1. Approve:

1) the standard rate of inventory by types of pesticides according to appendix 1 to this order;

2) Rules of use of inventory of pesticides according to appendix 2 to this order.

2. Declare invalid the order of the acting minister of agricultural industry of the Republic of Kazakhstan of April 6, 2012 No. 18-03/159 "About approval of Rules of use of inventory of pesticides (agricultural chemicals)" (No. 251-253 (27070-27072)) published on August 4, 2012 in the Kazakhstanskaya Pravda newspaper is registered in the Register of state registration of regulatory legal acts No. 7645,.

3. To provide to committee of the state inspection in agro-industrial complex of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan and the intranet portal of state bodies.

4. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of use of inventory of pesticides

Chapter 1. General provisions

1. These rules of use of inventory of pesticides (further – Rules) are developed according to the subitem 21) of article 6 of the Law of the Republic of Kazakhstan "About protection of plants" (further – the Law) and determine procedure for use of inventory of pesticides.

2. The inventory of pesticides represents certain amount of regularly updated pesticides and is the state-owned property which is under authority (order) of Committee of the state inspection in agro-industrial complex of the Ministry of Agriculture of the Republic of Kazakhstan (further - Committee).

3. The inventory of pesticides is intended for liquidation of unexpected mass distribution of especially dangerous harmful organisms and is created of amount of the pesticides which were purchased at the expense of budgetary funds on the basis of phytosanitary monitoring taking into account the developing phytosanitary situation.

4. Ensuring forming and control of safety, use of inventory of pesticides is performed by Committee.

Chapter 2. Procedure for use of inventory of pesticides

5. Use of inventory of pesticides is performed on distribution of the Chief state inspector on protection of plants of the Republic of Kazakhstan (further - the state inspector) in the following cases:

1) flashes of mass distribution of especially dangerous harmful organisms included in the List of especially dangerous harmful organisms approved by the order of the Minister of Agriculture of the Republic of Kazakhstan of March 30, 2015 No. 4-4/282 (it is registered in the Register of state registration of regulatory legal acts No. 11739), and to exceeding of forecast amounts;

2) penetrations it (is filled in) especially dangerous harmful organisms from the adjacent states and need of unplanned holding phytosanitary actions.

6. Information on flash of mass distribution, exceeding of forecast amounts or penetration (fly) especially dangerous harmful organisms is confirmed by the act of carrying out inspections on population (infectiousness), in form according to appendix 1 to these rules which is constituted by specialists of the state organization performing phytosanitary monitoring and affirms heads of regional territorial inspections of Committee.

7. Information on flash of mass distribution, exceeding of forecast amounts or penetration (fly) especially dangerous harmful organisms it is represented in Committee within 1 (one) calendar day.

8. In case of receipt of information on emergence of the cases provided in Item 5 of these rules, the state inspector within 1 (one) working day approves distribution of inventory of pesticides taking into account type of especially dangerous harmful organism.

9. In case of distribution of inventory of pesticides the order which goes Committee to the organization performing stock holding of pesticides within 1 (one) working day is drawn up.

The order about provisions of vehicles for transportation of inventory of pesticides goes Committee to transport organization within 1 (one) working day.

10. The organization performing stock holding of pesticides provides their issue to transport organization for transportation to places of application.

The transport organization performs delivery of inventory of pesticides to regions to places of their application.

Issue and transportation of inventory of pesticides is made with execution of the relevant documents.
