for the purpose of ensuring legal turnover of goods,

agreed as follows:

Article 1

For the purposes of this agreement concepts which mean the following are used:

"competent (authorized) body of state member" - the executive body of state member authorized according to the legislation of state member to provide:

control of turnover of goods on which the decision on marking is made by control (identification) signs;

functioning of national system of marking of goods control (identification) signs;

coordination of activities of executive bodies of state member for control of turnover of goods on which the decision on marking is made by control (identification) signs;

"control (identification) sign" - the form of the strict reporting with elements (means) of protection against counterfeit (the protected printed material) intended for marking of goods. Use of the control (identification) signs containing the built-in radio-frequency tag is allowed;

"marking by control (identification) signs" - drawing on goods of control (identification) signs of the approved sample;

"turnover of goods" - storage, transportation, production, import to customs area of the Eurasian Economic Union, acquisition and realization (sale) of goods in the territories of state members;

"wholesale trade" - the type of trading activity connected with acquisition and sales of goods for their use in business activity (including for resale) or in other purposes which are not connected with personal, family, home and other similar use;

"retail trade" - the type of trading activity connected with acquisition and sales of goods for their use in the personal, family, house and other purposes which are not connected with implementation of business activity;

"goods" - products on goods item of the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union "Articles of clothing, belongings to clothes and other products, from natural fur" on which the decision on marking is made by control (identification) signs;

"trading activity" - the type of business activity connected with acquisition and sales of goods;

"cross-border trade in goods" - the wholesale trade by goods performed from the territory of one state member on the territory of other state member.

Article 2

1. This agreement determines procedure for introduction of marking by control (identification) signs (further - control signs) goods in case of realization in 2015 - 2016 of pilot project by introduction of marking of goods on goods item "Articles of clothing, belongings to clothes and other products, from natural fur" on which the decision on marking is made by control signs.

2. Action of this agreement extends to the legal relationship connected with turnover of goods on goods item "Articles of clothing, belongings to clothes and other products from natural fur" on which the decision on marking by control signs, and also on the legal entities and physical persons registered as the individual entrepreneurs performing turnover and (or) use of such goods when implementing business activity is made.

Article 3

1. Council of the Eurasian economic commission approves the inventory, subject to marking by control signs (further - the List).

2. The decision of Council of the Eurasian economic commission (further - the decision) about approval of the List becomes effective not earlier than after 60 calendar days from the date of official publication of such decision. The decision on goods exception of the List becomes effective according to the procedure, stipulated in Item 16 Regulations on the Eurasian economic commission ( appendix No. 1 to the Agreement on the Eurasian Economic Union of May 29, 2014).

3. The goods included in the List, imported (imported) on customs area of the Eurasian Economic Union (further - the Union) and (or) made in the territories of state members except as specified, stipulated in Item the 5th this Article are marked by control signs.

Marking by control signs of the goods included in the List outside customs area of the Union is allowed.

4. From the effective date decisions on approval and (or) change of the List:

a) acquisition, storage, use, transportation and sale in the territories of state members by legal entities and individual entrepreneurs of the goods included in the List without control signs or with the control signs applied on them in defiance of established procedure, except for transportations of the goods included in the List, in the specialized storage facilities determined according to Item 6 of Article 6 of this agreement, and storage of the specified goods in such rooms is forbidden;

b) goods placement, included in the List, under customs procedures of reimport and release for internal consumption is performed in the presence of control signs on such goods except as specified provided by the paragraph the second this subitem and Item 5 of this Article.

Marking by control signs can be performed after release of goods for internal consumption in the specialized storage facilities determined according to Item 6 of Article 6 of this agreement if the possibility of such marking is stipulated by the legislation state member.

5. Requirements about marking by control signs of the goods included in the List do not extend on:

a) transportation of the goods placed under customs procedures in case of their export out of limits of customs area of the Union;

b) transportation of goods under customs control;

c) transportation and storage of tests and samples of goods in the necessary quantities intended for carrying out testing for the purpose of assessment of conformity to requirements of technical regulations, and also normative technical acts in the field of standardization;

d) the goods imported on customs area of the Union by organizers and participants of the international exhibitions and fairs as samples and exhibits;

e) the goods which are the foreign free (humanitarian) aid registered according to the procedure, established by the legislation of state member;

e) the transportation and storage of the goods acquired within retail trade and returned to sellers by buyers, performed according to the procedure, determined by the legislation of state member, on condition of availability of the documents confirming return of goods;

g) realization (sale) of goods in duty-free shops;
