About approval of regulations of rendering the state services in the sphere of social protection of the population
According to the subitem 2) article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" PRIKAZYVAYU:
1. Approve:
1) regulations of rendering the state service "Purpose of Retirement Benefits on Age" according to appendix 1 to this order;
2) regulations of rendering the state service "Purpose of the State Base Retirement Benefit" according to appendix 2 to this order;
3) regulations of rendering the state service "Purpose of the Public Social Benefits on Disability and on the occasion of Loss of the Supporter" according to appendix 3 to this order;
4) regulations of rendering the state service "Purpose of the Public Special Welfare Payments" according to appendix 4 to this order;
6) regulations of rendering the state service "Purpose of Benefits for the Birth of the Child and on Child Care" according to appendix 6 to this order;
7) regulations of rendering the state service "Purpose of Special Public Welfare Payment" according to appendix 7 to this order;
8) regulations of rendering the state service "Issue of Information on Receipt and Movement of Means of the Investor of the Single Accumulation Pension Fund" according to appendix 8 to this order;
9) regulations of rendering the state service "Establishment of Disability and/or Extent of Disability and/or Determination of Necessary Measures of Social Protection" according to appendix 9 to this order;
10) regulations of rendering the state service "Purpose of Benefit of Mother or to the Father, the Adoptive Father (Adopter), the Guardian (Custodian) Who Is Bringing Up the Handicapped Child" according to appendix 10 to this order;
11) regulations of rendering the state service "Purpose of Lump Sum Payment to Burial" according to appendix 11 to this order;
12) regulations of rendering the state service "Purpose of the Public Assistance in Type of Monthly Payments to Citizens of the Republic of Kazakhstan after Completion of the Period of Capitalization of Payments on Indemnification Caused to Life and Health of Workers by the Legal Entities Liquidated owing to Bankruptcy" according to appendix 12 to this order;
13) regulations of rendering the state service "Issue or Prolongation of the Reference to the Foreigner or the Stateless Person about Qualification Compliance for Independent Employment" according to appendix 13 to this order;
14) regulations of rendering the state service "Payment of Difference between the Amount of Actually Brought Compulsory Pension Contributions, Compulsory Professional Pension Contributions taking into account the Rate of Inflation and the Amount of Pension Accruals" according to appendix 14 to this order;
15) the regulations of rendering the state service "Purpose of public welfare payment to mothers having many children awarded with suspension brackets "Three-copecks piece are scarlet? and", "To? m_s it is scarlet? and" or entitled earlier "Mother heroine", awarded with the degree awards "Maternal Glory" I and II" according to appendix 15 to this order;
16) regulations of rendering the state service "Purpose of Attendance Allowance for the Disabled Person of the First Group since the Childhood" according to appendix 16 to this order;
17) regulations of rendering the state service "Implementation of Retirement Benefits from the Pension Accruals Created at the expense of Compulsory Pension Contributions, Compulsory Professional Pension Contributions from the Single Accumulation Pension Fund" according to appendix 17 to this order;
18) regulations of rendering the state service "Issue to the Participant of System of Compulsory Social Insurance of Information on Condition and Movement of Social Assignments" according to appendix 18 to this order.
2. Recognize invalid orders of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of April 1, 2014 as No. 139-O "About approval of regulations of rendering the state services" (registered in the Register of state registration of regulatory legal acts for No. 9379, published in information system of law of Ad_let on June 4, 2014) and of December 11, 2014 No. 313 "About introduction of amendments to the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of April 1, 2014 No. 139-O "About approval of regulations of rendering the state services" (registered in the Register of state registration of regulations for No. 10157).
3. To provide to strategic development department of the Ministry of health and social development of the Republic of Kazakhstan in the procedure established by the legislation:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in mass media and information system of law of regulatory legal acts of the Republic of Kazakhstan of Ad_let;
3) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan;
4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of health and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.
4. To committee of work, social protection and migration, the State center for pension payment of the Ministry of health and social development of the Republic of Kazakhstan to place the regulations approved by this order in places of tinning of the population in format, convenient for perception.
5. To impose control of execution of this order on the responsible secretary of the Ministry of health and social development of the Republic of Kazakhstan Kurmangaliyeva A. D.
6. This order becomes effective after ten calendar days after day of its first official publication.

1. Regulations of rendering the state service "Purpose of Retirement Benefits on Age" (further - Regulations) No. 279 "About approval of standards of the state services in the social and labor sphere" (registered in the Register of state registration of regulatory legal acts for No. 11342) is developed according to the subitem 2) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services", the Standard state the services "Purpose of Retirement Benefits on Age", the approved order of the Minister of health and social development of the Republic of Kazakhstan of April 28, 2015 (further - the Standard) and determines appointment procedure of retirement benefits by age (further - retirement benefits).
