About putting down of apostille on the Russian official documents which are subject to export out of limits of the territory of the Russian Federation

Article 1. Subject of regulation of this Federal Law

This Federal Law governs the relations arising in connection with putting down of apostille on the Russian official documents which are subject to export out of limits of the territory of the Russian Federation and establishes legal and organizational basis and general rules of putting down of apostille in the Russian Federation.

Article 2. The basic concepts and terms used in this Federal Law

In this Federal Law the following basic concepts and terms are used:

1) Convention - The convention canceling the requirement of legalization of foreign official documents of October 5, 1961;

2) authorized body - the federal executive body authorized by the Government of the Russian Federation on bonds with the Hague conference on private international law;

3) competent authority - the federal executive body, body of prosecutor's office of the Russian Federation, executive body of the subject of the Russian Federation given in accordance with the legislation of the Russian Federation authority on putting down of apostille;

4) apostille - the stamp conforming to requirements of the Convention and this Federal Law, which is put down by competent authority on the Russian official document or on the single sheet fastened to this document, and certifying authenticity of the signature and position of person which signed the document and in proper case authenticity of seal or stamp which fasten this document;

5) the register of apostilles - the systematized code of documentary data on the put-down apostilles which is kept by competent authority according to the procedure, determined by this Federal Law;

6) the applicant - the physical person or legal entity which made in competent authority inquiry about putting down of apostille.

Article 3. Normative legal regulation of the relations in the field of putting down of apostille

Legal regulation of the relations arising in connection with putting down of apostille is performed by international treaties of the Russian Federation, this Federal Law, other Federal Laws, other regulatory legal acts of the Russian Federation, and also regulatory legal acts of subjects of the Russian Federation.

Article 4. Powers of competent authorities in the field of putting down of apostille

1. Powers of competent authorities are established by regulatory legal acts of the President of the Russian Federation, the Government of the Russian Federation, and also regulatory legal acts of public authorities of subjects of the Russian Federation.

1.1. By the government of the Russian Federation features of the address with request about putting down of apostille, putting down of apostille and direction of requests, stipulated in Article the 9th this Federal Law, in electronic form and (or) with use of information and telecommunication networks, maintaining the register of apostilles in electronic form, ensuring remote access to data on the put-down apostilles can be established.

2. The procedure for putting down of apostille by competent authorities is established by regulatory legal acts of federal executive bodies, executive bodies of subjects of the Russian Federation, including the administrative regulations of provision of the state services in the field of putting down of apostille accepted in accordance with the legislation of the Russian Federation, regulating provision of the state services.

3. The list of competent authorities is established by the Government of the Russian Federation.

4. The authorized body coordinates activities of competent authorities in the field of putting down of apostille, performs methodical maintenance of the specified activities.

5. For the purpose of interaction with the Hague conference on private international law on the questions connected with execution by the Russian Federation of provisions of the Convention, competent authorities provide to authorized body on its requests information connected with putting down of apostille by competent authorities.

Article 5. Russian official documents

1. As the Russian official documents for the purpose of application of this Federal Law the documents issued in accordance with the legislation of the Russian Federation are considered:

1) federal executive bodies, territorial authorities of federal executive bodies;

2) federal courts, constitutional (authorized) courts and magistrate judges of subjects of the Russian Federation;

3) bodies of prosecutor's office of the Russian Federation;

4) executive bodies of subjects of the Russian Federation;

5) the organizations performing educational activities;

6) local government bodies when implementing of the separate state powers delegated to local government bodies;

7) public and local government offices.

2. As the Russian official documents the documents processed by notaries of the Russian Federation when making notarial actions or the other persons having the right to make notarial actions, and the documents issued by the multipurpose centers of provision of the state and municipal services are also considered.

3. The apostille is not put down on the documents made by diplomatic representations and consular establishments and also on the documents having a direct bearing on commercial or customs transaction including in cases if the specified documents are executed in the form of copies which fidelity is certified by notaries.

Article 6. Term of putting down of apostille

1. The term of putting down of apostille cannot exceed five working days from the date of registration of the applicant's request by competent authority about putting down of apostille if other is not provided by this Federal Law.

2. The term of putting down of apostille can be extended by competent authority to thirty working days in case of need of the direction competent authority of the request provided by part 1 of article 9 of this Federal Law.

3. In case of prolongation of term of putting down of apostille on the basis provided by part 2 of this Article, the competent authority notifies on it the applicant within one working day from the date of decision making about prolongation of term of putting down of apostille.

4. The term of putting down of apostille on the Russian official documents issued by the organizations performing educational activities cannot exceed forty five working days from the date of registration of the applicant's request by competent authority about putting down of apostille. The specified term includes time necessary for competent authority for receipt of information provided by part 1 of article 9 of this Federal Law.
