For the purpose of ensuring execution of subitem 1.1.14 of the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About approval of the Customs code of the Azerbaijan Republic" of September 15, 2011 the No. 499 Cabinet of Ministers of the Azerbaijan Republic decides:

Approve "The preferential and simplified rules of customs clearance of goods and vehicles, live animals, perishable goods, radioactive materials, materials for the purposes of mass information, the goods sent to addresses of bodies of legislative, executive and judicial authority of the Azerbaijan Republic, the Central bank of the Azerbaijan Republic, and other similar goods necessary during natural disasters and other emergency situations" it (is applied).

The preferential and simplified rules of customs clearance of goods and vehicles, live animals, perishable goods, radioactive materials, materials for the purposes of mass information, goods sent to addresses of bodies of legislative, executive and judicial authority of the Azerbaijan Republic, the Central bank of the Azerbaijan Republic, and other similar goods necessary during natural disasters and other emergency situations

1. General provisions

1.1. These rules are prepared based on Articles 111 and 112 of the Customs code of the Azerbaijan Republic (further - the Customs code) and determine rules of customs clearance in the preferential and simplified procedure for goods and vehicles, live animals, perishable goods, radioactive materials, materials for the purposes of mass information, goods sent to addresses of bodies of legislative, executive and judicial authority of the Azerbaijan Republic, the Central bank of the Azerbaijan Republic, and other similar goods necessary during natural disasters and other emergency situations.

1.2. Application of customs payments in case of customs clearance of the goods and vehicles transported through customs border of the Azerbaijan Republic is determined by the Customs code and other regulatory legal acts provided in article 224.1 of this Code.

1.3. The documents submitted in case of placement of the goods and vehicles imported on customs area of the Azerbaijan Republic (further - customs area), under the declared customs procedure, are determined according to requirements of Article 150.3 of the Customs code.

1.4. For the purpose of simplification of customs clearance for implementation of separate customs transactions, the customs clearance in coordination with customs authorities, carried out in writing or electronically, can be carried out also to after hours.

1.5. The customs clearance of goods and vehicles, live animals, perishable goods, radioactive materials, materials for the purposes of mass information, the goods sent to addresses of bodies of legislative, executive and judicial authority of the Azerbaijan Republic, the Central bank of the Azerbaijan Republic, and other similar goods necessary during natural disasters and other emergency situations is carried out out of the sequence established in electronic management system "electronic queue".

2. Customs clearance of the goods imported on customs area for assistance to the population which was injured in natural disaster areas

2.1. The food products, goods and vehicles sent for assistance to the population which was injured in natural disaster areas, the spare part the personal belongings and other goods provided for staff of the relevant organs occupied with mitigation of consequences of natural disaster are considered as help load.

2.2. The customs clearance of the loads of the help imported on customs area for assistance to the population which was injured in natural disaster areas is performed in the preferential and simplified procedure irrespective of time.

2.3. The customs clearance of the loads of the help imported on customs area for assistance to the population which was injured in natural disaster areas according to Article 155.2.2 of the Customs code is performed with use of the simplified declarations.

2.4. The help loads imported on customs area for assistance to the population which was injured in natural disaster areas contain under customs control.

2.5. The help loads imported on customs area for assistance to the population which was injured in natural disaster areas are used only in the provided purposes. Use of these loads of the help for other purposes is allowed on permission of customs authorities after complete payment of the customs payments and fulfillment of requirements provided in the Customs code and other legal acts.

2.6. Are not applied to the loads of the help imported on customs area for assistance to the population which was injured in natural disaster areas, measures of trade policy, prohibitions and restrictions, and also customs payments.

2.7. In the customs checkpoint the preferential and simplified customs clearance of the loads of the help imported on customs area for assistance to the population which was injured in natural disaster areas is performed by customs authorities based on the documents (documents of maintenance, inventories) provided by responsible body (person). Customs authorities provide sending to customs authority of appointment which will carry out complete customs clearance, data on goods (in writing or electronically).

2.8. The customs clearance of loads of the help is performed after representation by body of obligations, responsible for them, and carried out based on the simplified declaration with indication of the main data necessary for the customs purposes.

2.9. After fulfillment of requirements, stipulated by the legislation for customs control and customs clearance, customs employees based on the data specified in the simplified declaration help loads perform the omission of these loads.