2. The state service appears territorial subdivisions of Committee of work, social protection and migration of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan (further - the service provider).
Reception of an application and issue of result of rendering the state service is performed:
through non-commercial joint-stock company "The Government for Citizens state corporation (further - the State corporation);
through the web portal of "the electronic government" www.egov.kz (further - the portal) in case of receipt of information on appointment (about refusal in appointment) retirement benefits.
3. Form of rendering the state service: electronic (partially automated) and (or) paper.
4. Result of rendering the state service:
in the State corporation - the notification on appointment (refusal in appointment) retirement benefits;
on the portal - information on purpose of retirement benefits in electronic form, certified by the digital signature (further - the EDS) the service provider.
Form of provision of result of rendering the state service: electronic and (or) paper.
5. The basis for the procedure (action) for rendering the state service is the statement of uslugopoluchatel with application of documents, provided according to Item 9 of the Standard.
6. Actions of the service provider in the course of rendering the state service:
1) the specialist of department (management) of the service provider performing functions to destination of retirement benefits within two working days:
considers the arrived electronic prototype of case with the electronic draft decision (checks correctness of calculation, quality of the scanned documents);
returns in department of the State corporation electronic prototype of case with the electronic draft decision in the presence of the bases for familiarizing with electronic prototype of case of additional documents, for decision making about purpose of retirement benefits no more than thirty working days in time.
If within thirty working days required documents are not submitted, the service provider passes the decision on appointment (refusal in appointment) retirement benefits according to the available documents according to Item 26 of Rules of provision of the state base retirement benefit at the expense of budgetary funds, and also appointment and implementation of retirement benefits on age, the public social benefits on disability, on the occasion of loss of the supporter, the public special welfare payments approved by the order of the Minister of health and social development of the Republic of Kazakhstan of April 14, 2015 No. 223 (it is registered in the Register of state registration of regulatory legal acts for No. 11110) (further - the Rules approved by the Order No. 223);
in the presence of the bases within five working days from the date of receipt of electronic prototype of case to the service provider checks reliability of the submitted document, including from information systems (further – IS) through lock of "the electronic government", with the notification on it of uslugopoluchatel through department of the State corporation in form according to appendix 19, approved by the Order No. 223;
certifies the electronic draft decision by means of the EDS:
about purpose of retirement benefits in case of full compliance of electronic prototype of case according to the Standard;
about refusal in purpose of retirement benefits with indication of causes of failure in cases not of provision of required documents, establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them, discrepancies of uslugopoluchatel and (or) the provided materials supplied and the information necessary for rendering the state service, to requirements, approved by the Order No. 223);
sends in the automatic mode electronic prototype of case with the electronic draft decision on appointment (refusal in appointment) retirement benefits to the head of department (management) of the service provider.
At this stage the electronic prototype of case with the electronic draft decision on appointment (refusal in appointment) retirement benefit certified by the EDS of the specialist of department of the service provider is result of the procedure (action) for rendering the state service;
2) the head of department (management) of the service provider performing functions to destination of retirement benefits within two working days:
considers the arrived electronic prototype of case with the electronic draft decision (checks correctness of calculation, quality of the scanned documents);
returns in department of the State corporation electronic prototype of case with the electronic draft decision in the presence of the bases for familiarizing with electronic prototype of case of the additional documents necessary for decision making about purpose of retirement benefits no more than thirty working days in time;
in the presence of the bases within five working days from the date of receipt of electronic prototype of case to the service provider checks reliability of the submitted document, including from IS through lock of "the electronic government", with the notification on it of uslugopoluchatel through department of the State corporation in form according to appendix 19, approved by the Order No. 223;
certifies the electronic draft decision by means of the EDS:
about purpose of retirement benefits in case of full compliance of electronic prototype of case according to the Standard;
about refusal in purpose of retirement benefits with indication of causes of failure in cases not of provision of required documents, establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them, discrepancies of uslugopoluchatel and (or) the provided materials supplied and the information necessary for rendering the state service, to requirements, approved by the Order No. 223;
sends in the automatic mode electronic prototype of case with the electronic draft decision on appointment (refusal in appointment) retirement benefits to the head of the service provider.
