On regulation of rates for paid medical services
Based on subitem 2.1 of Item 2 of the Presidential decree of the Republic of Belarus of February 25, 2011 No. 72 "About some questions of price regulation (rates) in the Republic of Belarus", subitem 1.3 of Item 1 of the resolution of Council of Ministers of the Republic of Belarus of January 17, 2014 No. 35 "About approval of lists of socially important goods (services), the prices (rates) for which are regulated by state bodies, and recognition voided some resolutions of Council of Ministers of the Republic of Belarus" the Ministry of Health of the Republic of Belarus DECIDES:
1. Establish:
1.1. the limiting standard rate of profitability used for determination of the amount of the profit which is subject to inclusion in rates for paid medical services * in the amount of 30 percent to planned cost;

3. This resolution becomes effective after its official publication.

1. This Instruction determines procedure for establishment and application of rates for paid medical services in the list of paid medical services, rates for which are regulated by the Ministry of Health (in coordination with the Ministry of anti-monopoly regulation and trade), rendered by legal entities and individual entrepreneurs.
1-1. For the purposes of this Instruction the following terms and their determinations are applied:
range of services on radiodiagnosis – set of the medical services in radiodiagnosis provided to one patient within one research;
range of services on ultrasonic diagnostics – set of the medical services in ultrasonic diagnostics provided to one patient within one research.
2. Regulation of rates for the paid medical services rendered by legal entities and individual entrepreneurs to citizens of the Republic of Belarus, and also the foreign citizens who are constantly living in the territory of the Republic of Belarus if other is not established by legal acts and international treaties of the Republic of Belarus, is performed by the Ministry of Health in coordination with the Ministry of anti-monopoly regulation and trade:
2.1. on services in medical examination of the state of health of citizens for receipt of the medical certificate about the state of health confirming the validity to control of hand-operated cars, dental services (orthopedic and dental), on services on beam (including when rendering dental services), ultrasonic and laboratory diagnostics by establishment:
limiting maximum rates;
limiting standard rate of profitability;
limiting maximum allowances;
2.2. on services in functional and endoscopic diagnostics by establishment:
limiting standard rate of profitability;
limiting maximum allowances.
3. Legal entities and individual entrepreneurs within the maximum rates established by the limiting Ministry of Health and taking into account the limiting standard rate of profitability independently establish flat fares on the paid medical services rendered by them.
4. Rates for the paid medical services rendered by legal entities and individual entrepreneurs to the foreign citizens and persons without citizenship which are temporarily staying or temporarily living in the Republic of Belarus if other is not established by legal acts and international treaties of the Republic of Belarus, are established by them independently without limiting maximum rates, the limiting standard rate of profitability.
5. Rates for paid medical services are established by legal entities and individual entrepreneurs on the basis of planned cost, all types of the taxes established by the legislation and other obligatory payments, arrived, and also the features provided by this Instruction.
6. Costs join in the planned cost determined by the legal entity or the individual entrepreneur independently if other is not established by the legislation.
7. Taxes and other obligatory payments join in rates for paid medical services in the sizes and procedure determined by the legislation.
8. Rates for paid medical services are established proceeding from the regulations of time for their rendering established by the Ministry of Health and other regulations and standard rates of the material and labor costs determined by the legislation.
The regulations of time for rendering paid medical services established by the Ministry of Health decrease heads of legal entities and individual entrepreneurs on the basis of the carried-out timing of working hours depending on:
the applied technologies;
material equipment;
rendering medical services in beam and ultrasonic diagnostics in complex;
other factors which allow to optimize temporary labor costs.
By those types of paid medical services on which regulations and standard rates of material and labor costs are not determined by the legislation rates are established on the basis of economically reasonable regulations and standard rates of the material and labor costs approved by the head of the legal entity or the individual entrepreneur.
9. Rates for paid medical services are established by legal entities and individual entrepreneurs without the cost of the applied medicines, products of medical appointment and other materials which are paid by customers in addition.
10. The consumption rates of medicines, products of medical appointment and other materials on rendering paid medical services established by the Ministry of Health decrease heads of legal entities and individual entrepreneurs depending on the applied technologies, material equipment and other factors.
