1. Approve the enclosed Rules of development, approval and approval of requirements of normative and technical, sanitary and epidemiologic and metrological support of control and accounting of waters.

2. To provide to committee on water resources of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising Vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of development, approval and approval of requirements of normative and technical, sanitary and epidemiologic and metrological support of control and accounting of waters

1. General provisions

1. These rules of development, approval and approval of requirements of normative and technical, sanitary and epidemiologic and metrological support of control and accounting of waters (further - Rules) are developed according to Item 3 of article 83 of the Water code of the Republic of Kazakhstan of July 9, 2003 (further - the Code), item 4 of article 12 of the Code of the Republic of Kazakhstan "About health of the people and health care system" of September 18, 2009 (further - the Code about health), with article 8 of the Law of the Republic of Kazakhstan of June 7, 2000 "About ensuring unity of measurements" (further - the Law) and determine procedure for development, approval and approval of requirements of normative and technical, sanitary and epidemiologic and metrological support of control and accounting of waters.

2. The system of normative and technical, sanitary and epidemiologic and metrological support of control and accounting of waters includes national standards, sanitary and epidemiologic rules, techniques of accomplishment of measurements.

3. Requirements of normative and technical, sanitary and epidemiologic and metrological support of control and accounting of waters are developed according to the international treaties ratified by the Republic of Kazakhstan.

4. In these rules the following basic concepts are used:

1) authorized body on studying and use of subsoil - the state body performing functions on realization of state policy and control in the field of geological studying, rational and complex use of subsoil and also other functions in the field of subsurface use established by the legislation of the Republic of Kazakhstan;

2) authorized body in the field of use and protection of water fund, water supply, water disposal (further - authorized body) - the state body performing management function and control in the field of use and protection of water fund, water supply, water disposal outside settlements;

3) authorized body of technical regulation and metrology - the state body performing state regulation in the field of technical regulation and metrology.

5. The techniques of accomplishment of measurements applied in spheres of implementation of the state metrological control are subject to obligatory metrological certification and registration in the register of state system for ensuring the uniformity of measurements.

6. According to Item 3 of article 17 of the Law the devices of control and accounting of waters registered in the register of state system for ensuring the uniformity of measurements and attorneys are allowed to application.

2. Development, approval, approval of requirements of normative and technical, sanitary and epidemiologic and metrological support of control and accounting of waters

7. Development of requirements of normative and technical, sanitary and epidemiologic and metrological support of control and accounting of waters is performed according to Item 3 of article 83 of the Code, the subitem 2) of article 7-1 of the Code about health, article 8 of the Law, health regulations and hygienic standard rates.

8. In case of development of requirements of normative and technical, sanitary and epidemiologic and metrological support of control and accounting of waters results of research, developmental, experienced and technological, project works, results of patent researches, information on modern achievements of domestic and foreign science, the equipment and technology are used.

9. Approval of requirements of normative and technical, sanitary and epidemiologic and metrological support of control and accounting of waters is performed:

authorized body on studying and use of subsoil within preparation of drafts of normative and technical acts concerning control and accounting of underground waters, in coordination with authorized body and department of authorized body in the field of sanitary and epidemiologic wellbeing of the population;

authorized body within preparation of drafts of normative and technical acts concerning control and accounting of surface water, in coordination with department of authorized body in the field of sanitary and epidemiologic wellbeing of the population;

3) authorized body within preparation of projects of regulatory legal acts and regulating documents on metrological support of control and accounting of waters, in coordination with authorized body in the field of technical regulation and metrology;
