According to the subitem 67) of Item 15 of the Regulations on the Ministry of national economy of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of September 24, 2014 No. 1011, I ORDER:

1. Approve the enclosed technique of cost determination of services in advisory support of projects of public-private partnership, including concessionary projects.

2. To provide to department of budget investments and development of public-private partnership of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order its direction on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising Vice-Minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Technique of cost determination of services in advisory support of projects of public-private partnership, including concessionary projects

Chapter 1. General provisions

1. This Technique of cost determination of services in advisory support of projects of public-private partnership (further - PPP), including concessionary projects (further – the Technique) is developed for the purpose of ensuring rational use of budgetary funds according to the budget programs for advisory support of projects of PPP, including concessionary projects and has advisory nature.

2. The cost of services in advisory support of projects of PPP, including concessionary projects (further – services) is determined by the central and local executive bodies according to this Technique.

3. Services in advisory support of projects of PPP, including concessionary projects include:

1) in case of determination of the private partner by tender method:

development of information leaf on the project in case of two-stage tender at the choice of the private partner or the concessionary;

development of information leaf on the project in case of one-stage tender at the choice of the private partner or the concessionary, including development of the specification on development or adjustment of the feasibility statement on the project of PPP, including the concessionary project (further – the feasibility study);

development of information leaf on the project in case of one-stage tender at the choice of the private partner or the concessionary with calculation of cost of binding of the available design estimates (further – the design and estimate documentation) to the specific platform of object, on the projects having developed by the design and estimate documentation, and also being technically simple, realized based on the standard projects, prototype project solutions and projects of repeated application which are not requiring the feasibility study;

development of the specification within the first stage of tender by determination of the private partner with use of two-stage procedures;

development of the tender documentation in case of tender at the choice of the private partner or the concessionary with use of two-stage procedures, including development of the specification on development of the feasibility study for the project of PPP, including the concessionary project;

development of the tender documentation in case of one-stage tender at the choice of the private partner or the concessionary including the feasibility study in the structure;

development of the tender documentation in case of one-stage tender at the choice of the private partner or the concessionary, including binding of the design and estimate documentation to the specific platform of object, on the projects having the developed design and estimate documentation and (or) development of the design and estimate documentation being technically simple, implemented based on the standard projects, prototype project solutions and projects of repeated application which are not requiring the feasibility study;

actions for search and involvement of potential investors, including holding the public presentations, road show, conferences, advertizing campaigns;

project development of the agreement of PPP, including concession;

project development of the direct agreement with creditors of the private partner or concessionary;

modification and amendments in the approved tender documentation (adjustment);

rendering consulting services in negotiation process of the Commission on consideration and selection of competitive and concessionary requests with the participant of tender at the choice of the private partner or the concessionary, and also participation in negotiations;

independent tender bid evaluation of projects of PPP, including concessionary projects.

2) in case of determination of the private partner by method of direct negotiations:

rendering consulting services in negotiation process with the private partner before approval of the business plan, including:

maintenance of adoption of the request, provisional estimate of the business plan;

maintenance in case of qualification selection;

participation in negotiations on the business plan;

maintenance within examinations, adjustments of the business plan;

rendering consulting services in negotiation process with the private partner before agreement signature of PPP, including:

initial assessment of the agreement of PPP, its adjustment;

participation in negotiations on the agreement of PPP;

maintenance within examinations, adjustments of the agreement of PPP.

Chapter 2. Calculation of cost of services in advisory support of projects of PPP, including concessionary projects

Depending on specifics of the project of PPP, including the concessionary project, for calculation of cost of specific service correction coefficients to the cost of services in advisory support of projects of public-private partnership, including concessionary projects, according to appendix 1 to this Technique by multiplication of the amount of the corresponding coefficients by the cost of 1 person hour and normative labor costs are used:
