Procedure for creation, operation, safety and order by networks of telecommunications of special purpose of public authorities"

1. General provisions

1.1. This Procedure is prepared on the basis of Item 1.9 of the Presidential decree of the Azerbaijan Republic of August 9, 2005 No. 277 "About application of the Law of the Azerbaijan Republic "About telecommunications" and determines the procedure for creation, operation, safety, the order by networks of telecommunications of special purpose (further - networks of telecommunications of special purpose) created for information exchange with limited turnover in public authorities of the Azerbaijan Republic.

1.2. Creation, operation, safety, the order by networks of telecommunications of special purpose is performed by the Ministry of Internal Affairs of the Azerbaijan Republic, the Ministry of Defence of the Azerbaijan Republic, Service of state security of the Azerbaijan Republic, Service of foreign intelligence of the Azerbaijan Republic, the Azerbaijan Republic, the State Border Service of the Azerbaijan Republic, the Presidential Security Service of the Azerbaijan Republic, Public service of special communication and information security of the Azerbaijan Republic, the State agency on protection of strategic objects of the Azerbaijan Republic according to Item 2.9 of the Presidential decree of the Azerbaijan Republic of August 9, 2005 No. 277 "About application of the Law of the Azerbaijan Republic "About telecommunications" and other executive bodies, the telecommunications creating special networks according to the legislation.

1.3. Creation, operation, safety, development, the order by networks of telecommunications of special purpose is performed according to the laws of the Azerbaijan Republic "About telecommunications", "About the state secret", this Procedure and other corresponding regulatory legal acts.

1.4. Networks of telecommunication of special purpose are created for the purpose of requirements satisfaction in the field of management, defense, safety and law-enforcement area of the state in telecommunication.

1.5. In this Procedure concepts from the Law of the Azerbaijan Republic "About telecommunications" are used.

2. Creation of networks of telecommunications of special purpose

2.1. Networks of telecommunications of special purpose are created by the state bodies specified in Item 1.2 of this Procedure by approval in the appropriate order of the relevant structures.

2.2. According to requirements of the legislation state bodies in projectible and under construction them networks of telecommunications of special purpose shall consider the software of data of networks, management of them, effective and safe activities of network, and also the organization of maintenance.

2.3. In case of creation of network of telecommunications of special purpose spare parts for their stable work shall be provided in emergency and military situations.

2.4. Networks of telecommunications of special purpose can be connected on the basis of the specifications issued by operators to telecommunication public service networks with submission of the document (certificate) confirming equipment compliance to the international documents. In this case networks of telecommunications of special purpose do not turn into category of network of telecommunications public and when using of their services restrictions remain.

2.5. If in case of construction of networks of telecommunications of special purpose means of radio communication and radio frequency, possibility of selection of the radio frequencies corresponding to means of radio communication are used it is determined by the State Commission on Radio Frequencies of the Azerbaijan Republic.

2.6. The operators of networks of telecommunications who are in interaction shall provide selection of sections on placement of the technical means relating to networks of telecommunications of special purpose in acting now and networks of telecommunications new under construction, means and installations, creation of reserve reservoir in linearly - cable installations and use of the feeding installations in the appropriate order.

3. Operation of networks of telecommunications of special purpose

3.1. Operation of networks of telecommunications of special purpose is performed according to the prepared public authorities of the internal instruction and rules of technical operation (if connection to networks of telecommunications public is excluded).

3.2. Servicing of terminals of networks of telecommunications of special purpose is performed by the relevant state bodies operating these networks.

3.3. If during the organization of communication in network of telecommunications of special purpose also networks of telecommunications public are used, determination and elimination of damages are regulated by the agreements signed between these structures. The employee of networks of telecommunications public is not permitted to change the place of terminals of networks of telecommunications of special purpose, connection, repair and detachment from network of other switching installations.

3.4.
