1. Approve the enclosed Rules of public conveyance, baggage and loads on air transport.

2. To committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan (Seydakhmetov B. K.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printed publicity materials and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of public conveyance, baggage and loads on air transport

1. General provisions

1. These rules of public conveyance, baggage and loads on air transport (further – Rules) are developed according to Item 1 of article 76 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further – the Law), and determine procedure for public conveyance, baggage and loads on air transport.

2. In case of accomplishment of international carriages these rules are applied in the part which is not contradicting the international treaties ratified by the Republic of Kazakhstan, and also to the legislation of the country in the territory from the territory or through the territory of which such transportations are performed.

3. In these rules the following concepts and terms are used:

1) airline – the legal entity having the air operator certificate of civil air vehicles;

2) conditions of airline – condition, instructions and technologies established by airline which are applied in case of airborne transportations of passengers, baggage, loads and mails, and also conditions of application of rates, standards, installations on servicing of passengers and baggage, the appeal of passengers to airline;

3) the receiver – the physical person or legal entity specified in the freight bill as the consignee;

4) collection – airport and fuel collection, levied and entered by airline and included in the freight charge of the passenger, baggage, load and mailings;

5) the excess baggage ticket – the document certifying payment of luggage transport over the established regulation of free transportation or objects which transportation is subject to obligatory payment, and also certifying payment of charges for the announced baggage value;

6) the specific tariff is the rates of economy class having the special conditions and restrictions determined by airline;

7) airline – the established line determining Items between which regular airborne transportations are performed;

8) comfort onboard the air vehicle – the set of the life conditions, conveniences and climate intended for creation of certain fiziko-hygienic conditions to passengers and conveniences of their servicing by flight attendants, caused by configuration of passenger cabin, interior and equipment the necessary equipment and environmental control systems (electrical, oxygen, rescue system, water supply, the sewerage, pressure control, gas composition and air conditioning);

9) airborne transportations – activities of physical persons and legal entities for public conveyance, baggage, loads and mailings air vehicles;

10) the airport – the complex of constructions intended for acceptance and sending air vehicles, servicing of airborne transportations and having airfield, air terminal, other necessary constructions and the equipment for these purposes;

11) baggage – the personal belongings of passengers or crew transported onboard the air vehicle;

12) the act of defects in transit baggage (PIR – PropertyIrreguLarityReport), load (CIR – CarqoIrrequLarityReport) – the document processed by airline in the presence of the passenger (receiver) immediately after detection of the harm done to baggage (load) which transportation is made by air vehicles of one or several airlines which is signed by airline and the passenger (receiver);

13) damage (spoil) of baggage, load – reduction during transportation in unusable condition of baggage, load or part of baggage, load owing to what they cannot be completely or are partially used for the initial designated purpose (lost completely or partially the value);
