1. Approve the enclosed Rules of providing citizens with medicines.

2. To provide to committee of control of medical and pharmaceutical activities of the Ministry of health and social development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of health and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the vice-Minister of health and social development of the Republic of Kazakhstan Tsoi A. V.

4. This order becomes effective after day of its first official publication.

Rules of providing citizens with medicines

Chapter 1. General provisions

1. These rules of providing citizens with medicines (further - Rules) are developed according to the subitem 83) of Item 1 of article 7 of the Code of the Republic of Kazakhstan of September 18, 2009 "About health of the people and health care system" (further - the Code) and determine procedure for providing citizens with medicines in the Republic of Kazakhstan.

2. In these rules the following concepts are used:

1) subjects in the sphere of drug circulation of medical appointment and medical products - the physical persons or legal entities performing pharmaceutical activities;

2) objects in the sphere of drug circulation and medical products - drugstore, pharmaceutical Item in the organizations of health care rendering primary medical and sanitary and (or) consulting and diagnostic help, the mobile pharmaceutical unit for the remote rural zones organized from drugstore, pharmaceutical (distributor) warehouse, warehouse of temporary storage of medicines, medical products, shop of optics, shop of medical products, warehouse of medical products, the organizations for production of medicines and medical products;

3) the medicinal form of the organization of health care - the list of medicines for delivery of health care within the guaranteed amount of free medical care and in system of compulsory social medical insurance, created on the basis of the Kazakhstan national medicinal form and approved as the head of the organization of health care according to the procedure, determined by authorized body;

4) pharmaceutical service - the activities of subjects in the sphere of drug circulation and medical products connected with out-patient provision of medicines of the population including purchase, transportation, storage, accounting and realization of medicines and medical products, within the guaranteed amount of free medical care and in system of compulsory social medical insurance;

5) service in accounting and realization of medicines, medical products - the activities of subjects in the sphere of drug circulation, medical products connected with providing the population with medicines, medical products, providing accounting, storage, realization (prescription dispensing) to the population;

6) the single distributor - the legal entity performing within the guaranteed amount of free medical care and in system of compulsory social medical insurance activities according to article 77 of the Code;

7) the Kazakhstan national medicinal form - the list of medicines with the proved clinical safety and efficiency, and also orphan (rare) medicines which is obligatory basis for development of medicinal forms of the medical organizations and forming of lists of purchase of medicines within the guaranteed amount of free medical care and in system of compulsory social medical insurance;

8) fund of social medical insurance - the non-profit organization making accumulation of assignments and fees, and also performing purchase and fee of the subjects of health care providing medical care in amounts and on the conditions provided by the agreement of purchase of medical services and other functions determined by the laws of the Republic of Kazakhstan (further - Fund);

9) the medical organization - the organization of health care which main activities is delivery of health care;

10) information system of the single distributor - the information system determined by the single distributor automating activities of the single distributor and allowing message exchange of electronic documents of the parties of process of distribution (further - information system);

11) information system of accounting of out-patient provision of medicines (further - ISLO) - the information system determined by authorized body in the field of health care for automation of accounting of the statement of recipes, goods issue to suppliers of pharmaceutical service or service in accounting and realization within the guaranteed amount of free medical care (further - GOBMP) and in system of compulsory social medical insurance (further - OSMS).

3. Providing with medicines within GOBMP and OSMS is performed by the medical organizations:

1) when rendering the out-patient and polyclinic help - according to the List of medicines and medical products for free and (or) preferential out-patient ensuring separate categories of citizens with certain diseases (conditions) (further - the List) approved by authorized body according to the subitem 2) of Item 1) of article 88 of the Code.

2) when rendering the fast, stationary and hospital-replacing help - according to medicinal forms of the organizations of health care.

4. The organization of providing citizens with medicines includes:

1) determination of requirement of medicines;

2) purchase of medicines, purchase of services in accounting and realization, pharmaceutical services, distribution (redistribution);
