About approval of regulations of the state services in the field of author's and the related rights

1. Approve:

1) Regulations of the state service "State Registration of the Rights to the Works Protected by Copyright", according to appendix 1 to this order;

2) Regulations of the state service "Accreditation of the Organizations Managing Property Rights on Collective Basis", according to appendix 2 to this order;

3) Regulations of the state service "Issue of Certificates of Delivery on Storage of Manuscripts of Unpublished Works", according to appendix 3 to this order.

2. To provide to department on intellectual property rights of the Ministry of Justice of the Republic of Kazakhstan state registration of this order and its official publication according to the procedure, established by the legislation of the Republic of Kazakhstan.

3. Recognize invalid:

1) the order of the Minister of Justice of the Republic of Kazakhstan of February 27, 2014 No. 85 "About approval of Regulations of the state services in the field of author's and the related rights" (registered in the Register of state registration of regulatory legal acts on March 15, 2014 for No. 9224, published in information system of law of Ad_let on May 14, 2014);

2) the order of the Minister of Justice of the Republic of Kazakhstan of June 13, 2014 No. 200 "About modification and amendments in the order of the Minister of Justice of the Republic of Kazakhstan of February 27, 2014 No. 85 "About approval of Regulations of the state services in the field of author's and the related rights" (registered in the Register of state registration of regulatory legal acts on August 1, 2014 for No. 9661, published in information system of law"? d_lt" on August 12, 2014).

4. To impose control of execution of this order on the supervising deputy minister of justice of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Regulations of the state service "State Registration of the Rights to the Works Protected by Copyright"

Chapter 1. General provisions

1. The state service "State Registration of the Rights to the Works Protected by Copyright" (further - the state service) is rendered based on the Standard of the state service "State Registration of the Rights to the Works Protected by Copyright" approved by the order of the Minister of Justice of the Republic of Kazakhstan of April 30, 2015 No. 250 (it is registered in the Register of state registration of regulatory legal acts No. 11400) (further - the Standard) by the Ministry of Justice of the Republic of Kazakhstan (further - the service provider).

1) registration of a statement by the employee of office of the service provider in single system of electronic document management of state bodies (further - ESEDO);

2) consideration of the application by the chief of the department (or person fulfilling its duties) on copyright and related rights of Department on intellectual property rights of the Ministry of Justice of the Republic of Kazakhstan (further - management) and distribution to the chief expert or the expert of management;

3) consideration of the application and registration of result of rendering the state service by the chief expert or expert of management;

4) coordination of result of the state service with the chief of the department, the deputy manager of Department on intellectual property rights of the Ministry of Justice of the Republic of Kazakhstan (further - Department) and the head of Department;

5) signing of result of rendering the state service by the deputy manager of the service provider;

6) direction of result of rendering the state service to uslugopoluchatel.

Chapter 3. The description of order of interaction of structural divisions (workers) of the service provider in the course of rendering the state service

6. In the course of rendering the state service the following structural divisions (workers) of the service provider are involved:

1) employee of office of the service provider;

2) the chief of the department (or person fulfilling its duties);

3) chief expert or expert of management;

4) deputy manager of Department;

5) head of Department;

6) deputy manager of the service provider.

7. The description of the sequence of procedures (actions) between structural divisions (workers) of the service provider:

1) the employee of office of the service provider within three hours from the moment of receipt of documents, carries out registration of the received documents to ESEDO, and submits the chief of the department, at the same time in the right bottom corner of the statement the registration stamp in state language with indication of receipt date and the entering number is put down and put on control;

2) the chief of the department (or person fulfilling its duties) within three hours after document transfer by the employee of office of the service provider writes to the chief expert or the expert of management;