At this stage the electronic prototype of case with the electronic draft decision on appointment (refusal in appointment) retirement benefits certified by the EDS of the head of department (management) of the service provider is result of the procedure (action) for rendering the state service;
3) the head of the service provider performing functions to destination of retirement benefits within one working day:
considers the arrived electronic prototype of case with the electronic draft decision (checks correctness of calculation, quality of the scanned documents);
returns in department of the State corporation electronic prototype of case with the electronic draft decision in the presence of the bases for familiarizing with electronic prototype of case of the additional documents necessary for decision making about purpose of retirement benefits no more than thirty working days in time;
in the presence of the bases within five working days from the date of receipt of electronic prototype of case to the service provider checks reliability of the submitted document, including from IS through lock of "the electronic government", with the notification on it of uslugopoluchatel through department of the State corporation in form according to appendix 19, approved by the Order No. 223;
by means of the EDS makes the decision:
about purpose of retirement benefits in case of full compliance of electronic prototype of case according to the Standard;
about refusal in purpose of retirement benefits with indication of causes of failure in cases not of provision of required documents, establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them, discrepancies of uslugopoluchatel and (or) the provided materials supplied and the information necessary for rendering the state service, to requirements, approved by the Order No. 223;
sends to department of the State corporation in the automatic mode the made decision;
in case of the certificate of the EDS the notification on appointment (refusal in appointment) retirement benefits automatically sends to department of the State corporation.
At this stage decision making about appointment (refusal in appointment) and the direction in the automatic mode of the made decision on payment is result of the procedure (action) for rendering the state service.
7. Terms of rendering the state services are specified in item 4 of the Standard.
8. In the course of rendering the state service the following workers of the service provider participate:
specialist of department (management) of the service provider;
head of department (management) of the service provider;
head of the service provider.
9. Order of interaction of structural divisions (workers) of the service provider in the course of rendering the state service:
the specialist of department (management) of the service provider within two working days sends in the automatic mode electronic prototype of case with the electronic draft decision on appointment (refusal in appointment) retirement benefits to the head of department (management) of the service provider;
the head of department (management) of the service provider within two working days sends in the automatic mode electronic prototype of case with the electronic draft decision on appointment (refusal in appointment) retirement benefits to the head of the service provider;
the head of the service provider within one working day makes the decision on appointment (refusal in appointment) retirement benefits. The description of the sequence of procedures (actions) between workers of the service provider with indication of duration of each procedure (action) it is provided in appendix 1 to these regulations.
10. Documents acceptance from uslugopoluchatel is performed in department of the State corporation by the barrier-free principle, according to the procedure of "electronic queue".
11. The department of the State corporation within three working days creates electronic (paper) prototype of case of uslugopoluchatel.
At the same time the specialist accepting documents performs the following actions:
1) is created by request in the automated IS of state body for availability of the fact of appointment or payment. In case of detection of the fact of appointment or payment of retirement benefits issues the receipt on refusal in reception of an application on purpose of retirement benefits in form according to appendix 4 to the Standard;
2) is created by request in the relevant IS through lock of "the electronic government":
in IS the State database "Physical persons" - according to documents, the uslugopoluchatel proving the identity and confirming registration on the permanent residence;
in IS "ZAGS" - according to the certificate of birth of child(children) or the statement from the birth record (on the registration made in the territory of the Republic of Kazakhstan after August 13, 2007), under the certificate on marriage (on the registration made in the territory of the Republic of Kazakhstan after June 1, 2008), according to the death certificate of children (on the registration made in the territory of the Republic of Kazakhstan after May 1, 2008);
in IS "E Guardianship" - according to documents on establishment of guardianship (guardianship);
in IS "Supreme Court" - by a court decision about adoption (adoption) of child(children);
3) checks completeness of document package, accepted from uslugopoluchatel;
4) is checked by condition of the service record, in case of absence in it the corresponding records, availability of corrections, inaccuracies, discrepancies, requests from the applicant submission of references of archival organizations or from place of employment;
5) scans the documents submitted by uslugopoluchatel including in case of lack of data from information systems of state bodies;
6) is provided by quality of scanning and compliance of electronic copies of documents to the originals provided by uslugopoluchatel;
7) is registered by the statement and issues the receipt on adoption of documents.
In case of provision of incomplete document package according to the list, stipulated in Item 9 Standards, and (or) documents with the expired effective period, lack of the right to purpose of retirement benefits on age the receipt on refusal in reception of an application in form according to appendix 3 to the Standard is issued.
The specialist creating prototype put, performs the following actions:
1) performs check on compliance of the amounts specified in the certificate of the income, the electronic statement of turnovers from the transit account of the investor.
In case of discrepancy of the specified amounts requests from uslugopoluchatel representation from place of employment of the certificate confirmation of transfer of compulsory pension contributions;
2) is created by electronic prototype of case with the electronic draft decision of uslugopoluchatel;
3) makes calculation of the size of retirement benefits for age, draws up the electronic draft decision, certifies the electronic draft decision EDS and sends to branch of the State corporation.
In cases of low-quality scanning of the documents submitted by uslugopoluchatel of need of provision of references of archival organizations or from place of employment returns to the specialist who accepted documents.
