1. Approve the enclosed Rules of approval of temporary decreasing coefficients to rates (the prices, rates of charges) for regulated services of the high-level railway system and railway tracks with objects of rail transport under agreements of concession.

2. Recognize invalid some orders on regulation of natural monopolies according to appendix to this order.

3. To provide to committee on regulation of natural monopolies and protection of the competition of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan.

4. To impose control of execution of this order on the supervising Vice-Minister of national economy of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of approval of temporary decreasing coefficients to rates (the prices, rates of charges) for regulated services of the high-level railway system and railway tracks with objects of rail transport under agreements of concession

1. General provisions

1. Rules of approval of temporary decreasing coefficients (further - military industrial complex) to rates (the prices, rates of charges) for regulated services of the high-level railway system and railway tracks with objects of rail transport under agreements of concession (further - Rules) are developed according to the Law of the Republic of Kazakhstan of July 9, 1998 "About natural monopolies and the controlled markets".

2. Rules determine approval procedure of military industrial complex to rates (the prices, rates of charges) for services of the high-level railway system and railway tracks with objects of rail transport by agreements of concession.

3. In Rules the following concepts are applied:

freight cars turnover - the number of the sent cars taking into account haulage distance;

cargo turnover - amount of the performed transportation work on cargo delivery taking into account haulage distance;

competent authority - the Ministry for Investments and Development of the Republic of Kazakhstan;

the declared freight cars turnover - the planned freight cars turnover specified in the request of the consumer and (or) concessionary for approval of temporary decreasing coefficients;

the declared cargo turnover - the planned cargo turnover specified in the request of the consumer and (or) concessionary for approval of temporary decreasing coefficients;

the repayment schedule - the debt repayment schedule of the consumer and (or) concessionary of regulated services of the high-level railway system and railway tracks with objects of rail transport under agreements of concession before the National operator of infrastructure and the concessionary certified by signatures of the consumer and head of the National operator of infrastructure, the concessionary;

industry state body - the state body of the Republic of Kazakhstan performing management of industry (sphere) of public administration in which the consumer, except for authorized and competent bodies performs activities;
