1. Approve the enclosed Rules of implementation of the state control of health care.

2. To provide to committee of control of medical and pharmaceutical activities of the Ministry of health and social development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of health and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the Vice-Minister of health and social development of the Republic of Kazakhstan Tsoi A. V.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of implementation of the state control of health care

1. These rules of implementation of the state control in the field of health care (further - Rules) are developed according to the subitem 75) of Item 1 of article 7 of the Code of the Republic of Kazakhstan of September 18, 2009 "About health of the people and health care system" (further - the Code) and determine procedure Committee of control of medical and pharmaceutical activities of the Ministry of health and social development of the Republic of Kazakhstan (further - Committee) and its territorial subdivisions of the state control in the field of health care by means of other forms of control.

2. Other forms of control are carried out with visit of subject (object) of health care according to the subitem 8) of Item 3 of article 10 of the Law of the Republic of Kazakhstan of January 6, 2011 "About the state control and supervision in the Republic of Kazakhstan" in cases of the initiative request of the checked subject (object) of health care for receipt of the conclusion (information) on compliance of its activities to requirements of the legislation of the Republic of Kazakhstan which is not connected with receipt of allowing documents.

3. Subjects (objects) of visit are the following organizations of health care:

1) the organizations giving out-patient and polyclinic help;

2) the organizations giving stationary help;

3) organizations of emergency medical service and sanitary aircraft;

4) organizations of medicine of catastrophic crashes;

5) organizations of recovery treatment and medical rehabilitation;

6) the organizations giving palliative care and sisterly leaving;

7) the organizations performing activities in the sphere of service of blood;

8) the organizations of health care performing pharmaceutical activities;

9) the scientific organizations in the field of health care;

10) the organizations of education in the field of health care;

11) the organizations of health care performing activities in the sphere of forming of healthy lifestyle, healthy food;

12) the organizations of health care performing activities in the sphere of prevention HIV/AIDS;

13) national holdings;

14) the organizations performing assessment of professional readiness and confirmation of conformity of qualification of specialists in the field of health care;

15) the organizations of health care for orphan children, children without parental support, from the birth up to three years, children with defects of mental and physical development from the birth up to four years, performing psychology and pedagogical maintenance of families with risk of refusal of the child.

4. When carrying out other forms of control with visit of subject (object) of health care by Committee or its territorial subdivisions assessment is carried out:

1) readiness of subject (object) of health care for rendering highly specialized medical care (further - VSMP), with creation of the conclusion of the carried-out assessment of conformity of the medical organization to requirements to rendering VSMP in form according to appendix 1 to these rules;

2) availability and compliance of conditions for storage and transportation of medicines to the requirements established according to Item 1 of article 78 of the Code with creation of the inspection statement of any form of availability of conditions for storage and transportation;

3) object in the sphere of drug circulation and the organizations of health care for the purpose of determination of its compliance to requirements proper pharmaceutical the practician, the established subitem 115) Item 1 of article 7 of the Code by results of which the certificate on compliance to requirements proper pharmaceutical the practician in the sphere of drug circulation in form according to appendix 2 to these rules is issued.

5. When carrying out other forms of control are not required registration in authorized body on legal statistics and special accounting and the prior notice of the checked subject (object) of health care.

6. When carrying out other forms of control with visit of subject (object) of health care the Committee or its territorial subdivision notifies bodies for legal statistics and special accounting for the location of the checked subject (object) of health care before their carrying out.
