About approval of Operational regulations of vehicles

According to subitem 23-10) of article 13 of the Law of the Republic of Kazakhstan of July 4, 2003 "About road transport" PRIKAZYVAYU:

1. Approve the enclosed Operational regulations of vehicles.

2. To committee of transport of the Ministry for Investments and Development of the Republic of Kazakhstan (Asavbayev A.A.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printed publicity materials and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) 2) and 3) Item 2 of this order.

To impose control of execution of this order on the supervising Vice-Minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Operational regulations of vehicles

1. General provisions

1. These rules of technical operation of vehicles (further - Rules) are developed according to subitem 23-10) of article 13 of the Law of the Republic of Kazakhstan of July 4, 2003 "About road transport" and determine procedure for carrying out complex of the actions, technical impacts (diagnosing, technical maintenance, repair) directed to the organization and ensuring safe operation of vehicles.

2. Provisions of these rules extend on the physical persons and legal entity performing operation of vehicles in the territory of the Republic of Kazakhstan.

3. In these rules the following basic concepts are used:

1) serviceable condition - the technical condition conforming to all requirements of these rules and design documentation shown to design, parameters, functional purpose and properties of aggregates, nodes and details of vehicles;

2) reliability - the technical condition of aggregates, nodes and details of the vehicle providing accomplishment of the set functions, preserving operating characteristics in the set limits in case of the set operational modes and operating conditions, maintenance, repair and storage;

3) non-operational condition - the technical condition inappropriate at least to one of requirements of these rules, and the design documentation shown to design, parameters, functional purpose and properties of aggregates, nodes and details of vehicles;

4) planned works of maintenance (further - planned works) - complex of transactions which accomplishment is aimed at safety control of traffic and decrease in harmful effects of vehicles on the environment;

5) technical condition - set subject to change in use properties and the set design documentation issued by manufacturing plant of parameters of the aggregates, nodes and details of the vehicle determining possibility of accomplishment by them of the functions or their application to destination;

6) maintenance (further - TO) - complex of transactions (technical impacts) allocated for maintenance of vehicles in good repair, movement safety control, environment protection in the course of their operation and storage;

7) technical operation of vehicles - complex of the actions, technical impact (diagnosing, technical maintenance, repair) directed to the organization and ensuring safe operation of vehicles;

8) specially authorized organization - the legal entity or structural division of the legal entity operating from his name, accredited according to requirements of state standard of GOST ISO/IEC 17020-2013 "Assessment of conformity. Job requirements of different types of the bodies which are carrying out inspections" on implementation of works on carrying out periodic tests of the gas-balloon equipments installed on vehicles.

4. Ensuring reliability of vehicles, their safe movement on roads with the minimum negative impact on the environment is reached by realization of scheduled preventive system of maintenance and repair (further - System).

The system represents set of the regulating documentation, contractors and the means of maintenance and repair necessary for providing serviceable condition of vehicles in the course of their operation and storage.

5. The regulating documentation on maintenance and repair of vehicles establishes the principles, determinations, recommendations, technology, standard rates and methods of their adjustment taking into account operating conditions and consists of the these rules, interstate, national standards and other regulating documents on standardization existing in the territory of the Republic of Kazakhstan, design documentation and the maintenance manual on specific brand (model) on the vehicle.
