About the Strategy of reform of militia for 2013 - 2020

For the purpose of increase in efficiency of activities of law-enforcement bodies, enhancement of their structure, reduction of activities of law-enforcement bodies in compliance with modern requirements and regulations of international legal acts, rapprochements of activities of law-enforcement bodies to society, and also ensuring social legal guarantees of staff of law-enforcement bodies and according to article 69 of the Constitution of the Republic of Tajikistan I decide:

1. Approve the Strategy of reform of militia for 2013 - 2020 it (is applied).

2. To the Ministry of Internal Affairs of the Republic of Tajikistan to create the working group of number of representatives of the relevant ministries and departments, scientific institutions, civil society and during 2013 to develop the "Development Programs of Militia for 2013 - 2020" project and to submit to the Government of the Republic of Tajikistan for review.

The strategy of reform of militia for 2013 - 2020

Preamble

The strategy of reform of militia for 2013 - 2020 (further - Strategy), based on regulations of the Constitution of the Republic of Tajikistan, determines the purposes, priorities and measures for reform and development of militia, and reflects actions of the Government of the Republic of Tajikistan for the medium-term period.

Strategy is directed to determination of the purposes, priorities and measures for reforming and development of militia which realization promotes the solution of important tasks of social and economic development of Tajikistan in the modern world and meets the main priorities of the National strategy of development for the Republic of Tajikistan to the period till 2015.

It represents essentially new approach to ensuring development of militia of Tajikistan considering international experience on development and implementation of similar strategic documents, lessons and conclusions of last stages of development of militia, and also the developed realities and perspectives of its development.

Strategy will be realized with acceptance by the Development program of militia for 2013 - 2020 and the plan of its realization which participants are the Government of the Republic of Tajikistan, law-enforcement bodies, institutes of civil society and the population of the republic, and also the international organizations and the donor countries and regulatory legal acts on reform of militia.

Strategy considers and provides the transformations happening in important spheres of life activity of society and the state.

For the last 20 years in the Republic of Tajikistan there were serious economic, social and political changes. Inherently these changes mean emergence of qualitatively new political and social order. Significantly the system of law changes, also law-enforcement practice respectively changes. Now in Tajikistan the second stage of the judicial and legal reform aimed at providing rule of law and strengthening of legality, consecutive democratization and liberalization of the judicial and legal sphere, strengthening of judicial authority for the purpose of reliable protection of human rights and freedoms is performed.

The militia is one of the main links in the law-enforcement sphere. The changes made to work of the courts and other law enforcement agencies, with inevitability will affect nature of activities of other parts of this system including for work of law-enforcement bodies and, first of all, militia. But the existing practice of work of these structures can limit positive effect of judicial and legal reform. For this reason judicial and legal reform shall be followed also by reforming and development of militia of Tajikistan, and also other elements of law-enforcement system.

Reform of militia shall become the first step which will be added and enhanced by proportional changes in work of other law enforcement and judicial authorities.

Strategy is developed by national experts in interaction with Bureau of Organization for Security and Cooperation in Europe in Tajikistan, based on joint assessment of requirements of the Ministry of Internal Affairs of the Republic of Tajikistan which is carried out by estimative team of Organization for Security and Cooperation in Europe in 2008 and also the Memorandum of understanding between the Government of the Republic of Tajikistan and Organization for Security and Cooperation in Europe of April 8, 2011.

Purposes and tasks of reform of militia

Achieve the goal of reforming of militia depends on how its role in modern society is understood. Modern approaches formulate as the main objectives of law enforcement agencies minimization of negative effects from crime, and also creation and maintenance of safe social environment. It should be noted that such approach corresponds to the main request of society of Tajikistan that is confirmed by data of sociological polls of the population. With respect thereto the prevention of crimes and offenses and maintenance of safe social environment shall become as a result of reform one of the main priorities in work of militia.

It is represented that the prioritetization of task of the prevention of offenses and crimes shall find reflection in organizational structure of militia, in system of assessment of its activities, in system of professional training, and also in methods of its work.

Respectively it is necessary to create mechanisms and procedures within which the militia and local executive bodies of the government, social and other services could plan and realize efforts on law enforcement and safety.
