About approval of standards of the state services in the field of communication

According to the subitem 1) article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" PRIKAZYVAYU:

1. Approve enclosed:

1) the standard of the state service "Licensing for Provision of Services in the field of Communication" according to appendix 1 to this order;

2) the standard of the state service "Distribution of Resource of Numbering and Allocation of Numbers, and also Their Withdrawal" according to appendix 2 to this order;

3) the standard of the state service "Issue of Permission to Use of Radio-frequency Range of the Republic of Kazakhstan" according to appendix 3 to this order;

4) the standard of the state service "Issue of the Permission to Operate of Radio-electronic Means and High-frequency Devices" according to appendix 4 to this order.

2. (Sarsenov S. S.) to provide to committee of communication, informatization and information of the Ministry for Investments and Development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction of the copy of the order on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Standard of the state service "Licensing for Provision of Services in the field of Communication"

Chapter 1. General provisions

1. The state service "Licensing for Provision of Services in the field of Communication" (further - the state service).

2. The standard of the state service is developed by the Ministry of information and communications of the Republic of Kazakhstan (further - the Ministry).

3. The state service appears the State Control Committee in the field of communication, informatization and mass media of the Ministry (further - the service provider).

Reception of an application and issue of result of rendering the state service are performed through:

1) office of the service provider;

2) the web portal of "the electronic government" www.egov.kz (further - the portal).

Chapter 2. Procedure for rendering the state service

4. Term of rendering the state service:

1) from the moment of delivery of document package to the service provider, and also in case of the address on the portal:

licensing and (or) appendices to the license - 15 (fifteen) working days;

renewal of the license and (or) appendix to the license - 3 (three) working days;

renewal of the license and (or) appendix to the license by reorganization of legal person licensee, in case of confirmation of conformity to the qualification requirements imposed when licensing - 10 (ten) working days;

issue of duplicates of the license and (or) appendix to the license - 2 (two) working days.

The service provider within two working days from the moment of receipt of documents of uslugopoluchatel checks completeness of the submitted documents. In case of factual determination of incompleteness of the submitted documents the service provider within the specified terms gives motivated refusal in further review of the statement;

2) the most allowed time of expectation for delivery of document package uslugopoluchatel to the service provider - 15 minutes;

3) the most allowed time of servicing - 30 minutes.

5. Form of rendering the state service: electronic and (or) paper.

6. Result of rendering the state service:

the license and (or) appendix to the license, in shape according to appendices 1, 2 to this standard of the state service, renewal, the duplicate of the license and (or) appendix to the license for provision of services in the field of communication, or the motivated answer about refusal in rendering the state service in cases and on the bases, stipulated in Item 10 these standards of the state service.

Form of representation of result of the state service: electronic and (or) paper.

On the portal the result of rendering the state service goes to uslugopoluchatel to "private office" in electronic form, signed by the digital signature (further - the EDS) the authorized person of the service provider.

In case of the request of uslugopoluchatel for result of rendering the state service on paper, the result of rendering the state service is drawn up electronically, unpacked and certified by seal and the authorized signature of the service provider.

7. The state service is rendered on paid basis to physical persons and legal entities (further - uslugopoluchatel). In case of issue of appendices to the license (duplicates of appendices to the license) the license fee is not levied.

When rendering the state service in the location of uslugopoluchatel the license fee is paid for the occupation right by separate types of activity:

1) the license fee when licensing for the occupation right this type of activity constitutes 6 monthly settlement indicators (further - MRP);

2) the license fee for renewal of the license constitutes 10% of rate when licensing, but no more than 4 MRP;

3) the license fee for issue of the duplicate of the license constitutes 100% of rate when licensing.

Payment of the license fee is performed in cash and non-cash forms through the banks of the second level and the organization performing separate types of banking activities.

In case of giving of electronic request for receipt of the state service through the portal, payment can be performed through payment gateway of "the electronic government" (further - PShEP) or through banks of the second level.

8. Working schedule:

1) the service provider - Monday through Friday inclusive, from 9-00 till 18-30 o'clock, with lunch break from 13-00 till 14-30 o'clock, except days off (Saturday, Sunday) and holidays according to the labor law of the Republic of Kazakhstan.

Reception of an application and issue of result of rendering the state service is performed from 9:00 to 17:30 o'clock with lunch break from 13:00 to 14:30 o'clock.

The state service is rendered in turn, without making an appointment and the accelerated servicing;

2) the portal - round the clock, except for technical breaks in connection with carrying out repair work (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, reception of an application and issue of result of rendering the state service is performed the next working afternoon).

9. List of the documents necessary for rendering the state service in case of the address of uslugopoluchatel (or authorized representative: the legal entity according to the document, confirming powers; physical person under the notarized power of attorney):

the copy of the document confirming payment of the license fee for the occupation right with separate types of activity;

the documents confirming the applicant's compliance to qualification requirements according to appendix 5 to this standard of the state service depending on activities subspecies;

on the portal:

request in electronic form, the uslugopoluchatel certified by the EDS;

the document confirming payment of the license fee for the occupation right with separate types of activity in the form of the electronic copy of the document, except as specified payments through PShEP;

the documents confirming the applicant's compliance to qualification requirements according to appendix 5 to this standard of the state service depending on activities subspecies;

2) for receipt of appendix to the license within type of activity on which there is license:

to the service provider:

statements in forms according to appendices 3, 4 to this standard of the state service;

on the portal:

request in electronic form, the uslugopoluchatel certified by the EDS;

3) for renewal of the license move:

to the service provider:

statements in forms according to appendices 6, 7 to this standard of the state service;

the document confirming payment of the license fee, except for payments through PShEP;

request in electronic form, the uslugopoluchatel certified by the EDS;

the document confirming payment of the license fee for the occupation right with separate types of activity in the form of the electronic copy of the document, except as specified payments through PShEP;

copies of the documents containing information on changes, which formed the basis for renewal of the license and (or) appendix to the license, except for documents from which information contains in the state information systems;

the statement in any form;

the copy of the document confirming payment in the budget of the license fee for issue of the duplicate of the license.

The service provider receives data on identity documents, on state registration (re-registration) of the legal entity, on state registration of the applicant as the individual entrepreneur from the corresponding state information systems through lock of "the electronic government".

In case of delivery by uslugopoluchatel of all necessary documents:

to the service provider - confirmation of adoption of the statement on paper is the mark in its copy of the application about registration in office of the service provider with indication of date and time of acceptance of document package;

10. The bases for refusal in rendering the state service are:

1) occupation type of activity is forbidden by the laws of the Republic of Kazakhstan for this category of physical persons or legal entities;

2) the license fee is not brought;

3) the applicant does not conform to qualification requirements;

4) the licensor receives the answer from the relevant approving state body about discrepancy of the applicant to requirements imposed when licensing;

5) concerning the applicant there is decision (sentence) of court on suspension or prohibition of activities or the separate types of activity which are subject to licensing took legal effect;

6) court based on representation of the legal executive the applicant debtor is temporarily forbidden to grant the license.

Chapter 3. Procedure for appeal of decisions, actions (failure to act) of service providers and (or) their officials, concerning rendering the state services

11. Appeal of decisions, actions (bezdeystviye) of the service provider and (or) his officials concerning rendering the state service: the claim is submitted addressed to the head of the service provider to the addresses placed on Internet resource of the Ministry: www.miс.gov.kz in the Section "State Services" or addressed to the head of the Ministry of the address: 010000, city of Astana, Prospekt Mang_l_k El, 8, House of the ministries, 14th entrance, phone 8 (7172) 74 03 64.
