In pursuance of requirements of provisions of articles 6 and 10 of the Law No. 10-XVI of February 3, 2009 on the state supervision of public health (The official monitor of the Republic of Moldova, 2009, No. 67, the Art. 183), with subsequent changes and amendments, article 6 of the Law No. 186-XVI of July 10, 2008 on health protection and labor safety (The official monitor of the Republic of Moldova, 2008, Art. No. 143-144, 587), with subsequent changes and amendments, DECIDES: the Government

1. Approve Sanitary regulations on public health care and workers from the risks connected with functioning of gas stations it (is applied).

2. Provisions of Regulations are applied to all legal entities who design, build and operate gas stations, irrespective of type of property and form of business.

3. The gas stations which are constructed/reconstructed after entry into force of the Regulations approved in Item 1 of this resolution shall conform to its requirements, and already functioning gas stations will be brought into accord with Regulations till January 1, 2017.

4. To impose control over the implementation of this resolution on the Ministry of Health.

Sanitary regulations on public health care and workers from the risks connected with functioning of gas stations

I. General provisions

1. The sanitary regulations on public health care and workers from the risks connected with functioning of gas stations (further - Regulations), establish requirements for decrease in harmful effects on health and efficiency of workers and the population, prevention of risks which arise or can arise from harmful effects of chemicals or as a result of professional activity at gas stations.

2. In these Regulations the terms below have the following values:

a) zone of sanitary protection (zone) - the special territory with high security of operation which is established in perimeter of the production facilities and the companies which are source of environmental pollution and risk factor for health of the population;

b) gas station (station) - complex of buildings, constructions and the equipment which technological system is intended for filling of vehicles with two or three types of fuel.

3. In case of placement, construction or reconstruction of stations the zones of sanitary protection provided in appendix No. 1 to these Regulations shall be observed.

4. Placement and operation of stations as a part of complex objects for rendering services is allowed: service stations and testing, car washes, parking of vehicles, with observance of safe distance between the reservoirs, distributing fuel columns and the specified objects provided in the regulating document in construction of NCM G.05.03-2013 "Multifuel Gas Stations the Liquid Motor Fuel Liquefied by Hydrocarbonic Gas and Compressed Natural Gas".

5. In buildings of stations placement of retail trade Items and vending machines is allowed.

6. The realization of foodstuff in trade Items of stations is enabled with observance of requirements of the Sanitary regulations for trade items of food trade approved by the Order of the Government No. 931/2011. Activities of catering establishments at stations are performed according to the requirements established in the Order of the Government No. 1209/2007 about provision of services of public catering.

7. On blueprint stage of stations the sizes of zones of sanitary protection are confirmed by calculations taking into account background environmental pollution and traffic load of vehicles. The zone can be expanded if it is proved by the corresponding calculations. Reduction of zone is not allowed. The territory of zone or the certain sector of zone cannot be used as the area for expansion of object.

8. Placement of stations in zone of protection of water basins, sources of supply with drinking water, resorts and sanatoria, in green zones of the cities, in the territory of natural reserves and their conservation zones, conservation zones of historical and cultural monuments is forbidden.

9. Acceptance in operation of stations is performed based on results of laboratory researches of atmospheric air on border of the sanitary protection zone, air of the working area, drinking water, measurements of microclimate and lighting on workplaces.

10. In the territory of the station there shall be sectors for the temporary parking of vehicles.

II. Requirements for ensuring public health care

11. The area of the station shall be paved or asphalted, framed with curbstone, arranged well and planted trees and shrubs by trees and bushes of deciduous breeds.

12. In the territory of the station trees and bushes, especially near apartment houses shall be planted.

13. The territory of the station shall be inclined plane for providing free drain of waters from surface in network of the stormwater drainage system.

14. In the territory of the station sectors (platform) with reservoirs for separate collection of household and technical waste shall be provided.

15. Export of waste from the territory of stations is made on the basis of the agreements signed with specialized enterprises.

16. The territory and premises of the stations shall be kept clean. Their pollution is not allowed by remaining balance of fuel or oils.

17. In the territory of the station there shall be special places for storage of sand, sawdust, special ladles, buckets with covers, the neutralizing means.

18. In case of pollution of the soil, platforms, the equipment, packagings and other objects oil products it is necessary to take urgent measures on their neutralization.

19. The soil and other surfaces polluted by oil products it is necessary to neutralize right after infection by use of 3% solution of chloroamine or chloric lime in proportion 1:3 with water, and to process metal surfaces solvents (kerosene, alkaline solutions).

20. Napkins, sand, sawdust and other materials polluted by oil products shall be stored in the closed reservoirs in the territory of the station in the certain place.

21. Cleaning of the territory is performed daily, according to the schedule approved by administration of the station. In summertime cleaning of the territory is performed by damp method.

22. The deposit with the liquefied gas (containing etilmerkaptan) is exported from the reservoir on specialized enterprise based on the agreement signed with it.
