1. Approve the enclosed Rules of approval of temporary decreasing coefficient to rates (the prices, rates of charges) for services in transfer of electrical energy and (or) technical scheduling of leave in network.

2. Declare invalid the order of the Chairman of the Agency of the Republic of Kazakhstan on regulation of natural monopolies of December 28, 2004 No. 505-OD "About approval of Rules of establishment and cancellation of temporary decreasing coefficients to rates (the prices, rates of charges) for services in transfer of electrical energy and (or) technical scheduling of leave in network" (registered in the Register of state registration of regulatory legal acts for No. 3389, published on March 12, 2005 in the Ofitsialnaya Gazeta newspaper).

3. To provide to committee on regulation of natural monopolies and protection of the competition of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan.

4. To impose control of execution of this order on the supervising Vice-Minister of national economy of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of approval of temporary decreasing coefficient to rates (the prices, rates of charges) for services in transfer of electrical energy and (or) technical scheduling of leave in network

1. General provisions

1. Rules of approval of temporary decreasing coefficient to rates (the prices, rates of charges) for services in transfer of electrical energy and (or) technical scheduling of leave in network (further - Rules) are developed according to the laws of the Republic of Kazakhstan "About natural monopolies and the controlled markets", "About power industry" and other regulatory legal acts of the Republic of Kazakhstan.

2. These rules determine approval procedure of temporary decreasing coefficient to rate (the price, rate of charge) for services in transfer of electrical energy in networks interregional (regional, local) levels and (or) technical scheduling of leave in network (further - technical scheduling).

3. In these rules the following concepts are used:

department of authorized body - department of the state body performing management in spheres of natural monopolies and in the controlled markets;

the repayment schedule - the repayment schedule of receivables of the consumer of services in transfer of electrical energy and (or) technical scheduling (further - the consumer) before the power transferring organization certified by signatures of the consumer (the head of the legal entity or physical person performing business activity without formation of legal entity) and the head of the power transferring organization;

competent authority - the Department of Energy of the Republic of Kazakhstan;

leave in network - the amount of the released electrical energy all power making organizations in network of the power transferring organizations and the consumed imported electrical energy;

industry state body - the state body of the Republic of Kazakhstan performing management of industry (sphere) of public administration in which the consumer, except for authorized and competent bodies performs activities;

the system operator - the national company exercising centralized supervisory control, ensuring parallel work with power supply systems of other states, maintenance of balance in power supply system, rendering system services and acquisition of support services at subjects of the wholesale market of electrical energy and also transfer of electrical energy on national power grid, its maintenance and maintenance in operational readiness;

technical scheduling - the service rendered by the system operator on implementation of centralized supervisory control of the modes of production and consumption of electrical energy in single electric utility system of the Republic of Kazakhstan;

authorized body - the state body performing management in spheres of natural monopolies and in the controlled markets;

the power transferring organization - the organization performing transfer of electrical or heat energy on the basis of agreements.
