1. Approve the enclosed Rules of issue of permission to transit of products.

2. To committee of industrial development and industrial safety of the Ministry for Investments and Development of the Republic of Kazakhstan (Erzhanov A. K.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let:

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 presents of Item.

3. To impose control of execution of this order on the supervising Vice-Minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of issue of permission to transit of products

Chapter 1. General provisions

1. These rules of issue of permission to transit of products (further - Rules) are developed according to the subitem 16) of article 6 of the Law of the Republic of Kazakhstan of July 21, 2007 "About export control" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" (further - the Law) and determine approval procedure on transit of products and rendering the state service "Issue of Permission to Transit of Products Which Are Subject to Export Control".

2. If sanctions of the Republic of Kazakhstan, the international organizations and the certain states concerning which the Republic of Kazakhstan assumed obligations on their observance in this sphere are inflicted on the country of destination or on the country of the sender, action of these rules does not extend and permission to transit of products (further - permission) is not issued.

According to the subitem 2) of item 4 of article 20 of the Law of the Republic of Kazakhstan of January 6, 2012 "About homeland security of the Republic of Kazakhstan" transit through the territory of Kazakhstan of military forming, arms and military equipment of foreign states and (or) the international organizations is not allowed No. 527, except as specified, provided by the international treaties ratified by the Republic of Kazakhstan.

3. Permission is issued on one type of goods according to code of the commodity nomenclature of foreign economic activity of the Eurasian Economic Union with indication of code at the level of at least ten signs, irrespective of quantity and the product range in the contract in foreign trade (agreement).

4. Permission is issued to physical persons and legal entities for no more than one year from start date of its action.

Effective period of permission is limited to the duration of the contract on delivery of products, the insurance contract of civil responsibility and the document issued by authorized body concerning export control of the country of the exporter on availability of the export permit of products.

If transit of products is not performed in the specified time, then permission is cancelled automatically.

Modification and amendments in the issued permission is not allowed.

5. The issued permission cannot be transferred to other physical person or legal entity.

6. "Issue of permission to transit of products which are subject to export control" is the state service (further - the state service) and it appears Committee of industrial development of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan (further - the service provider).

Chapter 2. Procedure for rendering the state service

7. The state service appears the service provider by means of the appeal of physical persons and legal entities (further - uslugopoluchatel):

for physical persons and legal entities of the Republic of Kazakhstan:

1) in non-commercial joint-stock company "The Government for Citizens state corporation (further - the State corporation);

2) on the web portal of "the electronic government" www.egov.kz (further - the portal);

for foreign legal entities:

1) in the State corporation;

2) on the portal;

3) in office of the service provider.
