About approval of Rules of public conveyances, baggage and loads

According to subitem 55-14) of Item 3 of article 4 of the Law of the Republic of Kazakhstan of January 17, 2002 "About merchant shipping" PRIKAZYVAYU:

1. Approve:

1) Rules of public conveyances and baggage sea transport of the Republic of Kazakhstan according to appendix 1 to this order;

2) Rules of carriages of goods by sea transport of the Republic of Kazakhstan according to appendix 2 to this order.

2. To committee of transport of the Ministry for Investments and Development of the Republic of Kazakhstan (Asavbayev A.A.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printed publicity materials and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising Vice-Minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of public conveyances and baggage sea transport of the Republic of Kazakhstan

1. General provisions

1. These rules of public conveyances and baggage are developed by sea transport of the Republic of Kazakhstan (further - Rules) according to subitem 55-14) of Item 3 of article 4 of the Law of the Republic of Kazakhstan of January 17, 2002 "About merchant shipping" (further - the Law) and determine procedure for public conveyance and baggage sea transport of the Republic of Kazakhstan.

2. Action of these rules extends: on ocean ships during their swimming on sea lanes of the Republic of Kazakhstan; on vessels of internal water swimming, river-marine vessels during their following on sea lanes, the rivers, lakes, water storage basins and other waterways of the Republic of Kazakhstan when implementing public conveyance and baggage with calling seaport.

3. In these rules the following concepts are used:

1) baggage - the load packed for departure by sea transport and transported separately from the passenger;

2) cabin baggage - compactly packed and freely placed in cabin or on shelves in platitudes of thing of the passenger, transported by it in case of themselves, within assigned amount and dimensions.

4. Public conveyance and baggage is performed by sea transport of the Republic of Kazakhstan in the international transit message through the Republic of Kazakhstan according to the Law and international treaties ratified by the Republic of Kazakhstan.

5. Public conveyance and baggage is performed by sea transport of the Republic of Kazakhstan based on the sea transportation agreement.

2. Procedure for public conveyance and baggage

According to the sea transportation agreement of the passenger the carrier shall transport to the port or destination of the passenger and baggage, in case of its delivery by the passenger and to issue baggage to the passenger or the representative on receipt of baggage to person, and the passenger shall pay for journey, and in case of checking in and for conveyance.

7. Public conveyance by sea transport will be organized by carrier according to the schedule. The carrier notifies passengers on change of the schedule of transportations at least in fifteen days prior to day of approval of the new schedule.

Information on change of the schedule of transportations is posted by carrier on the Internet the website and (or) information display in seaport, the notification of passengers who acquired tickets is performed by carrier by means of mailing of messages on subscriber numbers of cellular communication of these passengers.
