ORDER OF THE GOVERNMENT OF THE KYRGYZ REPUBLIC

About approval of the Procedure for carrying out centralized purchases

According to article 10 of the Law of the Kyrgyz Republic "About public procurements" the Government of the Kyrgyz Republic decides:

1. Approve the Procedure for carrying out centralized purchases according to appendix.

2. Determine Department of public procurements under the Ministry of Finance of the Kyrgyz Republic by authorized body by carrying out centralized purchases.

3. To department of public procurements under the Ministry of Finance of the Kyrgyz Republic:

- in a month to resolve organizational technical issues on the organization of centralized purchases;

- determine the inventory, works and services on which centralized purchases according to the submitted applications of the ministries, administrative departments and local government bodies are carried out.

4. To impose control of execution of this resolution on department of finance and credit policy of Government office of the Kyrgyz Republic.

5. This order of the Government of the Kyrgyz Republic becomes effective after fifteen days from the date of official publication.

Procedure for carrying out centralized purchases

1. General provisions

1. This Procedure establishes the general legal and economic principles of the organization of centralized purchases and regulates procedure for their carrying out.

2. The purposes of this Procedure are:

- carrying out public procurements in centralized procedure;

- ensuring profitability and efficiency of purchases, assistance to the buying organizations, expansion and ensuring healthy competition;

- efficiency of use of money.

3. The organization of centralized purchases is performed by the authorized body on carrying out centralized purchases (further - authorized body) determined by the Government of the Kyrgyz Republic.

4. The main objectives of authorized body and the interdepartmental contest committee are:

- ensuring the maximum profitability and efficiency of purchases;

- expansion of participation and development of the competition between suppliers (contractors) in the course of implementation of purchases;

- providing the fair attitude towards all suppliers (contractors);

- ensuring impartiality and openness of procedures of purchases.

5. The authorized body and the interdepartmental contest committee are responsible for the organization and carrying out centralized purchases.

2. Participants of centralized purchases

6. Participants of centralized purchases are:

- authorized body;

- interdepartmental contest committee;

- the ministries, administrative departments, local government bodies (further - the buying organizations);

- suppliers (contractors).

7. Authorized body:

- determines the inventory, the performed works and the rendered services on which centralized purchases, according to the submitted applications of the ministries, administrative departments and local government bodies are carried out;

- determines purchasing amount and the purchasing budget of the buying organizations provided in the plan of public procurements in coordination with state bodies;

- carries out market monitoring and the prices of the purchased goods (on the basis of the provided plans of public procurements);

- creates in system of electronic procurement the tender documentation based on developed and approved with the buying organizations of single requirements and technical specifications and sends for consideration and statement of the interdepartmental contest committee;

- makes the decision on provision of privileges to internal suppliers (contractors) by results of monitoring;

- establishes the additional selection criteria determined by the legislation of the Kyrgyz Republic in the sphere of public procurements;

- determines the size and type of warranty providing;

- publishes the announcement of the forthcoming tender on the portal of public procurements;

- in case of need, in case of change of technical specifications or change of the main requirements, no later than three working days before the expiration of final term of submission of bids, can make changes to the tender documentation and places information on the web portal of public procurements with the obligatory notification of all participants of tender;

- debars the supplier (contractor) from procedures of public procurements, from cases, stipulated by the legislation the Kyrgyz Republic in the sphere of public procurements;

- provides the consulting help to the interdepartmental contest committee during tender;

- invites experts for assistance in development of documentation;

- makes the decision on inclusion in structure of the commission of technical employees;

- determines the auditor for conducting verification of the decision passed by the interdepartmental contest committee on observance of requirements of the legislation of the Kyrgyz Republic in the sphere of public procurements.

8. Interdepartmental contest committee:

- carries out tender bid evaluation, using the procedures and criteria provided by documentation according to the legislation of the Kyrgyz Republic in the sphere of public procurements prepares the estimative report on results of tender, with indication of the rating of winners;

- makes the decision following the results of the held competition.

All members of the interdepartmental contest committee bear responsibility for observance in the activities, the requirements established by the legislation of the Kyrgyz Republic, for objectivity of decision making, and also for disclosure of information which, according to tender conditions, is trade secret.

Members of the interdepartmental contest committee have the right in case of disagreement with the common decision of the interdepartmental contest committee to prepare written objection which shall be stated in the estimative report and in the protocol of procedures of purchases.

9. Ministries, administrative departments and local government bodies:

- submit requests to authorized body according to the approved procurement plan;

- sign agreements to deliver goods, performance of works and rendering services.

10. Suppliers (contractors):

- participate in tender;

- sign the framework agreement with authorized body;

- sign agreements to deliver goods, performance of works and rendering services with the ministries, administrative departments, local government bodies.

3. Procedure for education of the interdepartmental contest committee

11. For carrying out each tender the new interdepartmental contest committee which affirms the order of authorized body as the sphere of finance in coordination with the interested ministries, administrative departments and local government bodies is created.
