I.O.'S ORDER OF THE MINISTER OF INVESTMENTS AND DEVELOPMENT OF THE REPUBLIC OF KAZAKHSTAN

About approval of Rules of providing civil aircrafts with aviation fuels and lubricants

(In edition of the Order of the deputy. The Minister of Transport of the Republic of Kazakhstan of 03.04.2025 No. 102; The Order of the Minister of Transport of the Republic of Kazakhstan of 22.01.2026 No. 10)

According to subitems 41-44) of Item 1 of article 14 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" I ORDER:

1. Approve the enclosed Rules of providing civil aircrafts with aviation fuels and lubricants.

2. To committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan (Seydakhmetov B. K.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let of the republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan";

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. I reserve control of execution of this order.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of providing civil aircrafts with aviation fuels and lubricants

1. General provisions

1. These rules of providing civil aircrafts with aviation fuels and lubricants (further - Rules) are developed according to subitems 41-44) of Item 1 of article 14 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" and determine procedure for providing civil aircrafts with aviation fuels and lubricants.

2. Civil aircrafts are provided with aviation fuels and lubricants Service of fuels and lubricants (further - Service fuel and lubricants) which are structural division of the organization of civil aviation or the independent legal entity - the organization for providing with fuels and lubricants.

3. The terms and determinations used in these rules:

1) system of centralized filling of civil aircrafts with fuel (further - the TsZS system) - complex of constructions and processing equipment for fuel delivery from reservoirs in tanks of civil aircrafts by means of stationary pumps on technological pipelines and via filling aggregates;

2) aviation fuels and lubricants (further - aviafuel and lubricants) - the general name of fuels, oils, lubricants and special liquids of all brands applied in case of operation of the aircraft equipment;

3) quality of aviafuel and lubricants - the set of aviafuel and lubricants properties determining capability of these materials to meet the requirements established in the specifications and technical documentation;

4) warehouse aviafuel and lubricants - complex of buildings, constructions, installations and the equipment of acceptance, storage and issue of aviafuel and lubricants for gas station of civil aircrafts;

5) commercial water - the water which is formed in reservoirs as a result of upholding of fuels and lubricants.

2. Procedure for providing civil aircrafts with aviation fuels and lubricants

4. The quantity and the sizes of reservoirs are determined by Service fuel and lubricants for ensuring daily needs of the organizations of civil aviation, and also for creation of reserve amount of aviafuel and lubricants.

5. When providing civil aircrafts Service fuel and lubricants uses aviafuel and lubricants:

1) allowed to application and brought in documents on flight operation and maintenance of the corresponding types of civil aircrafts;

2) having the declaration of conformity to requirements of the technical regulation of the Customs union "About requirements to automobile and aviation gasoline, diesel and ship fuel, fuel for jet engines and to fuel oil" (to TR CU 013/2011) accepted by the Decision of the Commission of the Customs union of October 18, 2011 No. 826.

6. Use of aviafuel and lubricants, not brought in documents on flight operation and maintenance of civil aircrafts, is performed in coordination with producers and designers of civil aircrafts.

The delivery agreement aviafuel and lubricants is signed according to the civil legislation of the Republic of Kazakhstan.

7. In case of the conclusion of delivery agreements aviafuel and lubricants the supplier guarantees:

1) compliance of the delivered aviafuel and lubricants brand to requirements of technical regulations and standards, specifications and production technologies;

2) supply of aviafuel and lubricants with the quality assurance of the producer and documentation confirming quality and amount of aviafuel and lubricants;

3) observance of requirements for safety of quality and to exception of mixing of aviafuel and lubricants with other fuel and lubricants brands when transporting, and also in cases of complex transportation of aviafuel and lubricants by different vehicles to the receiver;

4) use of vehicles and reservoirs of the aviafuel and lubricants which are specially prepared and intended for transportation;

5) obligations on timely informing on the arisen and revealed case of intentional or unintentional quality degradation of aviafuel and lubricants in production process, storages and transportations which can affect reliability of operation of the aircraft equipment when obtaining and using the aviafuel and lubricants this brand.

8. Gas station of the aviafuel and lubricants civil aircrafts is performed based on daily plans of flights which arrive from the authorized representative of airline no later than one days about the planned days with indication of numbers of flights, types and board numbers, time of departures and amount of aviafuel and lubricants for each of them in time. Requests for aviafuel and lubricants are transferred to Service fuel and lubricants.

9. The list of the aviafuel and lubricants applied on civil aircrafts is determined by developer or manufacturing plant of the aircraft equipment.

Brands of the applied aviafuel and lubricants are determined by normative and technical documents in the field of civil aviation by types of civil aircrafts, maintenance instructions of civil aircrafts, the program (regulations) of maintenance of civil aircrafts. The nomenclature aviafuel and lubricants and the special liquids applied is given on civil aircrafts in appendix 1 to these rules.

Gas station of aircrafts at the airports is performed based on the agreements signed between the organization for providing fuels and lubricants and the operator of aircrafts.

