Rules of conducting special accounting of the legal entities, individual entrepreneurs and artists-jewelers performing transactions with precious metals and gemstones

1. These rules establish procedure for conducting special accounting of the legal entities, individual entrepreneurs and artists-jewelers performing transactions with precious metals and gemstones (further - special accounting).

2. The legal entities, individual entrepreneurs and artists-jewelers performing transactions with precious metals and gemstones (further respectively - legal entities, individual entrepreneurs, artists-jewelers), except for are subject to statement on special accounting:

a) credit institutions (banks);

b) the organizations using in the activities chemical compounds of precious metals for carrying out analyses;

c) the organizations performing purchase and sale and (or) use of ready forms of the pharmaceutical, perfumery and cosmetic products containing chemical compounds of precious metals;

d) the educational organizations using in the activities chemical compounds of precious metals when implementing educational processes;

e) the organizations performing purchase and sale and (or) use of argentiferous photographic plates photo and films, photographic paper and other photosensitive photographic materials;

e) the organizations performing purchase and sale and (or) use of the paint and varnish products containing precious metals;

g) the medical organizations performing reinforcing by threads from the precious metals establishing implants, false teeth, dentures, prosthetic devices, and also using the dental cements and other dental sealing materials containing precious metals or made of them;

h) the organizations using the machines and the equipment, devices, tools, the electronic equipment, puskoreguliruyushchy devices and devices of automatic equipment, electric devices, accessories, nodes containing precious metals;

i) the organizations using the chemical compounds, alloys, solders containing precious metals for repair of machines and the equipment, devices, tools, the electronic equipment, puskoreguliruyushchy devices and devices of automatic equipment, electric devices;

j) the organizations performing purchase and sale and (or) using tools and (or) products of technological appointment containing natural diamonds in the activities;

k) Central Bank of the Russian Federation;

l) public authorities;

m) the legal entities and individual entrepreneurs performing trade in the products made of non-noble metals with covering from precious metals;

o) the legal entities and individual entrepreneurs performing works using the sheets of gold leaf and sugary silver intended for decorative, art, restoration and anticorrosive coverings;

o) the legal entities and individual entrepreneurs applying to dressing of food products gold leaf and sugary silver in the form of powder, flakes, foil, thin sheets;

p) the legal entities and individual entrepreneurs performing receiving and delivery of goods in case of remote method of sale of jewelry and other products from precious metals and (or) gemstones (Item of issue of orders);

c) the legal entities and individual entrepreneurs using chemical compounds of precious metals in agricultural industry, the food industry;

r) the organizations performing development and (or) production of the medicines for medical application containing precious metals;

s) the legal entities and individual entrepreneurs performing trade in ware, souvenirs, office supplies and tableware from silver through objects of fixed retail chain stores and applying control and cash equipment providing forming electronically of forms of the strict reporting and also their seal on papers;

t) the organizations performing purchase of the commemorative and anniversary (personalized) medals made of silver, emblems, breastplates and other corporate souvenirs, and also souvenir coins, except for the coins which underwent issue and the state awards which statute is determined in accordance with the legislation of the Russian Federation.

3. Special accounting is performed by means of inclusion of legal entities, individual entrepreneurs and artists-jewelers in the register of the legal entities, individual entrepreneurs and artists-jewelers performing transactions with precious metals and gemstones.

The register of the legal entities, individual entrepreneurs and artists-jewelers performing transactions with precious metals and gemstones is kept by Federal assay chamber (further authorized body) in the state integrated information system in the sphere of control of turnover of precious metals, gemstones and products from them at all stages of this turnover (further - GIIS DMDK). The procedure for maintaining the register and form of the register are determined by Federal assay chamber.

4. Statement on special accounting is performed by authorized body.

5. Legal entities and individual entrepreneurs are subject to statement on special accounting within 30 calendar days from the date of their state registration (in case of the statement of the codes under the All-Russian Classifier of Economic Activities connected with production, conversion and the address of precious metals and gemstones) or entering of corresponding changes into their constituent documents.
