Rules of issue by customs authority of permission in connection with separate customs transaction or customs procedure

1. General provision

These rules are prepared based on Articles 102.3 and 102.4 of the Customs code of the Azerbaijan Republic (further - the Customs code) and other provisions of the Customs code and determine rules of issue by customs authority of permission in connection with separate customs transaction or customs procedure.

2. Conditions of issue of permission

2.1. Permission is issued by customs authorities in case of accomplishment by persons of the following conditions:

2.1.1. representation of reasonable request for issue of permission;

2.1.2. creation of necessary opportunity for implementation of customs control;

2.1.3. observance of all requirements established for issue of such permission.

2.2. Permission is issued by customs authority in oral form, written form or electronically.

2.3. In cases when the room of goods under the customs procedure established by the Customs code requires permission, issue of such permission is regulated on the basis of this procedure.

2.4. For receipt of permission to carrying out separate customs transaction and customs procedure person addresses to customs authority in oral form, written form or electronically.

3. Registration of permissions

3.1. In cases when according to the Customs code carrying out separate customs transaction and customs procedure requires permission of customs authority, person requests such permission in customs authority in advance.

3.3. In case of receipt of request for issue of the written permission the customs authority within 2 (two) working days from receipt date reviews this request and issues to person permission in writing or electronically.

3.6. The term of permission expires together with the term of actual finish of transaction.

3.7. In some cases the customs permit can be replaced with the customs declaration or other shipping documents.