10. Filling of civil aircrafts can be made through the TsZS system, and also using special vehicles: refueling vehicles, oil dispensers, filling aggregates.

11. All operational changes in the daily plan of flights influencing the organization of gas station of the aviafuel and lubricants civil aircrafts are told the dispatcher of service of special transport not later than 2 hours to arrival or departure of civil aircrafts according to the changed plan.

12. For ensuring efficiency of gas station of civil aircrafts the staff of filling crew accommodates in the rooms located in close proximity to fueling spaces and equipped with radio and telephone communication. The radio communication is established also in special transport (the refueling vehicle, the oil dispenser, the filling aggregate).

13. Before connection of the next reservoir and at the beginning of each change by the technician of aviafuel and lubricants of Service fuel and lubricants availability of commercial water in the account reservoir is checked.

After verification of presence of commercial water in the account reservoir, in after the reservoir transfer magazine in the column "The Conclusion and the Signature the Aviafuel and Lubricants Equipment about Water Verification of Presence" entry "Results of control of level of purity of aviafuel and lubricants satisfactory is made. I resolve issue".

In case of unsatisfactory results of check, the account reservoir is excluded from system of fuel supply, sampling is made for carrying out the analysis and identification of conditions of use of aviation fuel. In need of test go to independent laboratory for carrying out the analysis.

The form on reservoir the transfer magazine is determined in appendix 2 to these rules.

14. The admission of special vehicles to gas station of civil aircrafts is performed at the beginning of the next change by the specialist of Service fuel and lubricants together with the mechanic (foreman) of service of special transport, with mark in the magazine of the admission of special vehicles. About the special vehicles allowed to gas station it is reported to the dispatcher of service of special transport and/or Service fuel and lubricants.

15. After each filling of special vehicles (refueling vehicles, oil dispensers) the specialist of Service fuel and lubricants checks purity of aviafuel and lubricants, does mark in the control coupon about the admission to gas station of civil aircrafts and reports about it to the dispatcher of service of special transport and/or Service fuel and lubricants.

16. Departure of special vehicles (the refueling vehicle, the oil dispenser, the filling aggregate) on gas station of civil aircrafts is made on specifying of the dispatcher of service of special transport and/or Service fuel and lubricants.

17. Filling of the civil aircraft is made after stop of its engines and discharge of sediment from fuel tanks according to instructions and programs (regulations) of maintenance for types of aircrafts.

Prior to filling the aircraft is fixed and fixed by persistent blocks.

18. The entrance of filling special vehicles to civil aircrafts and their installation is performed by specialists of Service fuel and lubricants allowed by the order of the head of the organization of civil aviation to management of entrance and departure of special transport to aircrafts.

19. Before gas station person servicing the civil aircraft (the representative of crew of the civil aircraft, the aeromechanic of the engineering aircraft equipment) checks:

1) according to the control coupon - permission to gas station, compliance of numbers of the special vehicles specified in the coupon, compliance given on aviafuel and lubricants gas station and percentage of protivovodokristallizatsonny liquid, date and time of check of discharge of sediment of fuel from refueling vehicles, and its purity;

2) reliability and operability of earthing provisions and devices for equalization of potentials of means of gas station and civil aircrafts;

3) availability on site gas stations of emergency firefighting equipment;

4) installation of persistent blocks under wheels of refueling vehicles.

Upon termination of check person servicing the civil aircraft (the representative of crew of the civil aircraft, the aeromechanic of the engineering aircraft equipment) permits to gas station of the aircraft, specifies the mode of gas station, and also specific amount of aviafuel and lubricants for gas station with distribution on groups of fuel tanks.

20. Person servicing the civil aircraft (the representative of crew of the civil aircraft, the aeromechanic of engineering air service) exercises control of gas station of the civil aircraft, compliance of the actual amount of aviafuel and lubricants filled in the civil aircraft, specified in task for flight, the correct distribution of aviafuel and lubricants on fuel tanks and groups of fuel and oil system of the civil aircraft, behind use of protivovodokristallizatsonny liquid.

21. The dispatcher of service of special transport and/or Service fuel and lubricants fixes amount of the aviafuel and lubricants filled on types and numbers of civil aircrafts and informs authorized persons of Service fuel and lubricants on the end of filling of each civil aircraft.

22. The discharge of aviafuel and lubricants from fuel tanks of the civil aircraft is made according to requests of airline. The application is submitted the dispatcher of service of special transport and/or Service fuel and lubricants.

The discharge is made in the refueling vehicles which are specially allocated under each aviafuel and lubricants brand which are equipped with gages of amount of the merged fuel.

Plums of aviafuel and lubricants from fuel tanks of the civil aircraft in the refueling vehicle intended for gas station of civil aircrafts are not allowed.

23. Gas station of civil aircrafts in the presence of passengers is onboard carried out for prevention of delay of departures of civil aircrafts in case of observance of additional measures for ensuring fire safety.

Additional measures of fire safety when filling civil aircrafts in the presence of passengers onboard are:

1) attraction of additional number of fire fighting automotive equipment;

2) opening of all doors of the civil aircraft;

3) installation of passenger ladders.
