About approval of Rules of conducting the state accounting of waters and their use, state water inventory and state monitoring of water objects

According to the subitem 11) of Item 1 of article 37 of the Water code of the Republic of Kazakhstan of July 9, 2003, I ORDER:

1. Approve the enclosed Rules of conducting the state accounting of waters and their use, the state water inventory and the state monitoring of water objects.

2. To provide to committee on water resources of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing the edition and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of conducting the state accounting of waters and their use, state water inventory and state monitoring of water objects

Chapter 1. General provisions

1. These rules of conducting the state accounting of waters and their use, the state water inventory and the state monitoring of water objects (further – Rules) are developed according to the subitem 11) of Item 1 of article 37 of the Water code of the Republic of Kazakhstan and determine procedure for conducting the state accounting of waters and their use, the state water inventory and the state monitoring of water objects.

2. The state water inventory (further – GVK) represents the code of the systematized official data on condition and use of water objects, on their water resources, on water users.

3. Data of the state accounting of surface and underground water characterize condition of superficial and underground water objects by qualitative and quantitative indices, degree of their industrial and ecological safety for life and health of the person, study and use.

4. The state accounting of surface and underground water represents systematic determination and fixing of quantitative and qualitative indexes of the water resources which are available in the territory of the Republic of Kazakhstan.

5. The state monitoring of water objects which is component of system of the state monitoring of the environment and natural resources represents system of the regular observations of hydrological, hydrogeological, hydrogeochemical, sanitary and chemical, microbiological, parasitological, radiological and toxicological indicators of their condition, collection, processing and transfer of the acquired information, including with use this remote sensing of Earth for the purpose of timely identification of negative processes, assessment and forecasting of their development, development of recommendations about prevention of harmful effects and determination of efficiency rate of the performed water management actions.

Chapter 2. Procedure for conducting the state accounting of waters and their use

6. Department of authorized body in the field of use and protection of water fund, water supply, water disposal (further – Department of authorized body):

1) coordinates work of the state bodies connected with conducting the state accounting of waters and their uses;

2) is performed by accounting of waters on subordinated water management systems and constructions;

3) performs registration of primary water users.

Data on fence, use and water disposal of waters according to Chapter 4 of these rules are made to the section on use of waters of the edition GVK "Resources of Surface and Underground Water, Their Use and Quality".

7. The authorized body on studying of subsoil regarding the state accounting of underground waters, provides accounting of forecast and operational inventories of underground waters based on materials of hydrogeological studying of subsoil.

Data on accounting of forecast and operational inventories of underground waters according to Chapter 4 of these rules are made to the section on underground water resources of the edition GVK "Resources of Surface and Underground Water, Their Use and Quality".

8. Water users record uses of waters according to the procedure, approved by the order of the Minister of Agriculture of the Republic of Kazakhstan of March 30, 2015 "About approval of Rules of primary accounting of waters" (it is registered in the Register of state registration of regulatory legal acts at No. 11131).

9. Authorized body in the field of environmental protection regarding hydrological monitoring of surface water:

1) is performed by the state hydrological monitoring of surface water with use of the state supervisory network;

2) annually prepares regime reference information (average monthly and annual average expenses of water) by results of hydrological monitoring and no later than July 1 of the following after accounting year transfers them to department of authorized body according to appendix 1 to these rules, for accomplishment of further calculation of resources of river drain for 8 basins of the Republic of Kazakhstan.

Settlement data on resources of river drain on water management pools, information on nablyudenny and natural drain according to Chapter 4 of these rules are made to the section on superficial water resources of the edition GVK "Resources of Surface and Underground Water, Their Use and Quality".

Chapter 3. Procedure for conducting the state monitoring of water objects

10. For conducting the state monitoring of water objects:

The Authorized body in the field of civil protection provides 1):

conducting monitoring of flood situation in the Republic of Kazakhstan;

voluntary conveyance in department of authorized body and to its regional bodies, in national hydrometeorological service information specified in the list of the hydrological information provided by authorized body in the field of civil protection in department of authorized body and to its regional bodies and national hydrometeorological service according to appendix 2 to these rules.

The Authorized body in the area on studying of subsoil within the state monitoring of underground water objects provides 2):

implementation of monitoring of underground water objects based on Rules of implementation of the state monitoring of subsoil approved by the order of the Minister of investments and development of the Republic of Kazakhstan of May 5, 2018 No. 312 "About approval of Rules of implementation of the state monitoring of subsoil" (it is registered in the Register of state registration of regulatory legal acts for No. 17056);

processing, accumulating and their storage, annual generalization of data on condition of underground water objects on hydrogeological regions and pools, the territories of areas and in general across the Republic of Kazakhstan.

