About approval of standards of the state services in the field of technical inspection

According to the subitem 1) article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services", PRIKAZYVAYU:

1. Approve:

1) the standard of the state service "Certification on the Right of Control of Tractors and the Self-propelled Chassis and Mechanisms Manufactured on Their Base, Self-propelled Agricultural, Meliorative both Roadway Construction Equipments and Mechanisms, and also by Special Machines of the Increased Passability" according to appendix 1 to this order;

2) it is excluded according to the Order of the Deputy prime minister of the Republic of Kazakhstan - the Minister of Agriculture of the Republic of Kazakhstan of 08.02.2017 No. 56

3) the standard of the state service "Issue of the Registration Document (Duplicate) and the State Registration Plate for Tractors and Self-propelled Chassis and Mechanisms, Trail Cars Manufactured on Their Base to Them, including Trail Cars with the Mounted Special Equipment, Self-propelled Agricultural, Meliorative and Roadway Construction Equipments, and also Special Machines of the Increased Passability" according to appendix 3 to this order;

4) the standard of the state service "The State Registration of Pledge (Removal from Registration) of Tractors and the Self-propelled Chassis and Mechanisms, Trail Cars Manufactured on Their Base to Them, including Trail Cars with the Mounted Special Equipment, Self-propelled, Agricultural, Meliorative and Roadway Construction Equipments and Mechanisms, and also Special Machines of the Increased Passability" according to appendix 4 to this order;

5) the standard of the state service "Carrying Out Annual State Technical Inspection of Tractors and the Self-propelled Chassis and Mechanisms, Trail Cars Manufactured on Their Base to Them, including Trail Cars with the Mounted Special Equipment, Self-propelled Agricultural, Meliorative and Roadway Construction Equipments and Mechanisms, and also Special Machines of the Increased Passability" according to appendix 5 to this order;

6) it is excluded according to the Order of the Deputy prime minister of the Republic of Kazakhstan - the Minister of Agriculture of the Republic of Kazakhstan of 19.12.2018 No. 516

2. To provide to department of production and conversion of crop products and phytosanitary safety of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Standard of the state service "Certification on the Right of Control of Tractors and the Self-propelled Chassis and Mechanisms Manufactured on Their Base, Self-propelled Agricultural, Meliorative both Roadway Construction Equipments and Mechanisms, and also by Special Machines of the Increased Passability"

Chapter 1. General provisions

1. The state service "Certification on the Right of Control of Tractors and the Self-propelled Chassis and Mechanisms Manufactured on Their Base, Self-propelled Agricultural, Meliorative both Roadway Construction Equipments and Mechanisms, and also by Special Machines of the Increased Passability" (further - the state service).

2. The standard of the state service (further - the standard) is developed by the Ministry of Agriculture of the Republic of Kazakhstan (further - the Ministry).

3. The state service appears local executive bodies of areas, cities of Astana, Almaty and Shymkent, areas and cities of regional value (further - the service provider).

Reception of an application and issue of result of rendering the state service are performed through:

1) office of the service provider;

2) the web portal of "the electronic government" www.egov.kz, www.elicense.kz (further - the portal).

Chapter 2. Procedure for rendering the state service

4. Terms of rendering the state service:

1) in case of receipt of the certificate of the tractor operator-driver, the duplicate of the certificate, replacement (exchange) of the certificate of old sample, on the new certificate from the date of delivery of document package to the service provider, and also in case of the address on the portal - 2 (two) working days. The service provider within two working days from the date of receipt of documents checks completeness of the submitted documents.

In case of factual determination of incompleteness of the submitted documents the service provider within the specified terms gives written motivated refusal in further review of the statement;

2) the most allowed time of expectation for delivery of document package - 30 (thirty) minutes;

3) the most allowed time of servicing - 30 (thirty) minutes.

5. Form of rendering the state service: electronic (partially automated) or paper.

6. Result of rendering the state service - the certificate, the duplicate of the certificate, when replacing (exchange) of the certificate of old sample, on the new certificate on the right of control of tractors and the self-propelled chassis and mechanisms manufactured on their base, self-propelled agricultural, meliorative both roadway construction equipments and mechanisms, and also by special machines of the increased passability (further - the certificate of the tractor operator-driver).

Form of providing result of rendering the state service: paper. On the portal the result of rendering the state service goes to "personal account" of the uslugopoluchatel in electronic form signed by the digital signature (further - the EDS) the authorized person of the service provider.

7. The state service is rendered on paid basis to physical persons (further - uslugopoluchatel).

For rendering the state service the uslugopoluchatel pays in the budget the state fee according to the procedure, established by the Code of the Republic of Kazakhstan of December 10, 2008 "About taxes and other obligatory payments in the budget (Tax code)" (further - the Tax code).

The amount of the state tax constitutes 50 percent, established on the date of payment of the state fee.

Payment of the state fee is performed through the banks of the second level and the organization performing separate types of banking activities.

In case of giving of electronic request for receipt of the state service through the Portal, payment is performed through payment gateway of "the electronic government" (further - PShEP), banks of the second level.

8. Working schedule:

1) the service provider - Monday through Friday from 9:00 till 18:30 o'clock with lunch break from 13:00 till 14:30 o'clock, except days off and holidays, according to the labor law of the Republic of Kazakhstan.

Reception of an application and issue of result of rendering the state service - from 9:00 till 17:30 o'clock with lunch break from 13:00 till 14:30 o'clock.

The state service is rendered in turn, without making an appointment and the accelerated servicing;

2) the portal - round the clock, except for technical breaks in connection with carrying out repairing work (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan reception of applications and issue of results of rendering the state service is performed the next working afternoon).
