About ensuring carrying out calculations for the consumed natural gas

According to article 11 of the Law of Ukraine "About the natural gas market" the Cabinet of Ministers of Ukraine decides:

1. Approve enclosed:

Procedure for opening (closing) for current accounts with the special mode of use for transfer of the means arriving for the consumed natural gas;

Procedure for carrying out calculations for the consumed natural gas.

2. Determine authorized banks which service current accounts with the special mode of use of suppliers of natural gas to whose special duties the obligation on supply of natural gas, and their structural divisions, and also the wholesale sellers performing sale of natural gas to such suppliers for accomplishment of the special obligations assigned to such sellers, "Government Savings Bank of Ukraine" open joint stock company, public joint stock company Ukrgazbank joint stock bank and "National Export-import Bank of Ukraine" public joint stock company belongs.

3. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

4. Determine that regulations of this resolution are not applied to the legal relationship settled by the resolution of the Cabinet of Ministers of Ukraine of March 4, 2002 No. 256 "About approval of the Procedure for financing of expenses of local budgets on implementation of actions for accomplishment of state programs of social protection of the population at the expense of subventions from the government budget" (The Official Bulletin of Ukraine, 2002, No. 10, by Art. 482; 2003, No. 44, Art. 2309).

Procedure for opening (closing) for current accounts with the special mode of use for transfer of the means arriving for the consumed natural gas

1. Suppliers of natural gas to whom special obligations on supply of natural gas (further - the gas supplying companies), and their structural divisions, and also the wholesale sellers performing sale of natural gas to the gas supplying companies for accomplishment of their special obligations are assigned (further - wholesale sellers) open in organizations of authorized bank current accounts with the special mode of use for transfer of the means arriving for the consumed natural gas from consumers, according to the procedure, determined by National Bank.

2. The gas supplying companies and wholesale sellers open current accounts with the special mode of use for accomplishment of the special obligations assigned to them on deliveries and sale of natural gas. At the same time if for certain category (group) of consumers the prices which differ from regular or market prices, the gas supplying companies are established and wholesale sellers open in organizations of authorized bank separate current accounts with the special mode of use for each such category (group) of consumers.

3. The gas supplying companies and wholesale sellers stipulate in the relevant agreement on opening of the bank account the right of authorized bank to contractual write-off (transfer) from current accounts with the special mode of use of the means arriving for the consumed natural gas without application of payment requests.

4. The authorized bank submits to NKREKP the list of the current accounts with the special mode of use opened by the gas supplying companies and wholesale sellers.

The list of current accounts with the special mode of use of the gas supplying companies and wholesale sellers moves authorized bank in NKREKP on approval and is brought to the attention of National Bank, the companies of mail service, and also consumers and other participants of calculations by publication in the official printing publication of the Cabinet of Ministers of Ukraine and is posted on the official site of NKREKP.

The gas supplying companies inform within 10 working days from the date of opening of the current account with the special mode of use of consumers on the current accounts opened in authorized bank with the special mode of use.

5. The gas supplying companies sign in two-month time with consumers new agreements (supplementary agreements) with indication of the corresponding current account with the special mode of use for transfer of means for the consumed natural gas only into such account.

In case of the conclusion of purchase and sale agreements of natural gas between the gas supplying companies and wholesale sellers, and also contracts of delivery of natural gas between the gas supplying companies and consumers conditions on payment for natural gas only on current accounts with the special mode of use are determined.

6. In case of the termination (the execution expiration) of special obligations of the gas supplying companies and wholesale sellers the gas supplying companies and wholesale sellers close current accounts with the special mode of use according to the procedure, determined by regulatory legal acts of National Bank. With the special mode of use the authorized bank in two-day time in writing reports about closing of the current account to NKREKP.

Procedure for carrying out calculations for the consumed natural gas

1. This Procedure determines the mechanism of carrying out calculations for the consumed natural gas with suppliers of natural gas to whom special obligations on supply of natural gas are assigned (further - the gas supplying companies), and wholesale sellers of natural gas to whom special obligations selling natural gas to the gas supplying companies for accomplishment of their special obligations are assigned (further - wholesale sellers).

2. Consumers pay the cost of the natural gas consumed by them by money transfer only on the current accounts with the special mode of use opened in organizations of authorized bank by the gas supplying companies.

3. If in the payment order / the cash document account details for natural gas do not correspond to current account details with the special mode of the use opened by the gas supplying company, which is brought to the attention of bank (the company of mail service) servicing the consumer of natural gas, the servicing bank (the company of mail service) returns such document to the payer without execution.

4. Organizations of authorized bank according to terms of the contract of the bank account perform transfer in full of funds for the consumed natural gas from the current accounts with the special mode of use opened by structural divisions of the gas supplying companies on the current account with the special mode of use opened by the gas supplying companies, twice a day namely:

till 10 o'clock - balance for the beginning of operational day is transferred;
