About approval of the Procedure for conducting special check concerning persons applying for holding the posts who provide occupation of responsible or especially responsible provision, and positions with the increased corruption risk, and introduction of amendments to some resolutions of the Cabinet of Ministers of Ukraine

According to parts one and third article 57 and 58 of the Law of Ukraine "About prevention of corruption" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for conducting special check concerning persons applying for holding the posts who provide occupation of responsible or especially responsible provision, and positions with the increased corruption risk which is applied.

2. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

3. Ceased to be valid according to the Resolution of the Cabinet of Ministers of Ukraine of 20.03.2019 No. 239.

4. This resolution becomes effective along with enforcement of the Law of Ukraine "About prevention of corruption".

Procedure for conducting special check concerning the persons applying for holding the posts, providing occupation of responsible or especially responsible provision, and positions with the increased corruption risk

1. This Procedure determines the mechanism of conducting special check concerning persons applying for holding the posts who provide occupation of responsible or especially responsible provision, and positions with the increased corruption risk (further - applicants for position).

The positions providing occupation of responsible or especially responsible provision are determined in the note to article 56 of the Law of Ukraine "About prevention of corruption".

The list of positions with the increased corruption risk affirms the National agency concerning prevention of corruption (further - the National agency).

Special inspection is not carried out concerning persons whose list is determined in paragraphs three - the seventh part one of article 56 of the Law of Ukraine "About prevention of corruption".

2. For conducting special check the applicant for position gives to the relevant state body, authority of the Autonomous Republic of Crimea, local government body:

1) the written consent to conducting special check in form according to appendix 1;

2) the autobiography for date of provision of consent to conducting special check which is created electronically, unpacked and signed with own hand and contains, in particular, data relatively: surnames, name and middle name (in the presence), birth dates and birth places, nationality (in particular, nationality) (citizenship) foreign (foreign) the states (states), the documents granting to the applicant for position the right to permanent residence in the territory of foreign states (in the presence) and also the fact of submission of the documents necessary for registration of nationality (citizenship) foreign (foreign) the states (states); educations (the name of institution of the higher education (other educational institution), year of receipt and termination of such institution, diploma details, the received educational and qualification level (extent of education), specialty, qualification, scientific degree), admission availability to the state secret, and also the facts of cancellation of earlier provided admission for violation of the law about the state secret (or refusal in its provision); relations of the applicant for position to execution of conscription (recruit, person liable for call-up, reservist); passings of military service (in case of its passing) and/or stay on military accounting of persons liable for call-up; last place of employment (service) and position;

3) copies of pages of the passport of the citizen of Ukraine in the form of book with data on surname, name and middle name (in the presence), issue of the passport and the address of the registered residence or the front and return parties of the passport of the citizen of Ukraine in the form of card and the statement from the register of territorial community for confirmation of information on the residence (stay) or electronic copies of the e-passport and the e-passport for trip abroad (with the corresponding technical capability);

4) copies of education documents (with appendices), academic statuses and scientific degrees;

5) the medical certificate about the state of health in the form approved by the Ministry of Health of stay on accounting in psychoneurological or narcological healthcare institutions;

6) copy of the military and accounting document: for the recruit - the certificate of addition to the draft site; for the person liable for call-up, the reservist - the military ID or the temporary certificate of the person liable for call-up; for the military personnel - the military ID, the identity certificate of the serviceman;

7) the certificate of admission availability to the state secret (in case of its availability) constituted in the form determined by the legislation on the state secret;

8) the statement provided by part one of article 6 of the Law of Ukraine "About clarification of the power".

Consent to conducting special check moves together with the statement on appointment, and in case of appointment (election) or approval to position by local council or by results of competitive selection - within three working days from the date of the corresponding purpose (election) of approval or obtaining by the applicant for position of the message on results of tender.

The applicant for position in new state body until education in such body of the structural division responsible for conducting special check, for conducting such check files the documents specified in subitems 1 - 8 these Items, to NAGS.

3. Verification of information about the applicant for position during conducting special check is made:

1) GSA - concerning availability in the Unified state register of judgments of data on involvement of the applicant for position to criminal liability;

2) the Ministry of Internal Affairs - concerning criminal record availability, its removal, repayment;

3) Ministry of Justice and NKTsBFR - concerning availability at the applicant for position of corporate laws;
