefs of territorial authorities of Federal assay chamber to whom according to official regulations implementation of federal state assay supervision is assigned;

h) employees of territorial authorities of Federal assay chamber to whom according to official regulations implementation of federal state assay supervision is assigned;

i) the head and deputy managers of Federal assay chamber to whom according to official regulations implementation of federal state assay supervision is assigned;

j) chiefs and deputy chiefs of structural divisions of Federal assay chamber to whom according to official regulations implementation of federal state assay supervision is assigned;

k) employees of structural divisions of Federal assay chamber to whom according to official regulations implementation of federal state assay supervision is assigned.
