About approval of Rules of utilization of the space objects and technical means taken out of service

According to the subitem 24) of Item 1 of article 9 of the Law of the Republic of Kazakhstan of January 6, 2012 "About space activities" I ORDER:

1. Approve the enclosed Rules of utilization of the space objects and technical means taken out of service.

2. To space committee of the Ministry for Investments and Development of the Republic of Kazakhstan (Musabayev T. A.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) 2) and 3) Item 2 of this order.

3. To impose control of execution of this order on the supervising Vice-Minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of utilization of the space objects and technical means taken out of service

Chapter 1. General provisions

1. These rules of utilization of the space objects and technical means taken out of service (further – Rules), are developed according to the subitem 24) of Item 1 of article 9 of the Law of the Republic of Kazakhstan "About space activities" and determine procedure for utilization of the space objects and technical means taken out of service.

2. Utilization, and also realization, transfer, accounting, write-off of the utilized objects and technical means of military (double) appointment are performed according to the Law of the Republic of Kazakhstan "About defense and Armed Forces of the Republic of Kazakhstan".

3. In these rules the following basic concepts are used:

1) utilization – final stage of lifecycle of space objects and technical means which represent complex of the organizational and technical actions and engineering procedures providing deorbitation of spacecrafts, dismantle, dismantling, conversion of space objects out of service and the technical means which developed the resource, physically obsolete, liquidated for the purpose of reuse details, nodes and materials of utilizable space objects and technical means and use of waste as secondary material or energy resources;

2) technical means – the equipment of any kind (mechanical, electric, electromagnetic, electronic) which is part of space systems and space missile systems and providing their normal functioning at all operational phases;

3) deorbitation of spacecrafts (further – deorbitation) – complex of organizational and technical actions for utilization of spacecrafts in Earth orbit by withdrawal of spacecrafts into burial orbit (for the spacecrafts which are in geosynchronous orbit of Earth) or returns to dense beds of the atmosphere (for spacecrafts Earth orbits which are on low and average near-earth) after the expiration of their operation.

Chapter 2. Procedure for utilization of the space objects and technical means taken out of service

4. Utilizations are subject:

1) spacecrafts, the corresponding prototypes and educational and training means after the expiration of warranty periods of their storage;

2) the equipment of carrier rockets, accelerating blocks and spacecrafts (including placed on manufacturing plants);

3) the technical means which are released in case of reconstruction or capital repairs;

4) the components of technical means taken out of service;

5) landers and capsules of spacecrafts after proper use and return to Earth.

4-1. Utilization of the spacecrafts which are in Earth orbit is carried out by deorbitation.

Deorbitation is carried out by the physical and (or) legal entities performing space activities on the basis of the current technical parameters of spacecrafts.

5. The basis for representation of space objects and technical means on utilization are:

1) the expiration of the useful lives determined by the specifications and technical documentation;

2) physical wear (before the expiration of useful lives);

3) planned replacement of the obsolete equipment;

4) economic inexpediency of carrying out repair and recovery owing to impact of adverse climatic factors, natural disasters, the fires;

5) lack of need of use for the intended purpose.

6. For utilization of space objects and technical means the physical and (or) legal entities performing space activities send lists of the space objects and technical means which are subject to utilization to department of authorized body in the field of space activities (further – department) in which are specified:

1) name, index;

2) year of release;

3) serial number (in the presence);

4) quantity;

5) availability of components;

6) location or place of warehousing;

7) availability of technical documentation.