The Authorized body in the field of environmental protection within the state monitoring of superficial water objects provides 3):

creation and development of the state supervisory network of stations and posts on superficial water objects, and also the organization of observations of the mode, quantity and quality of surface water for physical, chemical, hydrobiological indicators;

organization of collection, processing, generalization, accumulating, storage and distribution of information, maintaining databank of monitoring of surface water for basins of the rivers, seas, their sites;

transfer to state bodies, water users of information on the level of pollution of water objects (except underground waters) and possibilities of its change under the influence of economic activity and hydroweather conditions, emergency information on sharp changes of level of pollution of surface water;

voluntary conveyance to department of authorized body and its regional bodies, in Crisis Management Centre and to territorial subdivisions of authorized body in the field of civil protection:

the prognostic and hydrological information specified in the List of the prognostic and hydrological information provided by national hydrometeorological service in department of authorized body and to its regional bodies in Crisis Management Centre and to territorial subdivisions of authorized body in the field of civil protection according to appendix 3 to these rules;

the operational hydrological information specified in the List of the operational hydrological information provided by national hydrometeorological service in department of authorized body and to its regional bodies in Crisis Management Centre and to territorial subdivisions of authorized body in the field of civil protection according to appendix 4 to these rules;

the regime reference information specified in the List of the regime reference information provided by national hydrometeorological service in department of authorized body and to its regional bodies according to appendix 1 to these rules.

The Authorized body in the field of sanitary and epidemiologic wellbeing of the population within sanitary and epidemiologic monitoring of quality of water of open reservoirs and subjects to drinking water supply provides 4):

implementation of sanitary and epidemiologic monitoring of sanitary and chemical, microbiological, parasitological, radiological and toxicological condition of quality of water of open reservoirs 1 and 2 categories and drinking water supply according to the order of the Minister of Health of the Republic of Kazakhstan of November 13, 2020 No. KR DSM-193/2020 "About approval of Rules of carrying out sanitary and epidemiologic monitoring" (it is registered in the Register of state registration of regulatory legal acts at No. 21640);

voluntary conveyance to authorized body and authorized body in the field of environmental protection of the generalized data of sanitary and epidemiologic monitoring of quality of water of open reservoirs 1 and 2 categories and drinking water supply.

The Authorized body in the field of space activities provides 5):

conducting remote sensing of Earth and voluntary conveyance to department of authorized body and its regional bodies of data of remote sensing of Earth.

6) the Water user, provides:

monitoring of conducting works on studying of the water mode and quality of the underground waters which are carried out on own (private) network of the observation posts;

determination of chemical composition of the dumped waters in own laboratories or laboratories of other companies, the organizations and organizations having the state certification;

voluntary conveyance to authorized body, authorized bodies on studying and use of subsoil (on underground waters), in the field of environmental protection and to the relevant territorial subdivision of department of authorized body in the field of sanitary and epidemiologic wellbeing of the population emergency information on emergency dumpings of pollutants, and also on violations of the set fence mode from water objects and dumping of waters into them.

Department of authorized body within the state monitoring of water objects provides 7):

coordination of works of the state bodies connected with conducting the state monitoring of water objects;

implementation of conducting monitoring and accounting of waters on subordinated water management systems and constructions;

voluntary conveyance in national hydrometeorological service, department of authorized body in the field of sanitary and epidemiologic wellbeing of the population, to territorial subdivisions of authorized body in the field of civil protection, in Crisis Management Centre of information specified in the List of operational hydrological information provided by regional bodies of department of authorized body in authorized body to the sphere of sanitary and epidemiologic wellbeing of the population, national hydrometeorological service, Crisis Management Centre and to territorial subdivisions of authorized body in the field of civil protection according to appendix 5 to these rules;

annual generalization of the water objects this about condition and use of water resources, conducts processing, accumulating, storage and distribution of information.

8) The authorized body in the field of forestry, protection, reproduction and use of fauna and especially protected natural territories provides:

implementation the state control and supervision in the field of protection, reproduction and use of fauna on water objects;

conducting the state accounting, the inventory and monitoring of fauna on water objects;

coordination of works of the state bodies connected with conducting the state monitoring of fauna on water objects;

protection and reproduction of objects of fauna on water objects, including rare and being under the threat of disappearance.

Chapter 4. Procedure for maintaining the state water inventory

11. Maintaining GVK is performed according to item 4 of article 59 of the Water Code of the Republic of Kazakhstan by Department of authorized body together with authorized body in the field of environmental protection (on surface water) and authorized body on studying of subsoil (on underground waters).