12. Branch of the State corporation within two working days from the date of receipt of electronic prototype of case with the electronic draft decision from department of the State corporation
Considers 1) and checks correctness of calculation of the size of retirement benefits and registration of the arrived electronic prototype of case and the electronic draft decision;
2) is sent to the service provider by the electronic prototype of case and the electronic draft decision certified by the EDS.
13. In case of return of electronic prototype of case with the draft of the electronic decision from the service provider because of need of familiarizing with electronic prototype of case of additional documents:
the specialist creating electronic prototype of case:
1) notifies uslugopoluchatel within five working days from the date of receipt in department of the State corporation of electronic prototype of case by means of telephone communication, including by means of transfer of the SMS notification on the mobile phone, on need of representation within 25 working days of the additional document(s) specified in the notification;
2) in case of representation uslugopoluchately the additional document(s):
within three working days from the date of provision of additional documents completes electronic prototype of case and the electronic draft decision, provides quality of scanning and compliance of electronic copies of documents to the originals provided by uslugopoluchatel, correctness of calculation of the size of retirement benefit, execution of the electronic draft decision, certifies the electronic draft decision EDS and sends to branch of the State corporation;
branch of the State corporation within two working days from the date of receipt from department of the State corporation of electronic prototype of case with the electronic draft decision:
1) is checked by correctness of calculation of the size of retirement benefits and registration of the arrived electronic prototype of case and the electronic draft decision;
2) is sent to the service provider by the electronic prototype of case and the electronic draft decision certified by the EDS.
14. The department of the State corporation within one working day from the moment of receipt from the service provider of the notification on appointment (refusal in appointment) retirement benefits prints out the notification and issues it in case of the personal address to uslugopoluchatel or informs the applicant on the decision made by the service provider by means of transfer of the SMS of the notification on the mobile phone of uslugopoluchatel.
15. In the presence of individual identification number (further - IIN) and the EDS is available possibility of receipt of information on purpose of retirement benefits in the mode of remote access through the portal for uslugopoluchatel.
The state service is provided to uslugopoluchatel whose documents were earlier submitted on paper to department of the State corporation and at the time of obtaining information on purpose of the state service data on uslugopoluchatel are in electronic form in the database of the automated information system of state body.
Step-by-step actions and decisions of the service provider (uslugopoluchatel) in case of receipt of information on purpose of retirement benefits through the portal:
1) the uslugopoluchatel performs registration on the portal by means of IIN and the password (it is performed for the unregistered uslugopoluchatel on the portal);
2) process 1 - input uslugopoluchately IIN and the password (authorization process) on the portal for receipt of service;
3) condition 1 - check on the portal of authenticity of data on the registered uslugopoluchatel through IIN and the password;
4) process 2 - forming by the portal of the message on refusal in authorization in connection with the available violations in data of uslugopoluchatel;
5) process 3 - the choice by uslugopoluchatel of the service specified in these Regulations, conclusion to the request form screen for rendering service and filling with uslugopoluchatel of form (data entry) taking into account its structure and format requirements and also the choice by uslugopoluchatel of the registration certificate EDS for the certificate (signing) of request;
6) condition 2 - check on the portal of effective period of the registration certificate EDS and absence in the list of the withdrawn (cancelled) registration certificates, and also compliance of identification data (between IIN specified in request, and IIN, specified in the registration certificate EDS);
7) process 4 - forming of the message on refusal in required service in connection with non-confirmation of authenticity of the EDS of uslugopoluchatel;
8) process 5 - the certificate of request for receipt of service by means of the EDS of uslugopoluchatel and the direction of the electronic document (request) through lock of "the electronic government" in the automated workplace (further - automated workplace) the service provider for processing by the service provider;
9) process 6 - registration of the electronic document in automated workplace of the service provider;
10) condition 3 - check (processing) by the service provider of request of uslugopoluchatel;
11) process 7 - forming of the message on refusal in required service in connection with the available violations;
12) process 8 - obtaining by uslugopoluchatel of the result of service (the notification in electronic form) created by automated workplace of the service provider. Information on purpose of retirement benefits on age is created with use of the EDS of the authorized person of the service provider, in form according to appendix 2 to these regulations.
Charts of functional interaction of the information systems involved in rendering service in graphical form are given in appendix 3 to these regulations.
16. Time of provision of information - no more than 30 minutes from the moment of receipt of request in information system of state body.
17. The scheme reflecting interrelation between the logical sequence of administrative actions in the course of rendering the state service and structurally functional units is provided in the reference book of business processes of rendering the state service "Purpose of Retirement Benefits on Age" according to appendix 4 to these regulations.
