About approval of standards of the state services in the field of gaming

According to the subitem 1) article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" PRIKAZYVAYU:

1. Approve:

1) the standard of the state service "Licensing for Occupation Activities of Casino", according to appendix 1 to this order;

2) the standard of the state service "Licensing for Occupation Activities of the Slot Machine Hall", according to appendix 2 to this order;

3) the standard of the state service "Licensing for Occupation Activities of Bookmaker Office", according to appendix 3 to this order;

4) the standard of the state service "Licensing for Occupation Activities of Totalizator", according to appendix 4 to this order.

2. To committee on cases of sport and physical culture of the Ministry of Culture and sport of the Republic of Kazakhstan (Kanagatov E. B.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration the direction it on official publication in periodic printing editions and in information system of law of Ad_let.

3. To impose control of execution of this order on the vice-Minister for Culture and Sports of the Republic of Kazakhstan Musaybekov S. Zh.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Standard of the state service "Licensing for Occupation Activities of Casino"

Chapter 1. General provisions

1. The state service "Licensing for Occupation Activities of Casino" (further - the state service).

2. The standard of the state service is developed by the Ministry of Culture and sport of the Republic of Kazakhstan (further - the Ministry).

3. The state service appears Committee of the industry of tourism of the Ministry (further - the service provider).

Reception of an application and issue of result of rendering the state service are performed through the web portal of "the electronic government" www.egov.kz (further - the portal).

Chapter 2. Procedure for rendering the state service

4. The term of rendering the state service from the moment of delivery of document package on the portal:

licensing - 10 (ten) working days;

renewal of the license - 3 (three) working days.

5. Form of rendering the state service: electronic (completely automated).

6. The state service licensing is result, of the renewed license for the occupation right activities of casino or the motivated answer about refusal in rendering the state service in the bases, stipulated in Item 10 these standards of the state service.

Form of provision of result of rendering the state service: electronic.

The result of rendering the state service is certified by the digital signature (further - the EDS) the authorized person of the service provider.

7. The state service is rendered on paid basis to legal entities (further - uslugopoluchatel). Rates of the annual license fee for the occupation right activities of casino according to item 4 of article 554 of the Code of the Republic of Kazakhstan of December 25, 2017 "About taxes and other obligatory payments in the budget" constitute (Tax code):

1) collection when licensing constitutes 3845 monthly settlement indicators (further - MRP);

2) collection for renewal of the license constitutes 10% of rate when licensing.

Payment is made in cash and non-cash form through the banks of the second level and the organization performing separate types of banking activities and also through payment gateway of "the electronic government" (further - PShEP).

8. Working schedule:

1) the service provider - Monday through Friday, from 9:00 till 18:30 o'clock with lunch break from 13:00 till 14:30 o'clock, except days off and holidays, according to the labor law of the Republic of Kazakhstan;

2) the portal - round the clock, except for technical breaks in connection with carrying out repair work, days off and holidays according to the labor law of the Republic of Kazakhstan, reception of applications and issue of result of rendering the state service is performed the next working day.

9. The list of documents necessary for rendering the state service in case of the address of uslugopoluchatel (or the authorized representative) through the portal:

for receipt of the license:

the statement of the legal entity for receipt of the license in the form of the electronic request (further - electronic request) certified by the EDS of uslugopoluchatel according to appendix 1 to this standard of the state service;

the document on payment in the budget of the license fee (except as specified payments through PShEP) in electronic form;

the form of data on building availability (part of the building, structure, construction) on the property right or other legal cause in hotel complex of category is not lower than three stars, meeting the sanitary and epidemiologic and fire protection standards established by the legislation of the Republic of Kazakhstan in form according to appendix 2 to this standard of the state service;

form of data on availability of the gambling equipment on the property right in form, according to appendix 3 to this standard of the state service;

form of data on availability of agreements with the physical persons or legal entities which obtained the license for implementation of security activities for form in the procedure established by the legislation of the Republic of Kazakhstan according to appendix 4 to this standard of the state service;

availability of samples and nominations, the applied legitimatsionny signs in the Kazakh and Russian languages in the form of the electronic copy of the document;

rules of work of gambling institution, acceptance of rates and the held gamblings in the Kazakh and Russian languages in the form of the electronic copy of the document;

the agreement with bank of the second level in the territory of the Republic of Kazakhstan on opening of contribution in the amount of 60000 MRP, established by the law on the republican budget for the corresponding financial year, on condition of issue of contribution on the first demand of (on-demand deposit) in the form of the electronic copy of the document;

for renewal of the license:

the statement of the legal entity for receipt of the license in the form of the electronic request (further - electronic request) certified by the EDS of uslugopoluchatel according to appendix 5 to this standard of the state service;

the document on payment in the budget of the license fee (except as specified payments through PShEP) in electronic form;

electronic copies of the documents containing information on changes, which formed the basis for renewal of the license and (or) appendix to the license, except for documents from which information contains in the state information systems.

1) occupation activities in the field of gaming is forbidden by the laws of the Republic of Kazakhstan for this category of uslugopoluchatel;

2) the license fee is not brought;
