About measures for further enhancement of procedures of provision of the parcels of land on the basis of tender for implementation of business activity and procedure for receipt of construction permits

For the purpose of program implementation of measures for ensuring reliable protection of private property, small business and private entrepreneurship, to removal of barriers to their accelerated development, the Republic of Uzbekistan approved by the Presidential decree of May 15, 2015 No. UP-4725, of establishment of single rules and requirements within the allowing procedures in the field of business activity at all stages of construction - from stage of preparation of town-planning documentation before input of objects in operation, the Cabinet of Ministers decides:

1. Consider the main directions in case of implementation of measures for further enhancement and optimization of all types of registration and allowing procedures in the field of the construction performed by subjects of entrepreneurship:

creation of equal competitive conditions to subjects of entrepreneurship due to provision of the parcels of land for implementation of business activity only on the basis of tender;

enhancement of the mechanism of issue of permissions to production of building and construction works of the state architectural and construction supervision of the State committee of the Republic of Uzbekistan by territorial inspectorates for architecture and construction by implementation of notifying procedure.

2. Determine that:

since January 1, 2016 provision in permanent use to legal entities and physical persons of the parcels of land in settlements, the area to hectare 1,0 inclusive, is made for implementation of business activity only on the basis of tender;

coordination of works on timely forming of the list of the parcels of land provided on the basis of tender for implementation of business activity is provided with Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent.

3. Approve and enact since January 1, 2016:

Regulations on procedure for provision to legal entities and physical persons of the parcels of land in permanent use on the basis of tender for implementation of business activity according to appendix No. 1;

4. To Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent:

together with the State committee of the Republic of Uzbekistan on land resources, geodesy, cartography and the state inventory by results of the careful analysis of results of the performed monitoring of lands to provide identification of not used lands, with their subsequent inclusion in lists of the parcels of land provided on the basis of tender for implementation of business activity;

in a month to form, in accordance with the established procedure, permanent tender committees on consideration of competitive proposals of subjects of entrepreneurship and to realize package of measures for assistance of their activities, with ensuring compliance with the principles of transparency and publicity.

5. To the state committee on architecture and construction of the Republic of Uzbekistan:

together with the State committee of the Republic of Uzbekistan on land resources, geodesy, cartography and the state inventory, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent to provide the organization and carrying out training seminars for members of newly created tender committees, specialists of executive bodies on places, single centers for rendering the state services to subjects of entrepreneurship for the principle "one window" regarding correctness of practical application and effectiveness of the taken measures for enhancement of procedures of provision to subjects of entrepreneurship of the parcels of land on the basis of tender, and also issue of permission to production of building and construction works and acceptance for operation of construction objects;

together with the interested ministries and departments in three-months time to make in the Cabinet of Ministers offers on further simplification of generally established procedure for provision of the parcels of land for town-planning activities and other nonagricultural needs, and also issue of permission to reshaping and reconstruction of object, approval of change of exterior of the building and construction (repair of facade), decision making about transfer of premises in category of non-residential.
