About some measures for implementation of the Law of the Republic of Belarus of December 31, 2014 "About modification and amendments in some laws of the Republic of Belarus on safety issues of navigation of small size vessels"

Based on the paragraph of the fourth of Article 9-1 and part two of article 22-2 of the Code of inland water transport of the Republic of Belarus and subitem 7.4 of Item 7 of the Regulations on the Ministry of Emergency Situations of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of December 29, 2006 No. 756 "About some questions of the Ministry of Emergency Situations" the Ministry of Emergency Situations of the Republic of Belarus DECIDES:

1. Approve the enclosed Instruction about procedure for investigation of transport emergency cases with participation of small size vessels.

2. Determine that:

2.1. transport emergency cases with participation of small size vessels are classified on accidents and incidents.

Accident is the transport emergency case connected with movement of small size vessels (small size vessel) and which entailed approach at least of one of the following effects:

death of the person or causing to it heavy bodily harms;

disappearance of the person;

loss or change of road performance of the small size vessel and (or) other courts.

Incident is the transport emergency case connected with movement of small size vessels (small size vessel), which is characterized by lack of the effects called in paragraphs the second or fourth part two of this Item, and entailed approach at least of one of the following effects:

causing to the person of less heavy or slight injuries;

damage of the small size vessel and (or) other courts which did not cause loss or changes of road performance of the small size vessel and (or) other courts;

2.2. in the register of bases (constructions) for parking of small size vessels the following data are subject to introduction:

surname, own name, middle name (if that is available) the individual entrepreneur or the name of the legal entity who is going to perform operation of bases (constructions) for the parking of small size vessels (further - the operator of base (construction) for the parking of small size vessels);

the residential address (location), contact telephone number of the operator of base (construction) for the parking of small size vessels;

the location of base (construction) for the parking of small size vessels, contact telephone number;

the name of position, surname, own name, middle name (if that is available) persons responsible for operation of base (construction) for the parking of small size vessels, number and date of the order on its appointment.

3. This resolution becomes effective after its official publication.

The instruction about procedure for investigation of transport emergency cases with participation of small size vessels

1. This Instruction determines procedure for investigation of transport emergency cases with participation of small size vessels (further, unless otherwise specified, - transport emergency cases).

2. For the purposes of this Instruction terms and their determinations in the values established by the Code of inland water transport of the Republic of Belarus are used.

3. According to this Instruction the transport emergency cases which occurred in the territory of the Republic of Belarus and entailed approach at least of one of the following effects are investigated:

death of the person or causing to it heavy, less heavy or slight injuries;

disappearance of the person;

damage of the small size vessel and (or) other courts, including loss or changes of road performance of the small size vessel and (or) other courts.

Action of this Instruction does not extend to transport emergency cases with participation of the courts which are subject to technical supervision and classification by the body authorized by the Government of the Republic of Belarus.

4. Tasks of investigation of transport emergency cases are:

establishment of circumstances, reasons and effects of transport emergency cases, persons because of whom there were transport emergency cases;

development of preventive measures for the prevention of transport emergency cases.

5. In case of investigation of transport emergency cases it is made:

survey of the place of transport emergency case and fixation of results of survey;

poll of the boatmaster, victim, witnesses and other persons;

if necessary photography, video filming of the place of transport emergency case, the damaged objects, creation of schemes, holding other actions;

studying of necessary documents;

establishment of circumstances, reasons and effects of transport emergency case, persons because of whom there was transport emergency case;

classification of transport emergency case and forming of emergency case;

development of actions for elimination of the reasons of transport emergency case;

development of preventive measures for the prevention of similar transport emergency cases.

6. Investigation of transport emergency cases is made by officials of public institution "State inspectorate for small size vessels" (further - GIMS).

7. The official of GIMS in case of investigation of transport emergency case has the right:

conduct survey of the boatmaster, the victims, witnesses and other persons;

make other actions directed to investigation of transport emergency case.

8. After investigation completion the official of GIMS draws up the statement of transport emergency case with participation of small size vessels in form according to appendix 1 to this Instruction and creates emergency case.

9. Join in emergency case:

list of documents;

the act of transport emergency case with participation of small size vessels;

schemes, photographic materials, video records (in case of their availability);

written explanations of the boatmaster, victim, witnesses and other persons;

other documents.

10. The statement of transport emergency case with participation of small size vessels is drawn up in number of at least two copies. Additional number of copies of the act is determined by the number of the small size vessels which became participants of transport emergency case. One copy of the act remains in GIMS, the others are handed to boatmasters.
