About measures for ensuring accomplishment by the Russian Federation of the obligations provided by the Basel Convention on the Control of Trans-boundary Movement of Hazardous Wastes and their removal

For the purpose of accomplishment by the Russian Federation of the obligations provided by the Basel Convention on the Control of Trans-boundary Movement of Hazardous Wastes and their removal, the Government of the Russian Federation decides:

1. Prohibit import of dangerous wastes for the purpose of their burial or burning in the territory of the Russian Federation.

2. Appoint competent authorities, stipulated in Article 5 Basel Conventions on the Control of Trans-boundary Movement of Hazardous Wastes and their removal (further - the Convention), the Ministry of Natural Resources and Environmental Protection of the Russian Federation and Federal Nature Management Supervision Service.

3. Assign to the Ministry of Natural Resources and Environmental Protection of the Russian Federation as competent authority the following functions:

organization and coordination of fulfillment of requirements of the Convention;

preparation of offers on development and acceptance of the regulatory legal acts directed to accomplishment of the Convention;

representation of interests of the Russian Federation at the Convention Conferences of the Parties, in other operating parts of the Convention, and also by consideration of disputes between the parties according to the procedure of their trial established by the Convention.

4. Assign to Federal Nature Management Supervision Service as competent authority the following functions:

issue of import permits to the Russian Federation, export from the Russian Federation and transit of dangerous wastes for their use as raw materials;

the notification of the relevant competent authorities of the states performing export, import or transit of dangerous wastes on the planned cross-border transportations of this waste.

5. Determine actionees of the obligations of the Russian Federation following from the Convention, the following federal executive bodies within their competence:

The Ministry of Natural Resources and Environmental Protection of the Russian Federation - regarding ensuring protection of ecological interests of the Russian Federation;

The Ministry of Foreign Affairs of the Russian Federation - regarding ensuring protection of foreign policy interests of the Russian Federation during international cooperation on the questions connected with control of cross-border transportation or transportation of dangerous wastes;

The ministry of the Russian Federation for civil defense, to emergency situations and natural disaster response - regarding implementation of supervision of readiness of service employees, forces and means to actions in case of emergency situations;

The Ministry of Industry and Trade of the Russian Federation - regarding issue of licenses for import to the territory of the Russian Federation of dangerous wastes, and also on export from the territory of the Russian Federation of dangerous wastes;

Federal Service for the Oversight of Transport - regarding implementation of federal state control (supervision) in the field of transport safety (including in case of cross-border transportations of dangerous wastes);

The Federal Customs Service - regarding application and enhancement of means of customs control over import to the Russian Federation, export from the Russian Federation and customs transit of dangerous wastes;

Federal Service for the Oversight of Consumer Protection and Welfare - regarding implementation of federal state sanitary and epidemiological surveillance in case of cross-border transportations of dangerous wastes and the treatment of them.

6. To the Ministry of Natural Resources and Environmental Protection of the Russian Federation:

when forming the draft of the federal budget for the next financial year and planning period to provide budgetary appropriations for payment of the membership fees of the Russian Federation in the budget of the Convention;

to submit offers on assignment of the legal entity for accomplishment of obligations of the allocated center responsible for obtaining and provision of information according to the Convention within 3-month term.

7. To the ministry of the Russian Federation for civil defense, to emergency situations and natural disaster response to take measures for ensuring readiness of forces and means of Universal State System of Prevention and Response to ES to interaction with similar systems of foreign countries in case of cross-border transportations of dangerous wastes and their removal.

8. Realization of the powers provided by this resolution is performed by the corresponding federal executive bodies within the established extreme number of employees of the specified bodies, and also budgetary appropriations provided by it in the federal budget on management and management in the field of the established functions.
