Rules of provision of subsidies from the federal budget to the Russian organizations on compensation of part of costs for projects implementation for production organization of medical products within the subprogramme "Development of production of medical products" of the state program of the Russian Federation "Development of the pharmaceutical and medical industry" for 2013 - 2020

1. These rules establish the purposes, procedure and conditions of provision of subsidies from the federal budget to the Russian organizations on compensation of part of costs for projects implementation for production organization of medical products within the subprogramme "Development of production of medical products" of the state program of the Russian Federation "Development of the pharmaceutical and medical industry" for 2013 - 2020 (further respectively - the project, subsidy).

2. Subsidies are provided for the purpose of stimulation of investment activity of the Russian organizations for creation, expansion and upgrade of production of medical products and promote achievement of the following target indicators of the subprogramme "Development of production of medical products" of the state program of the Russian Federation "Development of the pharmaceutical and medical industry" for 2013 - 2020:

a) share of medical products of national production in the total amount of consumption (in terms of money);

b) creation and (or) upgrade of high-productive workplaces in the medical industry (cumulative result);

c) implementation of the industry actions plan on import substitution in industry of the medical industry of the Russian Federation.

3. The project is understood as the complex of the interconnected actions and processes limited on time and resources, directed to the organization of high technology production of medical products including with involvement of the third parties.

4. Subsidies are provided within the budgetary appropriations provided by the Federal Law on the federal budget for the corresponding financial year and planning period and limits of the budget obligations brought in accordance with the established procedure to the Ministry of Industry and Trade of the Russian Federation as the receiver of funds of the federal budget for the purposes specified in Item 1 of these rules taking into account obligations assumed by the Ministry of Industry and Trade of the Russian Federation under earlier signed agreements.

5. The subsidy is provided to the Russian organization registered in the Russian Federation and corresponding to the following criteria:

a) availability of the current license on production and maintenance (except for case if maintenance is performed for ensuring own needs of the legal entity or the individual entrepreneur) medical equipment;

b) total revenue for 2013 - 2016 from realization of self-produced medical products constitutes at least 100 million rubles or from realization of technical means of rehabilitation of the disabled people and persons with limited opportunities of health who are medical products - at least 50 million rubles;

c) availability at least one acting registration the certificate on the medical product made by the applicant;

d) on the first, preceding month in which the conclusion of the agreement on provision of subsidy is planned, the Russian organization has no unexecuted obligation on tax payment, charges, the insurance premiums, penalty fee, penalties, percent which are subject to payment in accordance with the legislation of the Russian Federation about taxes and fees;

e) on the first, preceding month in which the conclusion of the agreement on provision of subsidy is planned, at the Russian organization are absent overdue debt on return to the federal budget of the subsidies, budget investments provided including according to other legal acts, and other arrears to the federal budget;

e) on the first, preceding month in which the conclusion of the agreement on provision of subsidy is planned, the Russian organization is not in process of reorganization, liquidation, bankruptcy;

g) on the first, preceding month in which the conclusion of the agreement on provision of subsidy is planned, the Russian organization is not legal entity in whose authorized (share) capital share of participation of foreign legal entities whose place of registration is the state or the territory included in the list of the states and the territories which are providing preferential tax regime of the taxation and (or) not providing disclosure and provision of information approved by the Ministry of Finance of the Russian Federation when carrying out financial transactions (offshore zones) concerning such legal entities in total exceeds 50 percent;

h) on the first, preceding month in which the conclusion of the agreement on provision of subsidy is planned, the Russian organization does not receive means from the federal budget based on other regulatory legal acts on the purposes specified in Item 1 of these rules.
