1.2. Control of payment of currency means for the goods exported from the territory of the Azerbaijan Republic is regulated by this Instruction.
1.3. In this Instruction the following concepts are applied:
- the state company - accessory to the state more than 50% of shares in Authorized capital of the companies;
- the file - document package on control over receipt of currency means for the exported goods (data on each transaction are constituted separately);
- the register - the document generalizing "Accounting card of currency exchange control over export transactions";
- authorized bank - bank or other credit institution which obtained the license of National Bank of the Azerbaijan Republic for carrying out currency transactions;
- foreign currency:
a) banknotes, treasury notes and bank notes in the form of stamping coin which are in circulation in the territory of the corresponding foreign states or group of the states and considered as legal means of payment, and also withdrawn from circulation or subject to withdrawal, but suitable for exchange for bank notes which are in circulation in this territory.
b) the means which are on accounts in monetary units of foreign states, international cash or units of account;
- specific goods - the goods approved by the corresponding Presidential decree of the Azerbaijan Republic, provided in "Regulations of import and export transactions in the Azerbaijan Republic" and permitted to export by the order of the Cabinet of Ministers or on special permission of the Ministry of Trade.
2.1. Control of currency payments in transactions on export is exercised according to "The technological scheme of control of payment of the currency in export transactions" approved by Appendix No. 1 of this Instruction.
2.1.2. Primary control. Primary control is exercised in case of customs clearance of export transactions. At the same time the relevant department (department of freight) conducting customs clearance checks integrity and correctness of the involved documents submitted by the exporter.
2.1.3. Consignment. Export transactions by consignment on the basis of the signed contracts with foreign persons provide commodity export, establishing term for trade in goods outside the republic up to 180 days since day of declaring in customs authority. The means obtained from sale shall arrive into the currency account of the exporter in the authorized bank serving it in process of sales of goods no later than 10 banking days. If goods will not be sold during the term established for trade by consignment, within 30 days these goods shall be returned to the Azerbaijan Republic.
Commodity export by consignment is made by the exporteraminegosudarstvenny companies with declaring in customs authorities. At the same time the goods made in the republican state companies can be exported only after their cost is completely paid to the producer. For registration of export transactions by consignment by customs authorities the following documents are required:
- the agreement signed with the foreign party (with registration in the Ministry of Trade if the exporter is the state company; if other exporters - with declaring in customs authorities);
- the certificate of origin of the exported goods;
