About approval of the Regulations on procedure for use of lands for the state natural parks of the Kyrgyz Republic

For the purpose of streamlining of process of use of lands of the state natural parks of the Kyrgyz Republic, according to the Law of the Kyrgyz Republic "About especially protected natural territories" the Government of the Kyrgyz Republic decides:

1. Approve Regulations on procedure for use of lands for the state natural parks of the Kyrgyz Republic according to appendix.

2. To the state agency of environmental protection and forestry under the Government of the Kyrgyz Republic to take the necessary measures following from this resolution.

3. To impose control of execution of this resolution on department of agro-industrial complex and ecology of Government office of the Kyrgyz Republic.

4. This resolution becomes effective after ten days from the date of official publication.

Regulations on procedure for use of lands for the state natural parks of the Kyrgyz Republic

1. General provisions

1. This Provision is developed according to the Law of the Kyrgyz Republic "About especially protected natural territories" and regulates questions of use of lands of the state natural parks of the Kyrgyz Republic.

2. In the state natural parks the following zones are allocated:

- reserved;

- ecological stabilization;

- tourist and recreational activities;

- limited economic activity.

3. In zones of ecological stabilization, tourist and recreational activities, limited economic activity (further - regime zones) implementation of activities according to the legislation of the Kyrgyz Republic is allowed.

4. In the territory of the state natural parks implementation of the actions directed to quality degradation and depletion of natural resources and objects, and also breaking the differentiated mode of special protection is forbidden.

5. Any activities in zones of ecological stabilization, tourist and recreational activities, and also limited economic activity shall be performed according to requirements of the legislation of the Kyrgyz Republic in the field of nature protection, forest and land regulation.

6. In temporary use the parcels of land of the state natural parks located in the zones specified in Item 3 this provision in accordance with the established procedure can be provided to legal entities and physical persons of the Kyrgyz Republic.

7. The concepts applied in this Provision:

the state natural parks - especially protected natural territories with the status of nature protection and scientific institution intended for preserving biological and landscape diversity, use in the nature protection, ecological and educational, scientific, tourist and recreational purposes of the unique natural complexes and objects of the state natural and reserved fund having special ecological, scientific, historical and cultural and recreational value (further - administration of the state natural park);

zone of ecological stabilization - the territory of the state natural parks in which borders the protection mode with prohibition of economic and recreational activity, except for regulated ecological tourism and holding actions for recovery of the broken natural complexes and objects is set;

zone of tourist and recreational activities - the territory of the state natural parks in which borders the protection mode providing preserving natural complexes and objects in the territory of which regulated tourist and recreational activities, including the organization of tourist routes, tracks, the device of camp parking and observation decks, taking into account regulations of recreational loadings are allowed is set;

the zone of limited economic activity - the territory of the state natural parks in which borders subjects to administrative appointment can be placed is conducted the economic activity necessary for ensuring protection and functioning of the state natural park, servicing of his visitors the construction and operation of hotels, campings, the museums and other objects for servicing of tourists is performed;

the agreement on temporary use the parcel of land - the agreement signed between administration of the state natural park and person who won competition in which conditions of temporary use are discussed by the parcel of land of regime zone of the state natural park determines the rights and obligations of the Parties, and also terms of temporary use and other conditions are specified;

tender - bidding procedure in case of which provision in temporary use of the parcels of land in borders of regime zones of the state natural parks is made;

commercial tender - form of tender which winner the person who won competition, offered the greatest amount of payment for temporary use by the parcel of land in regime zone of the state natural park with obligatory observance of the established competitive conditions is recognized;

investment tender - form of tender which winner person who won competition who, except obligations of observance of competitive conditions, shall enclose also investments into improvement of the parcel of land in regime zone of the state natural park provided in temporary use is recognized.

8. This Provision does not regulate the questions of provision of the parcels of land in regime zones of the state natural parks connected with safety of the Kyrgyz Republic.

2. Use of the parcels of land in borders of regime zones of the state natural parks

9. In regime zones of the state natural park the following types of activity are performed:

- in zone of ecological stabilization:

a) regulation of ecological activities of tourism taking into account scientific recommendations, with observance of recreational loadings and regulations;

b) holding actions for recovery of the broken natural complexes and objects;

- in zone of tourist and recreational activities:

a) regulation of tourist and recreational activities;

b) organization of tourist routes and tracks;

c) the device of camp parking and observation decks taking into account regulations of recreational loadings;

- in zone of limited economic activity:

a) placement of subjects to administrative appointment;

b) conducting the economic activity necessary for ensuring protection and functioning of the state natural park, servicing of his visitors;

c) implementation of construction and operation of hotels, campings, museums and other objects;

d) placement of subjects to administrative appointment for servicing of tourists;

e) development of ecological tourism and rendering tourist services;

e) according to the recommendation of the scientific organizations, creation fruit and berry and orchards, plantations on cultivation of fast-growing breeds and other valuable cultures of local grades;

g) procurement of wood according to materials of forest management and rules of cabins in the woods of the Kyrgyz Republic;
