About urgent measures for improvement of supply and distribution of medicines and products of medical appointment in the republic

In pursuance of the Presidential decree of the Republic of Uzbekistan "About streamlining of realization of medicines in the republic" of July 14, 1994 and for the purpose of improvement of providing the population of the republic by medicines, vaccines and products of medical appointment the Cabinet of Ministers decides:

1. Approve:

Rules of realization of medicines and products of medical appointment in pharmaceutical institutions of the republic according to appendix No. 1;

the list of the medicines of prime necessity realized on marginal retail prices and obligatory for all pharmaceutical institutions according to appendix No. 2.

3. To the Ministry of Finance together with the Ministry of Health of the Republic of Uzbekistan:

in week time to develop and approve marginal retail prices on medicines and products of medical purpose of prime necessity and to bring to all pharmaceutical institutions, irrespective of their patterns of ownership;

in two weeks to develop and approve procedure for education and use of fund of price regulation under State and joint-stock association "Dori-Darmon" for compensation of difference between selling and marginal retail prices on the medicines and products of medical purpose of prime necessity included in appendix No. 2 to this resolution.

4. State joint-stock to Uzfarmprom concern:

provide release of the medicines and products of medical appointment specified in appendix No. 2, in volume of requests of the Ministry of Health of the Republic of Uzbekistan;

together with the State committee on science and technology, Academy of Sciences of the Republic of Uzbekistan and the International fund "EKOSAN" to develop and introduce by October 1, 1994 in the Cabinet of Ministers the program of production in the republic of medicines on the basis of local raw materials of phytogenesis.

5. To the ministry of external commercial relations, the Ministry of Health together with National Bank of foreign economic activity of the Republic of Uzbekistan till September 15, 1994 to finish registration and the subsequent filling of the loan granted by European Union Commission in the amount of 68 million US dollars for purchase on import of medicines and the medical equipment.

6. To the State Property Committee of the Republic of Uzbekistan and State and joint-stock association "Dori-Darmon" to perform in the second half of the year 1994 organizational actions for privatization and privatization of pharmaceutical institutions according to appendix No. 3.

7. To the Ministry of Health of the Republic of Uzbekistan to transform Inspectorate for quality control of medicines of State and joint-stock association "Dori-Darmon" to the Commission under the Ministry of Health of the Republic of Uzbekistan on control of quality of medicines.

8. To allocate to Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent from the decentralized sources of State and joint-stock association "Dori-Darmon" and to its territorial subdivisions financial resources, including foreign currency, and also material resources for acquisition of medicines, vaccines and products of medical appointment in the amounts equivalent to the amount of Russian rubles, according to appendix No. 4.

10. To impose control over the implementation of this resolution on the Deputy prime minister of the Republic of Uzbekistan M. K. Karabayev.

Rules of realization of medicines and products of medical appointment in pharmaceutical institutions of the republic

1. In the Republic of Uzbekistan the pharmaceutical institutions having the license for implementation of pharmaceutical activities are allowed to be engaged in realization of medicines and products of medical appointment.

The realization of medicines is allowed to be enabled in the specified pharmaceutical institutions only to persons having vocational pharmaceutical education.

2. Realization of medicines and products of medical appointment as physical persons and legal entities out of pharmaceutical institutions - in the markets, on the street, in public places and at home is strictly forbidden.

3. It is forbidden:

realization of the medicines and products of medical appointment which are not registered in the Republic of Uzbekistan and or not having certificates of conformity;

acceptance of medicines and products of medical appointment as pharmaceutical institutions from legal entities and physical persons without certificates of conformity;

realization of counterfeited and substandard medicines, and also illegal copies of the medicines registered in the Republic of Uzbekistan.

4. The list and rules of leave of medicines to the population according to recipes and without recipe of the doctor, and also to treatment and prevention facilities affirm the Ministry of Health of the Republic of Uzbekistan.

5. The legal entities and physical persons which are engaged in realization of medicines without license and also realization of substandard or counterfeited medicines, are made responsible according to the legislation of the Republic of Uzbekistan.

6. All pharmaceutical institutions irrespective of departmental accessory and without fail shall have patterns of ownership available medicines and products of medical purpose of obligatory assortment and to provide their free sale.

In case of absence in pharmaceutical institutions of medicines from obligatory assortment replacement with their analogs in accordance with the established procedure is allowed.

7. All medicines, except for permitted by the Ministry of Health to leave without recipe of the doctor, are released from drugstores only according to recipes of the established forms.

8. On show-window of leave of finished pharmaceutical products medicines and products of medical appointment released without recipe of the doctor with indication of their price are exposed.

8-1. Pharmaceutical institutions irrespective of departmental accessory and pattern of ownership shall place in a visible place the approved List of socially important medicines and products of medical appointment with fixed prices in the state and Russian languages, at least 12 in font size.
