About some measures in the field of the organization of rendering by state bodies and the legal entities of the public law of electronic services created by the President of the Azerbaijan Republic
Use of information and communication technologies for the purpose of ensuring long and sustainable social and economic development of Azerbaijan, implementation of public administration on the basis of the modern principles became one of priorities of state policy, and important measures were in the field taken. Based on "The state program on development of communication and information technologies in the Azerbaijan Republic for 2010-2012 (Electronic Azerbaijan)", and also other regulatory legal acts adopted in connection with development of information and communication technologies the legal base in the field of rendering by state bodies to the population the electronic services conforming to international standards was created.
Ensuring modern and flexible management, increase in transparency in activities of state bodies and the legal entities of the public law and elimination of the phenomena creating conditions for corruption created by the President of the Azerbaijan Republic requires rendering electronic services to the population.
Being guided by Item 32 of article 109 of the Constitution of the Azerbaijan Republic, for the purpose of the organization of electronic services and acceleration of process of application of the digital signature I decide:
1. To the Cabinet of Ministers of the Azerbaijan Republic in two-month time to establish rules of rendering by the central executive bodies and the legal entities of the public law of electronic services in specific spheres created by the President of the Azerbaijan Republic and types of service.
2. To the central executive bodies and the legal entities of the public law created by the President of the Azerbaijan Republic to perform the following measures for the organization of electronic services:
2.1. creation in official information Internet resources of the special Section of electronic services for rendering electronic services according to powers;
2.2. placement in the Section of electronic services of the name of the service rendered on concern, the exact list of the documents required for rendering this service, electronic form of the relevant documents (the statement, the form and so forth), ensuring free and free use of persons with this Section;
2.3. ensuring acceptance electronically the scanned copies of the applications and required documents completed in accordance with the established procedure with persons who addressed in the Section of electronic services, the directions to the sent person of the confirmatory notification and consideration of these documents according to the procedure and the terms established by the legislation;
2.4. if receipt of the relevant documents from the relevant state body (structure) by means of the Information system "Electronic Government" is possible, then the specified documents are not subject to reclamation at the addressed person. If receipt of such documents by means of the Information system "Electronic Government" is impossible, then they with the consent of the addressed person, are subject to reclamation at the relevant state body (structure) based on request or to providing with the addressed person;
2.5. ensuring payment electronically, the duties in real time provided and other payments for the rendered services and acceptance of necessary technical security measures for the purpose of safety of the operations performed by means of the Section of electronic services, and personal data.
2-1. To bodies of the central executive authority in two-month time to establish administrative regulations on each rendered electronic service separately.
3. Charge to the Ministry of transport, communication and high technologies of the Azerbaijan Republic in three-months time:
3.1. for the purpose of enhancement of electronic service to organize work on providing state bodies with the digital signature and the legal entities of the public law, and also the legal entities and physical persons which addressed for the purpose of use of service of the digital signature created by the President of the Azerbaijan Republic;
3.2. perform necessary measures for the purpose of ensuring exchange of information between information systems of state bodies and the legal entities of the public law created by the President of the Azerbaijan Republic;
3.3. provide creation of the "elektronnoye pravitelstvo" portal for the purpose of the organization of use of electronic services of state bodies and the legal entities of the public law created by the President of the Azerbaijan Republic on the basis of the principle "one window";
3.4. provide methodical support to the central executive bodies and the legal entities of the public law created by the President of the Azerbaijan Republic for the organization of electronic service;
3.5. for the purpose of increase in level of training of government employees in the field of use of high technologies to perform the necessary measures directed to the organization of training courses;
3.6. once a month to provide information on accomplishment of the measures provided in Item 3 of this Decree in the Cabinet of Ministers of the Azerbaijan Republic.
4. To provide to the central executive bodies and the legal entities of the public law of times created by the President of the Azerbaijan Republic in month in the Cabinet of Ministers of the Azerbaijan Republic information on accomplishment of the measures provided in Item 2 of this Decree.
5. Charge to the Cabinet of Ministers of the Azerbaijan Republic:
5.1. together with the Ministry of digital development and transport of the Azerbaijan Republic to take adequate measures for accounting in the government budget of the current year and the next years of the means required in connection with implementation of the work provided by this Decree;
5.2. analyze condition of the carried-out work on accomplishment of the measures provided in Items 2 and 3 of this Decree and time in three months to provide to the President of the Azerbaijan Republic information on it;
5.3. resolve other issues following from this Decree.
