About crediting of some actions in agro-industrial complex

For the purpose of timely preparation of agricultural organizations for spring and autumn sowing, care of crops, creation of strong food supply and harvesting:

1. Determine that:

1.1. return of the budget credits granted to regional budgets at the expense of means of the state trust budget fund of national development in the amount of 150 million rubles for financing of purchase of mineral fertilizers is performed no later than December 31, 2018;

1.2. return of the money placed by the Ministry of Finance in the deposit in Belagroprombank open joint stock company (further - JSC Belagroprombank) at the expense of means of the state trust budget fund of national development in the amount of 305, of 38 million rubles, including 155, one million rubles - for financing of purchase of fuels and lubricants and 150 million rubles - for financing of purchase of nitrogen fertilizers, and also the money placed by regional executive committees in the deposit in JSC Belagroprombank at the expense of the means provided according to subitem 1.1 of this Item is performed till December 30, 2018 with establishment of deposit interest rate in the amount of 1 annual interest rate;

1.3. amount of money, subject to return according to subitems 1.1 and 1.2 of this Item, decreases by the amount of funds of the state trust budget fund of national development deposited in authorized capital of Asset Management Agency open joint stock company according to part one of subitem 2.2 and subitem 2.5 of Item 2 of the Presidential decree of the Republic of Belarus of July 14, 2016 No. 268 "About creation and activities of Asset Management Agency open joint stock company (The national legal Internet portal of the Republic of Belarus, 20.07. 2016, 1/16540).

2. Suggest JSC Belagroprombank to grant in 2016-2017 the loans to the organizations of agro-industrial complex * according to the lists determined by regional executive committees and (or) by their order district executive committees in amounts according to appendix at the expense of the means specified in subitem 1.2 of Item 1 of this Decree for a period of up to one year with payment of percent by these organizations in the amount of 3 annual interest rates for purchase of mineral fertilizers and fuels and lubricants, including expenses on their delivery (including transport), and also for debt repayment on them.

Loan granting according to part one of this Item is performed by JSC Belagroprombank annually within the amounts of the returned loans granted to JSC Belagroprombank earlier at the expense of the means specified in subitem 1.2 of Item 1 of this Decree.

The crediting amounts determined in appendix to this Decree decrease by the amount of funds of the state trust budget fund of national development deposited in authorized capital of Asset Management Agency open joint stock company according to part one of subitem 2.2 and subitem 2.5 of Item 2 of the Presidential decree of the Republic of Belarus of July 14, 2016 No. 268.

* For the purposes of this Decree the organizations of agro-industrial complex are understood as legal entities, including separate divisions which types of activity are production of agricultural products, provision of services in the field of crop production and livestock production, and also services in servicing of agricultural industry.

3. Obligation fulfillment on the loans granted according to Item 2 of this Decree is provided for the account:

the money deducted into the special accounts of the organizations of agro-industrial complex opened by them in JSC Belagroprombank according to part one of Item 5 of this Decree;

guarantees of local executive and administrative organs for the amount of principal debt.

Guarantees of local executive and administrative organs on the loans granted according to Item 2 of this Decree are provided without debt of the organizations of agro-industrial complex on payments in the republican budget, local budgets and budgets of state non-budgetary funds, and also in case of failure to carry out of the obligations by them on earlier granted loans (credits) including issued under guarantees of the Government of the Republic of Belarus, local executive and administrative organs, failure to carry out of the obligations by them on the performed guarantees of the Government of the Republic of Belarus, local executive and administrative organs, budget advances, the budget loans or accomplishment of the specified obligations at the expense of budgetary funds.

The payment for provision of guarantees for local executive and administrative organs on the loans granted according to Item 2 of this Decree is made one-timely in the amount of percent 0,01 from credit amount on which such guarantees are provided.

4. The organizations performing milk conversion make in 2016-2018 each decade assignments into special accounts of the organizations of agro-industrial complex included in the lists specified in the parts one of Item 2 of this Decree opened according to part one of Item 5 of this Decree in the amount of 25 percent from the amounts which are due to the organizations of agro-industrial complex for the milk delivered by them.
