1. General provisions

1. These rules of recalculation of the retirement benefits for long service appointed till January 1, 1998 which size did not increase since June 1, 2006 (further – Rules) are developed according to Item 13 of article 73 of the Law of the Republic of Kazakhstan of June 21, 2013 "About provision of pensions in the Republic of Kazakhstan" (further – the Law) and determine procedure for recalculation of the retirement benefits for long service appointed till January 1, 1998 which size did not increase since June 1, 2006 (further – retirement benefits).

2. The retirement benefits to the employees serving in bodies of prosecutor's office, except for bodies of military prosecutor's office (further – employees) appointed till January 1, 1998 are subject to recalculation.

3. Recalculation of retirement benefits is performed by territorial subdivisions of Committee of work, social protection and migration of the Ministry of health and social development of the Republic of Kazakhstan.

4. Data on position, the class rank, length of service, working life for recalculation of retirement benefits are filled in with the Republican state state company "State Center for Pension Payment" (further – the center) in form according to appendix 1 to these rules according to the data which are available in pension case and go to the Prosecutor General's Office of the Republic of Kazakhstan, till January 10, 2016.

Data on official pay rate on the similar or equated position and surcharge for the class rank of employees for July 1, 2005 are filled in with the Prosecutor General's Office of the Republic of Kazakhstan and are represented within five working days to the center for form according to appendix 1 to these rules.

7. Monetary pay for July 1, 2005 is determined by summing of official pay rate of the employee by the similar or equated position for July 1, 2005 and surcharges for the class rank for July 1, 2005 on the class rank corresponding on the date of purpose of retirement benefits.

8. The indicator of length of service is determined as a percentage, depending on length of service on military service, service in special state and law enforcement agencies, the public courier service, and working life, according to appendix 2 to these rules.
