1. Approve:

1) Rules of conducting examination of quality of seed cotton and certification about quality of seed cotton, according to appendix 1 to this order;

2) form (sample) of the certificate of quality of seed cotton, according to appendix 2 to this order;

3) form (sample) of the quality certificate of cotton-fiber, according to appendix 3 to this order.

2. To provide to department of production and conversion of crop products and phytosanitary safety of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar day after day of its first official publication.

Rules of conducting examination of quality of seed cotton and certification about quality of seed cotton

1. General provisions

1. These rules of conducting examination of quality of seed cotton and certification about quality of seed cotton (further - Rules) are developed according to the subitem 6) of article 7 of the Law of the Republic of Kazakhstan of July 21, 2007 "About development of cotton industry" and determine procedure for conducting examination of quality of seed cotton and certification about quality of seed cotton.

2. In these rules the following basic concepts are used:

1) the cotton-processing organization - the legal entity having ginnery on the property right, rendering services in slaughtering of seed cotton and warehouse activities with issue of cotton receipts;

1-1) hlopkozagotovitelny organizations – the legal entity performing purchase and procurement of seed cotton;

2) the applicant - the physical person or legal entity which submitted the request for conducting examination of quality of seed cotton;

3) testing - the technical transaction consisting in determination of one or several characteristics of seed cotton;

4) batch of seed cotton - the quantity of seed cotton of one selection and industrial grade, type and class which is drawn up by one accompanying quality certificate;

5) the certificate of quality of seed cotton - the document certifying the actual quality factors of the seed cotton and their compliance to requirements of documents for standardization and terms of the contract concluded between accredited test laboratory (center) and the applicant;

6) examination of quality of seed cotton - package of measures, directed to establishment and confirmation of the actual quality factors of seed cotton, the including selection and testing of test, execution of the certificate of quality of seed cotton;

7) test laboratory (center) (further - laboratory (center)) - the legal entity or structural division of the legal entity which is operating from his name, underwent accreditation according to the Law of the Republic of Kazakhstan of July 5, 2014 "About accreditation in the field of assessment of conformity", and performing examination of quality of seed cotton.

3. The work types on examination of quality of seed cotton performed by laboratory (center) are confirmed by the certificate of accreditation issued by accreditation body.

4. The certificate of quality of seed cotton is issued on each homogeneous batch of seed cotton shipped to one address, one type of the vehicle or intended to simultaneous storage.

2. Procedure for conducting examination of quality of seed cotton and certification about quality of seed cotton

5. Examination of quality of seed cotton includes:

1) sampling;

2) carrying out testing;

3) execution of the certificate of quality of seed cotton.

6. Expertize of quality of seed cotton is carried out based on the agreement (further - the agreement) on work on examination of quality of the seed cotton concluded between laboratory (center) and the applicant.

7. The applicant submits to laboratory (center) the request for conducting examination of quality of seed cotton (further - the request) in form, according to appendix 1 to these rules which is registered and considered by the head of the laboratory (center) within 24 hours from the moment of application.

8. The head of the laboratory (center) determines the specialist in conducting examination of quality of seed cotton to whom the task and the copy of the request are issued (further - the specialist of laboratory (center)).

9. Sampling is made no more than 24 hours from the moment of registration of the request in time.

10. Sampling is made by the specialist of laboratory (center) in the presence of the applicant or his representative and the representative of the hlopkozagotovitelny or cotton-processing organization.
