About the state land cadastre

Article 1. Purpose of this Law

The purpose of this Law is establishment of the legal basis of maintaining the state land cadastre, use of inventory data for development of economy, providing guarantees of the rights to the parcels of land, rational use, recovery and protection of lands.

Article 2. Legislation on the state land cadastre

The legislation on the state land cadastre consists of this Law, other acts of the legislation.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are provided in the legislation of the Republic of Uzbekistan on the state land cadastre then are applied rules of the international treaty.

Article 3. State land cadastre

The state land cadastre is the main component of the Single system of the state inventories and represents system of data and documents on natural, economic, legal regime of lands, their categories, quality characteristic and value, location and the sizes of the parcels of land, their distribution on owners, users, lessees and owners.

The state land cadastre includes: state registration of the rights to the parcels of land, accounting of quantity and quality of lands, appraisal of quality of soils, cost assessment of lands, and also systematization, storage and updating of the land cadastral information.

Article 4. Basic principles of maintaining the state land cadastre

The basic principles of maintaining the state land cadastre are:

completeness of scope of all territory of the country;

application of single system of space coordinates;

unity of technique of development of the land cadastral information;

reliability of the land cadastral information.

Article 5. Public administration in the field of maintaining the state land cadastre

Public administration in the field of maintaining the state land cadastre is exercised by the Cabinet of Ministers of the Republic of Uzbekistan, public authorities on places and the state body which is specially authorized on that.

Specially authorized body of public administration in the field of maintaining the state land cadastre is the Agency according to the inventory under the State Tax Committee of the Republic of Uzbekistan.

Article 6. Powers of the Cabinet of Ministers of the Republic of Uzbekistan in the field of maintaining the state land cadastre

In the field of maintaining the state land cadastre treat powers of the Cabinet of Ministers of the Republic of Uzbekistan:

development of the single state policy directed to rational use of land resources;

determination of the priority directions and the solution of questions in the field of financing and investments;

approval of the annual National status report of land resources;

establishment of procedure for state registration of the rights to the parcels of land and transactions with them;

implementation of other powers according to the legislation.

Article 7. Powers of public authorities on places in the field of maintaining the state land cadastre

On places in the field of maintaining the state land cadastre treat powers of public authorities:

organization of state registration of the rights to the parcels of land and transactions with them;

financing from the local budget of works on maintaining the state land cadastre;

organization and control of maintaining the state land cadastre;

implementation of other powers according to the legislation.

Article 8. Powers of the Agency according to the inventory under the State Tax Committee of the Republic of Uzbekistan in the field of maintaining the state land cadastre

To powers of the State committee of the Republic of Uzbekistan on land resources, geodesy, cartography and the state inventory in the field of maintaining the state land cadastre belong:

the organization of maintaining the state land cadastre in all territory of the Republic of Uzbekistan;

creation of the annual National status report of land resources;

organization and work for determination (refining) of administrative borders of areas, areas and settlements;

development and approval in accordance with the established procedure regulations;

organization of preparation and advanced training of specialists;

implementation of other powers according to the legislation.

Article 10. Maintaining the state land cadastre

Maintaining the state land cadastre is provided with carrying out space shootings, land, cartographic, soil, agrochemical, geobotanical and other inspections and researches, quantitative and high-quality accounting and assessment of lands, state registration of the rights of legal entities and physical persons to the parcels of land:

carrying out space shootings, land, cartographic inspections, inventory count of lands, quantitative accounting of lands, state registration of the rights of the physical persons and legal entities to the parcels of land which are carried out in accordance with the established procedure by the relevant divisions of the Agency according to the inventory under the State Tax Committee of the Republic of Uzbekistan;

creation of reports on availability and use of lands;

creation and maintenance of databanks of the land cadastral information with use of materials of the current inspections, shootings and inventory counts of lands.

Maintaining the state land cadastre is performed by bodies of the Agency for the inventory under the State Tax Committee of the Republic of Uzbekistan.

Maintaining the state land cadastre is performed in the way:

state registration of the rights to the parcels of land and transactions with them;

cadastral survey;

obtaining from owners, users, lessees and owners of the parcels of land of data, check of their reliability, entering of the current changes into land and cadastral documentation.

When maintaining the state land cadastre by the Ministry of Agriculture are performed:

carrying out soil, agrochemical, geobotanical and other inspections and researches;

quantitative and high-quality accounting and assessment of lands.

Article 11. National status report of land resources

The national status report of land resources is constituted annually and includes data on quantitative and high-quality condition of lands both their assessment countrywide and to administrative and territorial units, their distribution on categories, industries, owners, users, lessees, owners of the parcels of land and other land cadastral information.
