About production of organic products

Chapter 1. General provisions

Article 1. The basic concepts used in this Law

In this Law the following basic concepts are used:

1) organic products - agricultural products, products of aquaculture and fishery, products from wild-plants and the products of their conversion, including food products made according to requirements of this Law;

2) the producer of organic products - the physical person or legal entity performing activities for development (creation), production of organic products;

3) marking of organic products - information on organic products placed in the form of texts, drawings, signs, symbols, other designations and (or) their combinations on interior package, shipping package or on other type of the data carrier attached to interior package and (or) to shipping package either placed in them or attached to them;

4) national mark of conformity of organic products - the registered mark of compliance informing on passing by production of organic products and organic products of the procedure of confirmation of conformity to the requirements established by the legislation of the Republic of Kazakhstan in the field of production of organic products;

5) production of organic products - set of the types of activity corresponding to methods and acceptances, stipulated by the legislation the Republic of Kazakhstan in the field of production of organic products of which organic products are result;

6) authorized body in the field of production of organic products - the central state body enabling within the competence forming and the realization of state policy, and also cross-industry coordination in the field of production of organic products.

Article 2. Coverage of this Law

This Law governs the relations arising between producers of organic products, other physical persons and legal entities, authorized bodies in the field of production of organic products.

Article 3. The legislation of the Republic of Kazakhstan in the field of production of organic products

1. The legislation of the Republic of Kazakhstan in the field of production of organic products is based on the Constitution of the Republic of Kazakhstan and consists of this Law and other regulatory legal acts of the Republic of Kazakhstan.

2. If the international treaty ratified by the Republic of Kazakhstan establishes other rules, than those which contain in this Law then are applied rules of the international treaty.

Article 4. The purposes and tasks of legal regulation in the field of production of organic products

1. The purposes of legal regulation in the field of production of organic products are:

1) creating favorable conditions for development of production of organic products;

2) preserving natural resources;

3) use of steady management systems natural resources, including the soil, water, air, maintenance of biodiversity;

4) improvement of quality of food;

5) creation of national brand of organic products.

2. Tasks of legal regulation in the field of production of organic products are:

1) public health care and consumer protection;

2) assistance to preserving environment;

3) inspection and certification of production of organic products and organic products;

4) development of the domestic market of organic products and requirements satisfaction of the population of the Republic of Kazakhstan in organic products;

5) increase in export of organic products;

6) providing measures of the state support of organic products to producers.

Article 5. The principles in the field of production of organic products

The principles in the field of production of organic products are:

1) assistance in forming of healthy power supply;

2) restriction of use of non-renewable natural resources;

3) providing ecological safety and preserving ecological systems;

4) preserving and reproduction of fertility of soils.

Chapter 2. State regulation in the field of production of organic products

Article 6. Competence of the Government of the Republic of Kazakhstan in production of organic products

The government of the Republic of Kazakhstan develops the main directions of state policy in the field of production of organic products and will organize their implementation.

Article 7. Competence of authorized bodies in production of organic products

1. Authorized body in the field of production of organic products within the competence:

Creates 1) and implements state policy, and also performs cross-industry coordination in the field of production of organic products;

Develops 2) and approves rules of maintaining the register of producers of organic products;

Develops 3) and approves rules of production and turnover of organic products in coordination with state body in the field of sanitary and epidemiologic wellbeing of the population and authorized body in the field of consumer protection;

Develops 4) and approves the list of the permitted means applied in case of production of organic products in coordination with state body in the field of sanitary and epidemiologic wellbeing of the population and authorized body in the field of consumer protection;

5) is enhanced by the legislation of the Republic of Kazakhstan in the field of production of organic products;

6) performs other powers provided by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

2. State body in the field of sanitary and epidemiologic wellbeing of the population within the competence:

1) No. 156-VI ZRK is excluded according to the Law of the Republic of Kazakhstan of 24.05.2018;

2) is performed by approval:

rules of production and turnover of organic products;

the list of the permitted means applied in case of production of organic products;

3) performs other powers provided by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

3. Authorized body in the field of consumer protection within the competence:
