Approve Regulations on the Public archive agency of Ukraine which are applied.

Regulations on the Public archive agency of Ukraine

1. The public archive agency of Ukraine (Ukrgosarkhiv) is the central executive body which activities go and coordinated by the Cabinet of Ministers of Ukraine through the Minister of Justice and realizing state policy in the sphere of archiving, clerical work and creation and functioning of the state system of insurance fund of documentation.

2. Ukrgosarkhiv in the activities is guided by the Constitution and the laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine adopted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, other acts of the legislation.

3. The main objectives Ukrgosarkhiva are:

1) realization of state policy in the sphere of archiving, clerical work and creation and functioning of the state system of insurance fund of documentation;

2) submitting for examination of the Minister of Justice of offers on ensuring forming of state policy in the sphere of archiving, clerical work and creation and functioning of the state system of insurance fund of documentation;

3) the organization of carrying out research works in the sphere of archiving, document science, archaeography, forming and storage of insurance fund of documentation.

4. Ukrgosarkhiv according to the tasks assigned to it:

1) generalizes practice of application of the legislation on the questions which are within its competence develops suggestions for improvement of legal acts, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, regulatory legal acts of the ministries and in accordance with the established procedure represents them to the Minister of Justice;

2) performs cross-industry coordination on the questions which are within its competence;

3) will be organized by the state accounting and document storage of National Archive Fund, use of data which contain in it;

Coordinates 4) and controls forming of insurance fund of documentation, its maintaining, content, and also issue to users of copies of the documents of insurance fund of documentation necessary for statement on production, operation and repair of products of defensive, mobilization and economic appointment, for carrying out construction, rescue and emergency recovery operations in case of liquidation of emergency situations and during the special period, and also in the sphere of preserving information on cultural values;

5) is controlled by activities of archival organizations, services of clerical work, also control of activities of the central Public Records Offices, the central public archival institutions, research establishments and special facilities of insurance fund of documentation relating to the management sphere Ukrgosarkhiva exercises control;

6) participates in development:

forecasts and drafts of development programs of the state system of insurance fund of documentation, and also actions directed to accomplishment of such programs;

industry, the Autonomous Republic of Crimea, regional, district, city programs of creation of insurance fund of documentation, approves their projects and provides control of their accomplishment;

7) develops drafts of target development programs of archiving, clerical work, insurance fund of documentation, in particular mobilization and defensive appointment, determines measures for their accomplishment;

8) submits to the Minister of Justice for introduction in accordance with the established procedure to the Cabinet of Ministers of Ukraine offers on creation, reorganization, liquidation of the central Public Records Offices and together with the relevant central executive bodies - about creation of the industry Public Records Offices;

Forms 9), will reorganize and liquidates the central public archival institutions, special facilities of insurance fund of documentation;

Develops 10) and represents to the Minister of Justice for approval of regulations on the central Public Records Offices;

11) approves provisions (charters) of the central public archival institutions, research establishments and special facilities of insurance fund of documentation;

Develops 12) together with the relevant central executive bodies and gives to the Minister of Justice for approval of regulations on the industry Public Records Offices;

13) is approved by the project of regulations on the Public Records Office in the Autonomous Republic of Crimea;

14) develops methodical recommendations about preparation of regulations on local public archival institutions;

15) will be organized in accordance with the established procedure by accounting, inspection and the analysis of activities of archival organizations, irrespective of pattern of ownership and subordination, controls maintaining the register of archival organizations by the Public Records Offices;

16) will be organized by forming of National Archive Fund, including replenishment by its documents of cultural heritage of Ukraine which are located abroad and the documents of foreign origin concerning history of Ukraine;

17) is developed by the project of procedure for reference of documents in National Archive Fund, organizational and methodological bases of conducting examination of value of documents, coordinates activities of commissions of experts for conducting examination of value of documents, approves solutions of commissions of experts on withdrawal of documents from National Archive Fund;

18) is provided by creation, storage and use of archive electronic documents;

Develops 19) and represents to the Minister of Justice for approval standard regulations on archival divisions of state bodies, local government bodies, the state and municipal companies, organizations and the organizations; makes recommendations about preparation of regulations on archival divisions of the companies, organizations and the organizations founded on private pattern of ownership and also public associations, the religious organizations;

Develops 20) and represents to the Minister of Justice for approval standard lists of documents with storage durations;

21) approves industry lists of documents with storage durations, the standard and approximate nomenclatures of cases prepared by the central executive bodies, other state bodies, organizations for the companies, organizations and the organizations, uniform in nature of activities, relating to the sphere of their management;

Develops 22) and represents to the Minister of Justice for approval procedure for transfer for further document storage of state bodies, local government bodies which are liquidated or will be reorganized, and also documents of the companies, organizations and the organizations, irrespective of pattern of ownership which are liquidated, and exercises control of observance of such procedure;
