About approval of the Regulations on procedure for declaring of compliance of products to requirements of its safety

1. Approve Regulations on procedure for declaring of compliance of products to requirements of its safety, according to appendix.

2. Enact this order after ten days from the date of its state registration in the Ministry of Justice of the Republic of Uzbekistan.

Regulations on procedure for declaring of compliance of products to requirements of its safety

This Provision according to Item 2 of the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of July 6, 2004 No. 318 "About additional measures for simplification of the procedure of certification of products" determines procedure for declaring by the producer of products about its compliance to safety requirements.

I. General provisions

1. Declaring about products compliance to requirements of its safety is carried out for the purpose of confirmation of conformity of products to requirements of regulating documents in the field of technical regulation (further - ND) and establishments of the producer responsible for its compliance.

Declaring about compliance includes acceptance and the analysis of the evidential documents submitted together with the declaration confirming products compliance, identification of the declared products, registration of the declaration and registration on the basis of the declaration of the certificate of conformity.

2. The producer bears responsibility for the product characteristics established by ND on which the reference in the declaration of conformity of products to requirements of its safety is had.

3. The declaration of conformity of products to requirements of its safety (further - the declaration) shall be based on results of the testing and estimates received by the producer according to the legislation.

4. Products which are not subject to obligatory confirmation of conformity can be certified by declaring of compliance at the initiative of the producer.

According to the List of the types of products made in the Republic of Uzbekistan and imported on its territory, subjects of obligatory certification, the approved resolution of the Cabinet of Ministers of April 28, 2011 No. 122, confirmation of conformity of some types of products which are subject to obligatory confirmation of conformity can be performed by declaring by the producer about their compliance.

5. In all cases of application of the declaration the customer (consumer) has the right to make at own expense alternative quality test of products in accredited test laboratory.

6. Product indicators (properties) of products confirmed by the declaration are established by the producer according to ND or under the terms of the contract.

At the same time testing on the indicators characterizing requirements for safety of products are performed without fail.

7. The producer provides package of measures for safety, testing and confirmations of conformity of products.

8. For the purpose of the declaration production shall be provided with control and testing in the certified or accredited test laboratory according to requirements of ND.

9. When importing products declaring by the producer about its compliance can be performed only in the presence of the agreement on mutual recognition of conformance statements between the Republic of Uzbekistan and country of source of products (or between the bodies authorized by them).

10. Payment for work on confirmation of conformity by the declaration is performed according to the procedure, established by the legislation.

II. Procedure for adoption of the declaration and its registration (accounting)

11. The producer submits to accredited body on certification of products (further - OS) the request for registration (accounting) of the declaration.

To the request it is applied:

declaration of conformity;

test reports of accredited laboratory on products, and also on raw materials, materials, the components used for production.

11-1. OS independently receive necessary documents (including copies of certificates of conformity of systems of management, the sanitary and epidemiologic, veterinary, phytosanitary conclusions, the conclusions on environmental assessment) and information, its safety confirming products compliance to requirements which are available in other state bodies and the organizations by means of information exchange, including in electronic form.

12. The declaration is submitted concerning specific type of products or group of products on which single requirements are established by the operating ND.

The declaration is drawn up in the state and (or) Russian languages in the form of the separate document, according to appendix to this Provision.

13. The declaration shall contain the following data:

a) the name and the address of the producer representing the declaration;

b) product name, number of type or model, and also the additional information characterizing products (batch number or series, grade etc.);

c) exact and full name of ND on which references are had;

d) date of issue of products, amount of batch or series, expiration date, transportations;

e) date of provision of the declaration;

e) First name, middle initial, last name, position and the authorized signature, the supplier acting on behalf;

g) information on certification of system of management;

h) name, address of test laboratory, and also reference to the document on its accreditation.

At the discretion of the supplier the additional information confirming products compliance is provided in the declaration.

14. OS considers the documents submitted by the producer regarding:

correctness and completeness of filling of the declaration of conformity;

availability of all documents, stipulated in Item the 11th this provision if other is not established by regulating documents in the field of technical regulation;
