Some questions of holding actions of the state supervision (control) in the field of economic activity

According to the paragraph the second 4, paragraphs the seventh and eleventh article 9-1 of the Law of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity" the Cabinet of Ministers of Ukraine decides Article parts two:

Procedure for creation and approval of the plan of complex planned actions of the state supervision (control) of state supervision bodies (control);

Procedure for introduction of submissions to state supervision bodies (control) on elimination of violations of requirements of the Law of Ukraine by them "About the basic principles of the state supervision (control) in the field of economic activity".

Procedure for creation and approval of the plan of complex planned actions of the state supervision (control) of state supervision bodies (control)

1. This Procedure determines the mechanism of creation and approval of the plan of complex planned actions of the state supervision (control) (control) by state supervision bodies (further - the plan of complex actions).

2. In this Procedure terms are used in the value given in the Law of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity".

3. The plan of complex actions is constituted and affirms the Ministry of Economic Development in form according to appendix.

4. State supervision bodies (control) represent to the Ministry of Economic Development in written and electronic (in the Excel format) to form of the data on the planned actions of the state supervision (control) till September 15 of the year preceding planning period which begins since January 1 and comes to an end on December 31 or report about lack of the planned actions.

Data on the planned actions of the state supervision (control) shall contain:

the name of the subject of managing concerning which activities the action (the name of the legal entity or surname, name and middle name of physical person entrepreneur) is performed;

identification code of the legal entity or registration number of accounting card of the taxpayer of physical person entrepreneur (series and passport number - for physical persons which owing to the religious beliefs refused adoption of registration number of accounting card of the taxpayer, reported about it in the relevant monitoring body and have mark in the passport);

the place of implementation of economic activity of the subject of managing concerning which activities the action of the state supervision (control), or its separate divisions is performed;

type of economic activity of the company;

risk degree from implementation of economic activity of the company;

start date of holding action of the state supervision (control);

terms of holding action of the state supervision (control);

the name of state supervision body (control) performing action of the state supervision (control).

5. If the subject of managing is included in plans of implementation of actions of the state supervision (control) at the same time of several state supervision bodies (control), the Ministry of Economic Development includes it in the plan of complex actions.

6. The Ministry of Economic Development constitutes the draft of the plan of complex actions and will promulgate it on the official site no later than October 15 of the year preceding planned.

State supervision bodies (control) make notes and offers to the draft of the plan of complex actions within 10 calendar days after its promulgation.

The plan of complex actions affirms the order of the Ministry of Economic Development and is published on its official site no later than November 15 of the year preceding planned.

The state supervision body (control) can attract to participation in the relevant activity of the state supervision (control) of representatives of the Ministry of Economic Development.

In case of receipt of such offer of the Ministry of Economic Development makes the decision on its acceptance or variation what reports to relevant organ of the state supervision (control) about.

Data on participation of representatives of the Ministry of Economic Development in action of the state supervision (control) are specified in respect of complex actions.

7. After approval of the plan of complex actions of the Ministry of Economic Development sends it to the copy to the state supervision bodies (control) specified in the plan.

Taking into account the plan of complex actions the state supervision bodies (control) included in the plan approve the annual plans of actions of the state supervision (control).

8. Changes are made to the plan of complex actions based on offers of state supervision bodies (control) and affirm the order of the Ministry of Economic Development.

The order on modification of the plan of complex actions is published on the official site of the Ministry of Economic Development.

State supervision bodies (control) make notes and offers to the draft of the order on modification of the plan of complex actions within 10 calendar days after its promulgation.

The order on modification of the plan of complex actions and the plan of complex actions taking into account the made changes are published on the official site of the Ministry of Economic Development within two days.
