2. Declare invalid the order of the acting minister of agricultural industry of the Republic of Kazakhstan of August 5, 2011 No. 06-2/454 "About approval of regulations of the state service "State Testing of Agricultural Plants for Economic Usefulness" (registered in the Register of the state registration of regulatory legal acts for No. 7166, published in the Kazakhstanskaya Pravda newspaper of October 18, 2011, No. 332 (26723)).

3. To provide to department of production and conversion of crop products and phytosanitary safety of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan and the intranet portal of state bodies.

4. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. The state service "State Testing of Agricultural Plants for Economic Usefulness" (further - the state service) appears the Ministry of Agriculture of the Republic of Kazakhstan (further - the service provider) based on the standard of the state service "State Testing of Agricultural Plants for Economic Usefulness" approved by the order of the Minister of Agriculture of the Republic of Kazakhstan of May 6, 2015 No. 4-2/416 (it is registered in the Register of the state registration of regulatory legal acts of the Republic of Kazakhstan at No. 11777) (further - the Standard).

Acceptance of the request and issue of result of rendering the state service are performed through State commission on strain testing of crops (further - State commission).

Chapter 2. The description of operations procedure of structural divisions (workers) of the service provider in the course of rendering the state service

4. The basis for the procedure (action) for rendering the state service is availability of the request for inclusion of selection achievement in the State register (further - the request), including documents and materials according to Item 9 of the Standard.

5. Contents of each procedure (action) which is part of process of rendering the state service, accomplishment duration:

when carrying out testing of grades according to uslugopoluchatel:

1) clerk of State commission:

performs acceptance, consideration of the request and does mark about registration for copies of the application of uslugopoluchatel with indication of date and time of acceptance within 30 (thirty) minutes;

sends the request to the head of State commission for imposing of the resolution and determination of the executive in charge within 15 (fifteen) minutes;

in case of representation by uslugopoluchatel of incomplete document package according to the list, stipulated in Item 9 Standards, and (or) documents with the expired effective period refuses acceptance of the request;

2) the head of State commission studies the request, determines the executive in charge, imposes the relevant resolution and sends the request to the executive in charge within 3 (three) hours;

3) the executive in charge of State commission from the moment of receipt of the request in office of State commission within 44 (forty four) working days carries out expertize of the request and name of grade:

in case of receipt of positive results of examination of the request and name of grade, the notification on acceptance of new grade on testing for economic usefulness is issued to uslugopoluchatel;

in case of receipt of negative results of examination of the request and name of grade the State commission in writing notifies uslugopoluchatel on discrepancy of the request and (or) name of grade;

4) the executive in charge of State commission after issue of the notification on acceptance of new grade on testing for economic usefulness according to uslugopoluchatel carries out assessment of conformity of the submitted request on new grade according to Item 50 of Rules within 132 (hundred thirty two) working days:

in case of compliance documentation of new grade for consideration of Advisory council of State commission on consideration of entering of changes into the State register (further - Advisory council) for inclusion in the legal decision on the recommendation of grade is prepared for use;

in case of discrepancy documentation of new grade for consideration of Advisory council for inclusion in the legal decision on carrying out state strain testing is prepared;

5) the Advisory council considers results of examination of new grade and constitutes the conclusion with reasons for removal of selection achievement from further testing or inclusion in the State register on complex of economic and valuable signs (further - the conclusion) in form according to appendix of 4 Rules within 21 (twenty one) working days;
